We contracted with Viasat to supply us internet access for a plan that gave 25 MBPS speed and 60 gigs data cap. They installed their equipment on the 2nd of Sept. and we had them remove it on the 10th as we informed them that they broke their contract with us by only providing 9 MBPS download speed. They billed us the monthly service fee on the 14th. We disputed the charge, called Viasat to have them remove the charge and they then said it was a disconnect fee. On Oct. 4th, they charged my credit card for over $447. ( Their contract states a $15 per month charge for early termination of the 2 year contract.) Since we only had it for 8 days, that would be 24 x 15. Or $360. This company is a scam.

In the middle of October, they sent us a box filled with shredded styrofoam. We sent it back. On Nov. 1st, a UPS truck showed up to collect a satellite dish...Viasat's contracted tech removed all equipment on Sept. 10th. They called me the next day, admitted that they had the equipment and I told them I had facts that they broke the contract and they could take me to court!!

Bait and switch

By your argument, Viasat could give me ONE mbps and I would be still obligated to continue to pay $130 per month. Are you serious?? Do you work for Viasat or do you have a license to practice law?

Presently, this month they charged my credit card ONE PENNY. Last month it was $879. ( Based on their claim I never returned their equipment.) The Attorney Generals office is in contact with Viasat and we are waiting on them to respond to my offer to pay for the 8 days of service ($3.40 per day) and the $95 "trouble shooting" fee I agreed to.

I am convinced that they pull this crap because they have over sold their service ( one rep. told me my speed was probably slow due to TOO MANY PEOPLE using the satelitte. ) and then harass people when they cancel the crappy service. This has been 6 months now. But don't take my word for it, sign yourself up. LOL

 Even 1 megabits would be in line with their guarantees, since they don't guarantee any level of service availability or performance. Internet service with a Service Level Agreement (SLA) starts in the thousands of dollars per month. I am sure you can get the full bandwidth you paid for in the right conditions, say perfect weather and off-peak hours.

So their marketing is correct -- you can get the full advertised speed at least some of the time, and you can't get it all of the time. Your problem seems to be that you can't get the advertised bandwidth when you want to, which is more of a case of buyers remorse / not doing your homework.

Up Too??

They ALL say "Up to", but when they can only provide 9 mbps, which is even less than their lowest plan of 16mbps, then do tell me it isn't fraudulent!! They wanted to charge me $90 to have someone come out to check THEIR equipment. And the tech told me there was no issue with the equipment and 9 mbps was TYPICAL for Viasat. But if you believe 1 mbps would be acceptable under their plan, please go to law school.

"Vary”

 You’re making an invalid assumption which will NOT stand up in Court. As per the Contract, there are no limits delineating a range value of the "vary” statement. Therefore, the amount of variation is NOT fixed to within certain limits and hence you have no case!

I don't know about you, but they kept telling me that "Speeds may vary" which anyone not a moron would consider to be maybe 18 to 19 or even 28 or more. This was their Silver plan. They have a bronze plan for 16 mbps...since I got 9...i seriously doubt a judge would consider that speed falling under the quize of 25 mbps.

Your contract does not say that.

all ISP contracts say Up To and do not guaranteed the speed all the time. I have one of their contracts in front of me and it says Up To. So you are wrong on them breaking the contract.
