My truck was parked legally at 1109 Fern Dr. in front of the house that we were visiting. 1101 Fern has signs along their fence saying no parking. The tail of my truck was at least 30 ft from the edge of the property line. Winchester towing came in the middle of the night and towed several cars parked in front of the other property and took my truck as well.

I have pictures of my tire tracks in the snow where it was parked as well as proof that the property line goes to the fence. Winchester towing claims that the property line comes all the way to the telephone pole where I was parked. The police agree that I was parked legally and say that Winchester towing cannot tow from the street, but it is a "civil matter". They also reccomended that I file a complaint with the BBB and the city and file a civil lawsuit as well because Winchester towing is nothing but a bunch of crooks and they have been trying to put them out of business for years.(direct quote from the responding officer)

When I went to pick up my truck they refused to take my Visa credit card, a direct violation of the KRS dealing with towing. They have visa and mastercard stickers in the window and are required by law to take all commercially accepted forms of payment without exclusion including credit cards. They would not let me take my vehicle even after paying with a debit card until I signed a release form stating that they were not responsible for any damages or anything else which I signed with a note that said, "signed under duress".

They also ran my license plate which came back as no record found. This was because we had just gotten a new plate the week before and it was not in the system yet. They called the police and had my license plate confiscated which was easily rectified with the police as soon as I produced the registration. Had they simply asked before acting I wouldn't have had to run all over town to fix it and they used the opportunity to repeatedly accuse me of running "stolen" plates.

I believe they towed my truck simply because it had out of state plates and they thought they could get away without a fight. After leaving and doing some research on property lines and regulations on towing and billing I called and asked for Mike Winchester, but he was unavailable. I told Mary, the office manager, that if they would refund my $118 I would drop the issue and not say another word. If they were unwilling to do that I have prove that the truck was legally parked and illegally towed and that their billing practices were against the law and I would sue them for the tow as well as the cost of my trip that was ruined by this and the cost of subsequent trips that would now be neccesary to deal with the law suit. Mary told me Mike would call me back shortly and he never has. I have since discovered multiple websites of complaints about these crooks and stories that sound like carbon copies of mine. I have made it my mission to make them regret towing my truck.
