I’m suing Credit Acceptance. I purchased a car February 2017. After my 30day temp tag period was up, I got my license plates. Everything was going fine. I had the end of Feb 2018 to renew my tags, I try to renew my tags and was told I couldn’t because there’s also a title issued out in Florida to my car. At that point I was confused and mad. I called Credit Acceptance and asked them what’s going on, how did that happen. They only thing they could say was "oh, we don’t know how that could’ve happened”. I was livid at that point. They told me they will freeze my payments until this situation is dealt with. They send me info I needed and told me to call Florida DMV. WHY AM I DOING THEIR JOBS!!! Why do I have to get my title situation worked out?? It’s not my fault that this happened. It’s now mid April and Florida DMV or Credit Acceptance isn’t helping me. Credit Acceptance still calls my phone for payment. My Mom called them and told them I’m not paying anything since I’m unable to drive the vehicle because my tags are expired. I pay my car note every month on time and that’s all I should be doing. Why do I have to get my title situation worked out when it’s not my fault. That’s their job. The title department tells me they don’t know what happen and it’s my responsibility to check with Florida DMV to see what’s going on. They are also like yeah we understand you can’t drive your car, that’s not our fault, we still want our money. I’m really feed up and frustrated. I lost my job because of this situation and I’m ready to get my money back and they can get the car or they can get sued. I’ve never been so mad in my life.

Dealer Will LIkely Not do Anything

The dealer is going to claim the finance company should have checked title before issuing you a loan, and the finance company says it's the dealer's responsibility to make sure they're legally able to sell you a car.  The problem at this point is that you need to get clear title.  There are ways in which you can at least start the process:

1.  I would go to a website where you can plug in your VIN number for free to check title and the previous owners.  Take that information down.

2.  Go to the dealer and see if they have the bill of sale - they had to buy the car from someone.

My guess (and it is a guess) is that the dealer never got clear title for the car they sold you.  Now, if they don't have the bill of sale from the prior owner, they (and you) have a real problem because you own a car that belongs to someone else and they sold you a car that didn't belong to the dealer.  Now you can still obtain title, BUT the process may now include having to contact a title company that can help you obtain title for a fee.

The other problem you may have is if the reason you can't get clear title is because the car was listed as totaled, either through an accident or flood.

Now, as far as the CAC goes, they have the obligation to collect on the loan they provided to you and you have the obligation to pay.  Now, depending on how the aforementioned issues turn out, you may have to sue the dealer for a car they didn't legally own.

You have a lot of work ahead of you - at least the way I see it.  Best of luck to you....

 You are being financed by a subprime (deadbeat) lender because of YOUR poor reputation of paying your bills on time...otherwise you would have been financed by a bank. Suddenly you have all this money to hire an attorney, right? Come on...tell us some more jokes! Whatever title problems you may or may not have are with the dealership! (Of course, this wouldn't be the first time a subprime borrower tried to discredit the lender!)

 First of all I didn’t have good enough credit from the beginning so wtf does that have to do with me paying bills. I just said I pay my bills on time every month so what you’re talking about is really irrelevant.

Your issue is NOT with CA. They are just a finance company, they have NOTHING to do with the title(other than being a lienholder). They loaned you money to purchase a car with the understanding that you would make a set amount of payments for a period of time. You having or not having the car, or being able to drive it or not is NOT a condition of paying the loan back. So they do have the legal right to continue to require payments...Sorry.

Now, I am not saying you are not in a bad situation or that it is your fault. Just that you need to deal with other people to get this solved.

Your issue appears to be with a couple of groups. First with the dealer that originally sold you the car, they can not sell a car that they do not have a legal right to sell. Next is your State and the State of FL, if your State is saying that there is a title out of FL they should be able to provide you enough information to track that down and should not have issued you your plates in 2017. To find out more information this MAY actually require you to go to your DMV to get someone to help you face to face.

Personally I would get something in writing from your DMV stating it can't be renewed due to the other title, then look at going after your original dealer either by talking to them or through the courts.
