We were quoted a price for new installation of a sprinkler system, rock hounding, top soil and hydroseeding for a newly built house of $ 5,700. A price that could hardly be beat, providing we allowed our house to be used as a "model" for the company. We agreed.

All Seasons offered some suggestions and improvements on our ideas, including a retaining wall to run the length of the front of the house. When questioning the price, we were told "don't worry about it, we got you covered." Installation of additional plant materials were "at our labor costs." The company received a multitude of interested potential customers from people viewing our house, including the developer of the complex.

All Seasons did not receive any of the jobs that were referred to them for pricing and ideas, for various reasons, mostly because "they are abrasive," "cocky," and "bad mouthing competitors."

Because of the lack of referral income, the company has since decided to attempt to sue us for over $ 13,000 - despite the signed contract reading $ 5,700 - to cover labor and supply costs that were supposedly "taken care of." On top of that, the charges came 4-5 months after the job was completed. The company has also attempted to place a lien on the house.

The unscrupulous and down right illegal business practices of All Seasons Contracting run a wide range of legal avenues - from the Home Solicitation Act to billing fraud to questionable personnel hired to perform the manual labor, i.e. ex-convicts and illegal aliens.

I have nothing to hide...Ms. Berlin does.

AUTHOR: Mark - (U.S.A.)

POSTED: Tuesday, December 27, 2005

My name is Mark Fourtounis, and I own All Seasons Contracting and Landscaping. I have been in business since 1988, incorporated in 1997, and have built my business from the ground up.

We at All Seasons firmly believe in the saying the customer is always right. Sometimes, unfortunately, that saying is inaccurate, as is the case of Cathy Berlin of Brunswick, OH.

We received a call from Ms. Berlin, who was given our name and number by one of our customers, and she asked if we could give her an estimate. We came out and gave her and her husband a quote, which she signed (which we have a copy of). The quote was for a lawn installation and irrigation ONLY, for a total of $6,131. Cathy then called a few days later and asked if she could add more to her project; however, she would not be able to pay in full until she sold her other house (see Cuyahoga Country Recorder Office to verify, if needed), and asked if she could make payments until the house was sold and they could pay in full. I said yes.

Ms. Berlin then installed flower beds and plant material. We took her to the nursery to get the products at cost (another favor to herwe have a copy of this invoice, which is $1,340.95). Ms. Berlin then showed us a satellite photo of her house and how it would look with a retaining wall with a topsoil filling, which she also asked us to install. This would add $4,757.30.

Meanwhile, Ms. Berlin new the original cost of the estimate ($6,131), because she signed it. Ms. Berlin picked the plant material ($1,340.95) out herself, so she knew the cost the entire time. Thirdly, she knew about the retaining wall because we worked from HER photo, and SHE picked out the wall system from Shemin (the supplier of the product). Ms. Berlin was involved in this landscaping project EVERY STEP OF THE WAY, and knew the price each time she added something.

Mr. and Ms. Berlin tried to take us for a ride. They purchased other items for their house, adding more and more debt until they were able to file bankruptcy and pay NO ONE. They charged up their credit cards and paid no one; we were not the only company ripped off by these two. I was personally at the bankruptcy hearing, which is a matter of public recordanyone may check this.

How do a nurse making $80,000+ (in her own words) and a manager of a large auto parts company making $50,000+ file bankruptcy? Her claims of our questionable personnel are ridiculous. What she assumed were illegal aliens were legal workers with Visas via the H-2B work program.

This matter was settled IN COURT, with judgment going to All Seasons. If anyone has any questions or disputes, please feel free to contact All Seasons Contracting at (216) 447-9799 or visit us at 1256 Industrial Parkway in Brunswick, OH. I have worked too hard in my life to let people make false accusations against my business when it is actually they who are the rip-offs. We have nothing to hide.

There was judgment given down from the courts to All Seasons. Do the courts give judgment to a rip-off? If anyone has any questions or doubts, please come and talk to me in my office and look at the court files. I have absolutely nothing to hide.
