After reading all of the complaints about this company I decided to add my "two cents" I too am growing quite frustrated with this company.. I called them a few weeks ago to ask about loan modification, after all, their website indicates they are included in the new govt program to help home owners, and although we are not behind in our payments yet, I am trying to be proactive.. My husband is self employed and because of the economy has lost more than 50 percent of his income.. I am currently working two jobs to help pay the mortgage but it is getting very difficult to keep up.. I explained to the customer service rep on the phone our situation and explained that we probably were not going to be able to make january's payment on time if at all... She promptly directed me to the refinance dept where the gentleman told me we could not refinance because we would have to pay 12,000 dollars in prepayment penalties and we have no equity in our home, and we would not quality for loan modification because we are not behind in our payments as of yet.. Now, we have been in this home for two years, we have an ajustable rate loan, pay almost 3500.00 per month, including an escrow account which they inexplicable raised last year.. Our home has dropped in value over 100,000 dollars and will continue to go down, and yet these greedy banks refuse to work with homeowners to help them stay in there homes! There are millions of houses sitting empty in which they are getting nothing, the govt has been bailing out these banks (with our tax dollars I might add) and we are left feeling helpless! I wanted to let everyone know what I have been discovering in my research.. I have hired a company to do a forensic audit of my home loan.. If in doing so they find that this company did anything illegal, they will have to modify our loan by law because our contract will no longer be binding.. The laws are changing, and it helps to consult with someone who knows about these laws... These banks can no longer just foreclose on people without first showing proof that they have tried to work with you... I hope that helps someone out there.. (and by the way, be careful when trying to find someone to help you with the loan modification process, because sadly there are alot of predators out there looking to take advantage) so do your homework and find someone trustworthy!

Since when? As of today (12/26), there is no such requirement. It is certainly in the lender's interest to try and work something out with potential forclosures, but there are a number of reasons why it doesn't happen. The most common is that the loan servicing company (probably Aurora Loan Services, in this case) does not own the loan. If they are just the servicing company, they are not authorized to change the terms of the loan. Contacting the true owner of the note and coordinating the process of modification is a lengthy and usually futile process.

Bottom line is that you signed up for a high risk, sub prime ARM with a prepayment penalty, instead of a more reasonable fixed rate mortgage. You agreed to the terms when you bought the house. You should expect to eventually lose the house if you can't live up to those terms. Loan refinances on subprime ARMs are virtually impossible due to the reduced equity and tighter lending restrictions.

I wish you the best of luck, but caution you not to get your hopes up. The government program that was supposed help people avoid forclosure has been a major failure (as most government programs are). Of the few people that were "helped", most slid right back into forclosure within a few months.
