Put simply, know your own facts Mr. Hicks.  The 13,000 due has nothing to with the time you were in Iraq and all those payments were reported to the courts.  The payments made directly to Trayc were never discounted or told to anyone that they had never been made.  She knows you made them, provided Missouri child support enforcement an affidavit stating the same.

The 13,000 is the result of your choice to continue requesting continuances for a modification of support.  The original request for modification was set in Nov 2005.  Using continuances left and right and not completing the modification is what led to the arrears.  Illinois law is very clear that when a modification for support is requested, that the modified amount is retro-active to the date of file.  Had Mr. Hicks not prolonged the court process with dozens of continuances, the resulting arrears would not have been so much.

3 years of modification arrears adds up to a lot, a lot more than Mr. Hicks final judgement against him was for. 

He should be thanking Trayc, the attorneys and the courts for settling for an amount that should have been around 18k.

And good luck with your court hearing in June, Missouri can't do anything about the Illinois judgement....but best to you on that.

Trayc R. Foutz (Hermann) from Swansea, Illinois 01/21/1976 is misleading in her accusations. Child Support has been paid regularly since March 2003. As an Active Duty Army Soldier, paying child support is a must! In March 2003, 3 days prior to deploying to Iraq for the initial invasion, child support was awarded to Mrs. Foutz.

Mrs. Foutz requested transfering the case from Peori Il to St. Clair Co. Il. Without enough time to have the child support switched, Mrs. Foutz, myself AND our two Attorneys agreed that support would be paid directly to Mrs. Foutz bank account WITHOUT the reprocussion of the "gift" law. After returning from Iraq, I was reassigned to Alaska and once again deployed to Iraq. The span of time it took to finally return to the "lower 48" was about 4 years.

So, for four years child support was coming directly form my pay to Mrs. Trayc R. Foutz. During my duty in Alaska Mrs. Foutz realized I was receiving extra pay for my other 3 children and wife for being in Alaska. This is called (COLA). Mrs. Foutz knew that according to Illinois law she could steal 20% of my other childrens income so she did. She was receiving $996.00 a month for one child due to the funds that were supposed to support 3 other children.

After exiting the military and returning to Missouri, I became unemployed for a couple months. After regaining employment, child support was adjusted to $325 a month with an additional $135 for arrears. Mrs. Foutz was upset to not be receiving $996.00 for one child and know in Illinois the courts would uphold the previous agreement of direct payment so she petitioned the Mo. child support agency for back support saying the 4 years of support I payed during my overseas assignments was a "gift". Missouri, going strictly of the greed induced lies, filed a suit against me. I of couse am fighting the suit and have a court date in June 2010. 

I see my son regularly and pay my support through the courts. Mrs. Foutz receives every penny she is alloted by the courts according to the 50% law.

If paying your support and having a wonderful relationship with your child and God is the definition of a "Dead Beat Dad" than I am guilty as charged and proud of it!!
