In may we fell behind 2 payments and both my husband and I tried to work out a way to get back on track with ASc but everytime you cal you get different answers and different numbers to call. My husband filed Chapter 7 and tried to re-affirm our house loans, but with absolutely no help from ASC he ended up at the end of october just filing on it too.

Both my husband and his bankruptcy lawyer tried to contact ASC to work out some kind of agreement with the loan company so we wouldnt loose our house. They would ask for paperwork over and over, tell us we would have to wait weeks for review and never call back. The house ended up in forclosure before the bankruptcy because we couldnt get any answers from ASC or get them to contact us regarding the loan.

They did at one point work out a modification ut it was to raise our payments by $60 a month, plus recoupe all the attorney fees for foreclosure which were over $3000.00. My husband called them to see if that was the best they could do and they again asked for more paperwork and then they would get back with us regarding paymets.

Our loan went from the original $98,000 that was owed to $106,000. But we never heard back from them again until his bankruptcy attorney called and told us that they wanted to get relief of stay from bankruptcy and go ahead with forclosure. We have done evrything to try and work out something with this company as well as the bankruptcy attorney, but they have proved impossible.

It wasnt until today 11/07/2006 that i found out that ASC has done similar things to other homeowners and have been pretty much one negative thing after another about the way they have treated homeowners unfairly. Seems to me that they have proffited hugely from their scamming business they call a loan company. I read complaint after complaint about how they treat homeowners. i think its time to do something about this company. this many people cant be making up stories about their expeiences.

i have found very scary similar instances that are all to familiar to me and my husband. Its too late for us to save our home because my husbands bankruptcy was discharged today and we have already lost our home to these MONSTERS! They find a house they can proffit on and then when they see a way to get you out of it they do. People work hard to be homeowners and to be basically screwed by someone like ASC is a disgrace to people who have worked so hard like us to be first time homeowners.
Whats even more sad is that I cant explain to my baby girl why we have to move because she doesnt want to.

We made bad financial choices, but we thought we were protected when we filed bankruptcy, but ASC pretty much made it impossible for us to work out something to keep our home.
Surely they cant keep doing this to hard working Americans who struggle as it is just to live, and then they take away the only pride they have left. THEIR HOMES!!!

Since there were repeated attempts to reach ASC and work out something with them, numerous "we'll call you back" or let me give you over to someone else, my husband finally ended up including our house in his bankruptcy. He did this because he was afraid his bankruptcy would be discharged and he would be left with a loan with ASC that would be impossible to work out. So yes, they proffited. The crooks got our house and are taking advantage of homeowners all over the US. I think its a d**n shame that somebody doesnt step in and do something to these CROOKS!!!

If you house is worth, say, $250,000 and you owe $98,000 on it, then yes, Americas Servicing Company will profit. But if your house is worth $120,000 then no, they will end up with almost $105,000 invested in a non-performing asset, plus their carrying costs for taxes and property protection and supervision, plus RE commissions when the house is sold. This latter scenario is not a great moneymaker. But perhaps ASC account mangers are under the gun to prevent the houses they have mortgages on from being involved in an owner's bankruptcy.
