How shall I begin this...

Fact 1. We signed our contract Oct , 2003
Fact 2. Home didn't get moved till November 29 or so.
Fact 3. Mortgage due Dec 1st.
Fact 4. We didn't move into our home till Dec 31, 2003 (and we've been harassed ever since.)
Fact 5. Yes, we're late by 2 months.
Fact 6. We have not received any LETTERS telling us what amount is due, only a PRIVACY Statement letter.
Fact 7. Today the people we pay our lot rent to (they are not even written anywhere in our contract that gives Vanderbilt permission to call them) calls us to inform us to call Mark from Vanderbilt.

Now I want to know when did Vanderbilt start contacting people that aren't listed as a "contact person" in your contract? Who will they call next... our phone company? our utility company? Our insurance company?

With Vanderbilt contacting our lot landlord whom isn't listed as a contact person on our contract.... Wasn't this a breech of contract?????

Anyone with solid suggestions please reply!!! I don't want to read replies about all this being our fault... we know where we're at fault. It's our fault that we chose to finance with Vanderbilt and do business with Clayton homes. The reps at Vanderbilt are soo rude with their holier than thou / better than you attitudes that I refuse to speak with any of them via phone.

Attorney Generals Office in Tenessee, Texas, North Carolina, FTC and With The U.S. Army office of Dicilplinary Action and Military Contract all have copies of all of the transanctions I have had with Vanderbilt.

I have had the most success with the The State of Tennesse who has gotten Vanderbilt to report to the creditors that we do not owe them any money. However, that was after they sold us an overpriced lemon, robbed our house of all of our personal possesions (including the food in the cubboards and the childrens toys!)refused to allow the home to be sold, stalked and harrassed us out of our house......

In all of my complaints My cover letter reffers to this websight. Through it's editor a investigator has all the contact information for many complaintants. If you have not yet been contacted, then I have not yet been successful.

*Vanderbilt is owned by Berkshire Hathaway out of Omaha, Nebraska. Who once owned Oakwood Mobile Homes. Who now owns Clayton Mobile Homes, and ownes a substantial amount of Wells Fargo, another subject of this websight who's tactics sound very familiar. The State Attorney General of Nebraska should be added to the list.

Keep copies of everything, keep a journal and make notes of all your conversations with this company. Should you record your telephone conversations. Make sure you inform them that your conversation is being recorded. (they will probably hang up) You have make your payments on time, I was never late and they still stole our home and harrassed us for years. What Vanderbilt can do with a late payment can only be monsterous.

I have hunted for an attorney to represent us in a civil case, I need $30,000 just for a retainer fee. All Vanderbilt has to do is bury my lawyer in paperwork until I run out of money or the statute in my case runs out.

I hope you will be more successful in dealing with Vanderbilt than I have been.

I received an answer from the Fedreral Trade Commission, in order for them to proceed with an investigation they need more than one complaint, if there is any way to make all of the consumers here aware of this maybe they can file their complaints also. I got a little extra time before foreclosure, because I sent a letter to their lawyer denying I am behind. So hopefully within the next month some of you can also write the ftc and help us all.

I am going thru the same nightmare, I am wondering if enough of us banded together, filing complaints at the Federal Trade Commission and BBB of Tennessee and our individual states, that maybe they would be investigated and punished for their fraudulent acts. I plan to take my situation to our local news and possibly finding more consumers who have been cheated.

I refuse to give up w/o a fight!

I will be placing my own complaint also but just wanted to let you know that I have dealt with the same thing. Vanderbile bought our mortgage in January from Chase and it has been a nightmare every since. They have even went as far as contacting our neighbors. This was horrible. Especially considering the fact we were in contact with them but were only able to leave messages due to our work schedule. That wasn't good enough so they started contacting everyone. I couldn't even tell you all of our neighbors names and they received phone calls about us. Yes we were late but only by 30 days. With Chase we had been on time for 3 years but that doesn't matter now. They are very rude and impossible to work with, I don't even want to talk to them because of the way I am treated. I just sent them $350.00 of a $500.00 payment and received a message the last day that the payment was completely unacceptable and I needed to call them with the date we were moving out of the home. I have never in my life been treated like this. There has to be something I can do to protect myself and my family from them. I will be checking for continuous responses. Thanks for your comments.

Georganna, thank you so much for your reply and helpful suggestions.

I have my pad & paper handy as well as my tape recorder. I'll also look into VA's disability and eviction laws.. My spouse is disabled. Chapter 13 will be a last resort.

You should know that Vanderbilt does not sell you a home with the intention of compleating the transaction. They intentionally mislead, misrepresent, delay and harrass you with the intent of making you late on your payments and eventually forclosing on your property to resell it again for the same amount of money and finance terms. This is a huge profit for this company, and it is preditory lending.
I saw on this sight, a case with Fairbanks Financial that individuals were protecting their house from forclosure by filing Chapter 13 protection. In which case the court would prevent your house from foreclosure (when it gets to that point)

*I suggest you also contact your state attorney generals office, in your state as well as Tennessse (Vanderbilts Home Office)send them copies of all of your transactions, contact your state legislatures and anyone else you can think of.

*Keep a journal next to your phone and record all of your conversations regarding this company. Names, times, etc. This will be useful in writing letters or in court, if your one of the few who get the opportunity to get them in court.

*Check your credit reports, I'm sure you will be interested to see what Vanderbilt says about you, be sure to dispute any information you feel is incorrect.

*Do not let them throw you out of your home. Check with your local County Social Services Agency, In my state, it is illeagal to evict an individual with disabilities.

*Do your best to get caught up on your payments and keep them on time. Do not give them the ammunition that could effect the integrity of your claim. But, do not over pay them or agree to send them money you do not legally owe, that will only encourage Vanderbilt to continue to extort money from you.

First and foremost, you're play wasn't helpful. Second, why reply with Nunya as your name. Everyone knows that Nunya means "None of Your business" I'm not in highschool dear.

On to your comment:
No it's not illegal
.... It's not illegal, however it's only allowed ONCE... take NOTE of section 3.
Per FDCPA:
804. Acquisition of location information [15 USC 1692b]

Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall --

(1) identify himself, state that he is confirming or correcting location information concerning the consumer, and, only if expressly requested, identify his employer;

(2) not state that such consumer owes any debt;

(3) not communicate with any such person more than once unless requested to do so by such person or unless the debt collector reasonably believes that the earlier response of such person is erroneous or incomplete and that such person now has correct or complete location information.

NUNYA, IF you're not familiar with the FDCPA I suggest you go there, gather your information and come back here with something that tells a bit more of the truth.

Anyone else out there have a step by step plan IN CASE this happens again? SINCE I now know that Vanderbilt can only contact a 3rd party ONCE.

If a creditor cannot get a response from you, they can try to locate you and leave a message with anyone for you to call them. They did nothing wrong.
