 I am hoping that by writing this no one else has to experience what I have gone through.  October 20, 2013 I had to trade in my 2003 Jeep Liberty, becuase of extensive engine problems.  For the two years that I have had the Liberty, I have put in over 9000 in maintenance bills.  I am on a limited income.  I had called Credit Acceptance to let them know the Jeep was traded in , and that I had to stop the payment that was due to come out.  The gentleman at the Dealership called credit acceptance to get a pay off.  I thought everything was okay.  Until Moday October 21st 2013 up until now, I have received over 50 calls from Credit acceptance.  That is let me remind you, the Jeep was no longer in my possession.  I figured all was well.  Well I certainly thought wrong.  Not only have they harassed me, they have harassed the dealership.    What really concerns me, is that they were accusing me of stealing the jeep and they would have me arrested  and I said sure, go ahead.  I am deeply distraught because they would not veryify who they were over the phone, and I kept asking hello how can I help you.  I then said , if you are not going to answer me , I am going to hang up.  When they finally said who they were, I was already hot under the collar.  In other words I was angry.Well we are planning on having you arrested, I said go ahead, the officers cannot do anything about that since the transfer of vehicle was legal and according to law.   To make a long story short, several times they have called and my children had answered the phone.  They immediately started harassing them and said tell her not to leave cops are coming.  My kids started screaming.  The bottom line is that the Jeep was traded in on the 20th and the company is still harassing me and my children and anyone else that picks up the phone  They should not be allowed to continue this behavior, even if I was late on payments, they took them out automatically from my account.  I am frustrated to the point where i feel bullied by a company and stalked by the company as well.  Something has got to be done about their scare tactics, it should be illegal for companies to bully people.  I was late three times in two years but never more than a few days, except the time I was in the hospital and was late two weeks.  I am sorry for being late but the payments always were made.  They are a despicable company that steals money from those who desperately need a vehicle.  Please do something about this, it is wrecking my family's life. I am scared because of what they have done.  There is no privacy with this company   Shannon, Carterville, Illinois

 I actually am on my second vehicle with Credit acceptance. I needed to use them the first time and stuck with them the second. I here what everyone is saying that yes, she is responsible for her loan until they get the payoff. If she was to make payments, I would hope that they would send her back a check for overpayment once they got the payoff.

Today, I am a very angry and unhappy person. I just called Credit acceptance to make my payment. My account is current. My due date was yesterday. I called today to make the payment and was berated and talked to rudely..asked to speak to a supervisor , I get a man on the phone who I then find out after I call again that he isnt even a supervisor. Both parties were rude to me, I asked the first rep can I please have the automated line for debit cards, not the western union so I can make my payment. Her response was " Can you tell me why you're late" I'm sorry but i'm not sure if what world the day after the due date is late..maybe I will get bashed but come on..I didnt get to it yesterday so i'm hassled..when the socalled supervisor gets on, and I tell him the companys customer service is lacking, he tells me this is collections. I said Collections?? my accoutn is current. He said , "no it's not its a day late"...really??

I'm not going to go around and around, not everyone makes excuses when they call or get called from this company and not everyone is late, the bottom line is we are the customer, the companies wont exist without their customers. I dont care what type of situation is going on, if you contact a customer or they contact you, treat them with respect, ask questions in a nice manner and it will go a long way. Credit Acceptance could contact the dealer and find out whats happening, they can note the account and say, the customer is trying to get information from the dealer about the payoff..they do harrass..and i'm sorry but if that is how I was treated for paying a day after my due date, I clearly believe this woman was harrased to the extend that she's saying.

The Payoff

The problem is with the dealership where you traded this Jeep in.  It is THEIR RESPONSIBILITY to pay off the Jeep.  If they didn't, you need to get with them and find out why.  In the meantime, enjoy your new car.  No...enjoy driving one car but paying for two because the payoff does not magically disappear!

Did Credit Acceptance Receive the Payoff?

If the lender did not recieve the payoff amount you are still responsible for the loan.  It doesn't matter whether you have the vehicle or not.

The dealer may have called for a payoff amount but have they actually sent the payment to them?  If they did, when did they send it?  You cancelled your last payment and if they have not recieved a payment since then or the payoff then yes your loan is in defualt.

There are cases where dealers will take a vehicle on trade but are slow to send in the payoff amount to the lien holder. There are a few reasons they do this.  1) They may be waiting to get funded by the new loan company then they will send a check to Credit Acceptance.  2) The dealership has accidently not sent the payoff or 3) The dealership has not sent the payoff as they are using the money funded to them by the new lender to satisfy other leins on vehicles that were traded in. 

In case 3 what happens is the dealership is run poorly and do not have the cash reserves available to payoff an existing lien (loan) on a traded vehicle. So when they recieve the funds from your sale from the lender they will be using that amount that should have been used for your payoof on someone elses trade in. 

You should go to the dealership right away and ask them when they sent your payoff to Credit acceptance, the amount that was sent, and what the check number was and what address they sent it to.  While there ask them to contact Credit Acceptance right them with you in the office so you can get this matter cleared up.  Be sure to take Credit Acceptance's contact info with you.  If for any reason the dealer hesitates, or gives a reason why they can't do it now you should suggest you will be contacting the Attorney Generals office or the agency in your state that would look into such matters. 

If the dealer is not making the payoffs as they should they are commiting fraud which is having a negative impact on your credit.

 That is let me remind you, the Jeep was no longer in my possession.

- It doesn't matter if the car is still in your possesion, you "traded" it in, it burnt up in a fire, is at the bottom of the ocean, or on the moon.  Until the loan is paid off you are 100% responsible for any payments that need to be made.  So your issue is not with this company it is the dealer.  Just keep in mind that it can take some dealers almost 30 days to payoff your vehicle.  So what did you get in writing from the dealer as to when they will pay off this loan?

So yes this means that if you have/had a payment due and did not make it..you are late. 

 They are a despicable company that steals money from those who desperately need a vehicle.

- You borrowed several thousand dollars on the promise that you would make regular payments on a specific date for a specific amount.  So exactly how did they "steal" your money?  Then how come when they stole your money you didn't turn the tables on them and call the police.

Please do something about this, it is wrecking my family's life. I am scared because of what they have done.

- While it is impossible to say how much exaggeration you are doing, if they are threatning you with the cops and jail that is wrong.  But on the flip side they ar a sub-prime lender who on a daily bais deal with people who make up one excuse or another why they aren't paying on their loan.  But so far it seems like you are handling the phone calls pretty well.  Perhaps you should get on the dealer to pay off the car loan.  Until then either stop picking up the phone or make the payments to keep you current.
