I have been attacked by Zwicker & Associates and need help to combat.  I live in Massachusetts and They have seized my bank accounts and I believe they are trying to garnish my wages.  I don't wish to file for bancruptcy and have been repaying my debts but I truly can not pay them if they act in such a manor.  What's more is that I'm afraid with the reports that I have read regarding this company that they will continue to disregard any contact I've attempted with them.  Over the past 2 years I have contacted them on nemerous occassions and asked to negotiate a settlement - they do not contact me but threaten and go through the courts.  Is there anyone that can help me with them in Massachusetts?

It really depends on what your exact situation is.


In order to have your accounts attached or your wages garnished you have to have a judgment against you.  That is basically the courts saying that you owe this money and they have every legal right to take further action.  Depending on your state this may include Wage Garnishment or Attaching of your accounts.  Now to get a judgement they have to file suit against you.  Part of this is that you must be Served(notified) and have a chance to defend yourself in court.


So if you were served properly and had a chance to defend yourself and either choose to ignore it or did not defend yourself successfully.  As long as they are following the court order you are pretty much screwed.  Especially if you have been paying on the debt...Sorry.


However, if you were never properly served you may have further options.  The first thing you need to is get a copy of the original suit.  If you don't have a copy of this your bank would as it would be on the attachment order.  You can then go to the Clerk of the Court where the suit was filed and pull the original suit.  You are most interested in the "Proof of Service".  


If the "Proof of Service" is fraudulent or delivered to a location they know you are not at you should be able to get the Judgement Vacated.  This basically cancels out the judgment and releases any attachments.  Then they have to re-file the suit.  Now, if you fall under this later situation but have been paying them anyways that may cause you some problems in trying to get the Judgement Vacated. 


Now, if you have proof that the "Proof of Service" is faked then you may also be able to go after them through the Civil Courts as well as the State Bar association.


The best thing you can do is do your intial research and if you think you have a valid argument contact a lawyer who deals in Consumer Debt.
