In their sales circular that came out in the Sunday newspaper on December 8, 2002, they were offering an Accessory Pack for the PlayStation 2 for $19.99, regularly $49.99, if you bought the PS2 console for $199.99.

Since every other store was selling the consoles for $200, this was the best incentive being offered. I went to the store on the afternoon of the 9th to purchase these as a Christmas gift. However, they had already sold out of the accessory packs, even though there were probably 30 consoles stacked up, and weren't expecting any more.

I called other stores in the area, but they were all sold out too. I called their 800 number and the person told me I should go back to the store and ask the manager for a rain check.

On December 10th I went back to the store and asked the manager for a rain check. I wouldn't quite say he was rude, but he was definitely not friendly or helpful! He told me that -
1) The person I talked with on the phone didn't know what they were talking about
2) They were not ordering any more accessory packs
3) They printed in the ad that they have the right to limit quantities
4) They DO NOT issue rain checks for ANYTHING!
I left the manager, and everyone else within earshot, with a number of expletives as I stormed out of the store.

NO WHERE on this ad did it say that quantities were limited! NO WHERE on this ad did it say "no rain checks"!

Buried in the middle of their fine print it does say "We reserve the right to limit quantites". However, that means if I want to buy 100 of something, they can say that I can only buy 10.

I'm never going to buy anything from CompUSA again!

I am filing a Deceptive Trade complaint with the Texas Attorney General and possibly the US AG also.

Umm, it is not bait & switch there, dude. Bait & Switch is when they lure you into the store, offer you a higher priced substitute, and do not override it to match the advertised price. Give me a break. CompUSA, Omx, Circuit City, THOSE ARE N A T I O N A L ads!!! Stores have the ability (if you ask politely and are patient, not screaming, rude red faced idiots) to search the stock of the entire country if they want to. I've located computers and parts and gobs of stuff way out of my territory for customers who are willing to wait for a back-ordered ad item. Why get in your car and drive around? That's so ridiculous. The companies release these national sunday ads to reflect what, as a whole, the nation can sell. A lot of times it will say "hurry while supplies last." Well, if they are out and won't issue a rain check (which officemax will usually) then you should be given the option to ORDER IT. And you don't pay for shipping or handling or anything and if you are willing to wait a week or more for delivery you will get it shipped to your door no extra money involved. That's the best anyone can do. Again, being firm but polite and patient will get you farther than anything. Ask to speak with a supervisor or mgr, and you will be fine. Because the stores are losing money @ their bottom line, they may not offer you a sub without you asking them. Same with a raincheck. I don't immediately offer a rain check to someone, because down the line when i get that product in stock, i'm going to take a monetary hit on it to give it to you. But if you ask for a substitue within reason, or a rain check, and it's approved by corporate, we will usually always bend over backwards to help you out. But if you are rude, and a jerk, i will switch into a different mode and shut down and not want to help you at all. So, use your heads.

Had a similar experience with Officemax

They had a scanner advertised last Christmas season in a Sunday ad. The price was great for the product. I went to Officemax that day and they did not have the scanner in stock, nor did they know when they would get any. They did have a "better" more expensive version they tried to sell me though. I contacted every Officemax within 30 miles and guess what, none of them had it. So I visited a different Officemax in the area knowing what was going to happen and asked the sales clerk for the specified scanner. Didn't have it. I asked to speak to the store manager and told him that no Officemax had the scanner. He didn't seem to care until I told him that this sounded like a "bait and switch." He then quickly offered me the next better model at the same price as the ad. I bought two.
