We were in a Chp 13 bankruptcy protection (stay) in 2010 (due to non payments of clients). Citi was notified of the BK by the courts directly.  All entities knew of the BK stay; the foreclosure attorney, Citi, and Fannie Mae - all knew of the stay. The Chp 13 moved to a 7 (of which we finally got paid and we asked to the court cancel the BK - we'll pay our debts).
While in the stay, Fannie Mae and Citi foreclosed the house (without notice) and trashed out the house of all my furniture, belongings, closets, etc. while we were gone on vacation to see our family. We returned December 27th (four days later) to find our house was "broken in to" - seriously broke down the security doors, threw out EVERYTHING inside and out.  We drove up to our house it had for sale signs in the window and front yard. I called the REO agent listing the house and they said it was their listing to sell it and they had a buyer already. I asked where  was my stuff (assuming it would be in storage) - he said a landfill somewhere.
Citi admitted they were wrong - I have the recorded conversation with their legal dept. They missread a letter that said "the consumer was in a bankruptcy stay and the foreclosure was invalid."  Some DipBrain can't ready and took the letter to mean valid. What legal department person would see the word Bankruptcy Stay and still move to foreclose??? They just need to go back to flipping burgers if that's all they can handle as a job (flipping burgers is not a bad job - you just don't have to use too much thought).  We got the house back within a few weeks - much to the surprise of the REO agent.
The legal department (on the recording) said to send them an assessment of the damages and costs to replace and repair.  I hired an attorney to write them a letter - then a few letters and Citi has ignored everyone of them. They owe me about $10,000 for the trashout.
Now, Citi has added about $6,000 to my note in foreclosure fees - for the illegal foreclosure.  and since then, Citi Mortgage has placed a forced escrow on our fixed rate note - taking the payments from $1065 to $1500 a month without  explanation - I have written them numerous letters showing them I pay for tax and insurance directly, asking them for an explanation of the amounts. I have yet to get a straight answer. I keep paying my monthly mortgage and it is now considered behind again since they do not credit my account correctly. They say I'm in default when I am not.
I get numerous automated calls from them daily - when I answer they barely speak English and it's never the same answer. When I mention whey they never respond to my turn my attorneys assessment or letters they put me in a limbo and I cannot stay on the line for that. Talking on the phone gets nowhere - writing gets nowhere.
How has this business gotten away with so much BS they have been doing on the consumer???  We really need a strong Attorney to stick it to these companies screwing over the consumers.
We still have the house - but every day when I get drive home from work and turn down my street I have serious anxiety attacks and wonder if there is going to be a for sale sign in the window and all our stuff gone.  I'm sure I'll just have a heart attack and die before I get to the driveway so that I won't have to see the sign.  Only then, I guess, I won't worry anymore.
