Our horror story began when Associates turned our mortgage over to Citifinancial on May, 2001. The first 5 payments were correctly placed into our account. After that the payments we sent to them did not equal what they say they received. We struggled to keep this company happy. They would not accept additional principal payments from me.

I sent payments even though I didn't ever receive a statement from them. I wrote up my own form letter of information to apply payment to my account and constantly requested a statement yet they continued to ignore my request. The payments
we sent showed 3 weeks later on their statement they sent
to our attorney.

I was $900 behind on the mortgage when I filed Chapter 13 reorganization bankruptsy and I included only that $900 in the filing. This was in August, 2002. This threw them for a loop. They sent out to all my creditors that we had abandoned our home and we were 15 months behind in payment!!!

We received a letter from CitiFinancial's attorney telling us they were foreclosing.

We went to court. Their lawyer didn't show so we rescheduled.

We went to court again. Again their lawyer didn't show.
Next court date their attorney showed and said she'd agree to us being 6 months behind. We were stunned but agreed with them we'd send $250 a week from June through November to settle the arrearage plus make current payments. The lawyer gave me her
business card.

I sent first 2 payments on June 19, 2004 and June 28, 2004.

We received them back with a writing of "reject" on them.
I contacted their attorney and she said hold onto them. Citi was still hunting our money that was lost. I then decided to put away $1,200 to pay them. She said she'll look into it and get back with me. Four months later we are to go back to court and I receive word from my attorney that they say I'm $5,000 behind. I told him no way!!!!!!

I sat down and figured up the borrowed amount of $48,304.24 at 10.94% interest. Payments monthly at $457.82 at 30 years. The worksheet shows I have to this date paid $17,322.03 in accumulated interest and $848.65 in accumulated principal.

Since January 2002 our mortgage payments do not equal their record of our account.

Someone is pocketing my money. Payments are being put in someone elses account and I'm being ripped off and punished for
this.

Now my family's health is failing over this worry of losing our home! My immune system is failing due to the stress and worry. I'm fighting depression and anxiety. I'm emotionally distraught and now cannot work. I fight high blood pressure. My husband cannot sleep with the fear of losing the home. We've been here 26 years!!!!!! We were planning to divorce last summer but because of the money we couldn't. This stress has come between us now. My husband works so much overtime he isn't getting adequate rest. He's a truck driver and with this worry causes him to be unstable on the road and endangering all lives in the vehicles. He doesn't sleep. He doesn't eat. He can't work enough he thinks.

So now today the attorney calls. He wants me to come up with receipts for 2004. My hands shake from a muscle seizure disorder (myoclonus) that I have come down with so badly that

I can no way sit and do this paperwork. I will have to call the bank and request 2004 receipt copies (already did 2001,2002,2003 costing me $50) for him. I sit crying on the phone explaining to him how nuts this all is!
He said if I send them the $1,200 that they can postpone the court hearing for tomorrow and it will give us another month to work on this. Now we are into the holiday season AGAIN (did this in 2003 also with them). I told the lawyer I want to know what the $1,200 is going to be applied too. Where I'm to send it? Will they accept it?

I'm being totally used and abused by CitiFinancial. I want my normal life back!! I want my mortgage sent to another company that is a good company that won't steal from me!!

I was so blown away to see how many people went through the same thing that my family is going through with CitiFinancial.

Citifinancial "Predator Lender or Loan Company"

If Citifinancial has done all these things to everybody. Why has the Federal Goverment or the Federal Banking Commission not put a stop to it. Where are all the lawyers when it comes to the class actions suits, are they afraid of Citifinancial.

As I've explained in the long story, court has come and gone.

They have now found my payments but they are put on my statement strangely in partial payments. They hold the payments past 30 days then report you to credit bureau as a paid debt pay.

The attorney representing Citi in Indianapolis, IN get more and more heartless. She flat out said pay $6,500 by 6 month or we take the house. I'm trying to just refinance with some mortgage company that will feel sorry for our situation and get out of citi.

I've talked to 2 mortage companies and they said they knew about citi and will try to get us out..... but we've heard nothing. So I have applied to 8 mort. companies and another one tonight.

Every story here that I've read since I first filed here is saying the same thing. They want 5,000 or 6,000 or they will foreclose.

Is there not an attorney out there that wants to earn a name for himself and fight this company?

I'm just praying nightly to my God that something good will happen here. After owning for 26 years .... Associates is purchased by CitiFinancial and BANG we are all dead and homeless!!!!!!!!!!!!!!!!!!!!!!

*sigh*

civil suit for the $7,099.10

Small claims court is up to $3,000.
I have to go civil suit for the $7,099.10 amount.
I contacted my attorney on this.
I'll keep you updated on what happens.

Since my first report... I'm going to file small claims for misappropriation of funds against Citifinancial for the $7,099.10

Since my first report I have reported CitiFinancial of Irving TX to the Better Business Bureau of Texas, I have written the Texas Attorney General, I've written the CEO and Vice President of Citifinancial. I'm hunting addresses for the president of citi, Kevin Kessinger; Robert Rubin, chairman of the exec. comm; and Doug Peterson, Citigroup Chief Auditor.

I went through my 2001,2002,2003 payments and have pulled out 18 payments that were not applied to my account. $7,099.10

My attorney seems to be laid back and is trying to settle this but CitiFinancial seems to be playing games. They now want me to write a check for $1,200 to their attorney to give us 30 more days before court. What they don't know is I'm taking the $1,200 to the trustee of the court and tell him that all money paid to them has to go through the court system. I'm going to also show him the payments they refused to accept from me.

I'm going to file small claims for misappropriation of funds against Citifinancial for the $7,099.10. I have the 18 payments with other account numbers on them that came from my checking account. I'm not quitting till I win this!!!!!!!!!!!!!

Some tips that may help

Hello, I am sorry to hear about the troubles you have had with Citifinancial. My mortgage was just acquired by them. I have recently gotten out of a similar situation as yours (not as brutal, though) with Household Finance Company (HFC) and have posted for two years about my ongoing struggles with them.

After reading your story, I am curious about cancelled checks and postdates. Your bank should have records of your cancelled checks and the date they were cashed on. If you could retain all of those, then you could show that they have all of the money you say they do.

It may cost a fee, but well worth it. Also, from now on, I would send EVERYTHING to them registered mail, or if possible, pay online. This may cost you a few more dollars, but it will bring peace. I had to use this tactic with HFC. Every time I paid, I did it on their website, paying $7 for processing each time. Some months I paid them something every week just to keep up with the ridiculously high payments.

I am also curious as to what your attorney has to say about them not letting you pay extra on your principal. Soon they will have to let you because all of the interest will be paid off! Is this a stipulation in your contract? Or maybe a prepayment penalty? I would definitely look into that aspect, if you haven't already.
I have dealt with Citifinancial before for a personal loan several years ago and they are not very nice. Did you know that Citifinancial acquired The Associates and that is why your loan went there? In 2001 and 2002 (and possibly others) Citifinancial was a party to one or more lawsuits for their lending practices, and from what I understand there are some out there now. You may want to have your attorney look into that as well.

I completely empathize with what you are going through with the stress. Those who have not had to go through it do not realize the toll a bad mortgage company can take on a marriage or finances; when most monies go to paying for the mortgage rather than other bills, just to keep your home. It is hard when these companies can't seem to understand that life happens and with that comes times of financial strife. Hang in there!

I am hoping that my past experience with lenders like Citifinancial will help me to steer clear of situations like yours, but after reading through everyone's stories here at Rip Off Report, I will be sure to save every receipt and document relentlessly.

Just know that it can get better, and thanks for sharing your story!
