Repeatedly Denied Benefits w/out taking all facts into consideration ....

Last year (08/13/2002) I was forced to have my husband incarcerated for felony child abuse upon our biological child. At this time it became clear, in order to protect my children (against DCF) I had to make a tough decision; stay and keep my job and risk losing my children or leave the state to be with my family which would help with raising the children. Reluctantly, I gave my notice to my employer (a job I really enjoyed) and moved up north.

When I applied for unemployment compensation, I was told my reason didn't fit into their description of "just cause". I appealed to no avail and have since been just treading water and not being able to pay bills and was without work between September and December 2001. These people could care less about myself and children whether we ate or not. Not to mention, everytime I'd call there was a different story by a different agent.

A large number of the representatives I would speak with would be rude and unprofessional. When I filed my appeal in 2001, I received coorespondence that I would be having my telephonic hearing scheduled for the Monday following Thanksgiving. I called the AWI the day after Thanksgiving when I got the notice only to find the offices closed and left voice mail for DAISY and asked for a return call to reschedule as my first day at my new job was on Monday and wouldn't be available. NO RETURN PHONE CALL - EVER!

Monday came and at 11:00 am my mother answered the phone and explained to the gentleman that I had called to reschedule and explained why I couldn't appear. He was extremely rude to her and said "well, she'll be hearing from us". I did - in writing denying my benefits again.

I rescheduled as per their instructions only to be denied benefits again - my claim didn't "fit into their box". At this point I said to myself, "I'm just beating a dead horse".

This year I was working for ACS/CCB (for six months now) and left due to hostile environment, company requiring me to lie (which is against my morals), when it was 17 degrees outside they had the AC on and blowing right down on my. My requests to be moved into another seat or turn of the AC went completely ignored. Eventually I wound up with a severe upper resperatory infection resulting in loss of my voice for three weeks in which ACS/CCB required me to continue working on the phones w/out but maybe one or two days off, excessive mandantory overtime, frequent bonus structure changes (once a month) and the list goes on.

I left to find a better job only to lose that job a month later then went to the local Unemployment Compensation office only to be told I had to file in Florida. Why? Because, they may have denied my benefits but my claim was still open after a full year!!!

Upon contacting Florida, I was again denied my benefits and the representative "Diana" was extremely rude, wouldn't allow me to give her all of the facts (as they did in 2001). How can anyone make an informed descision without all of the facts?

THEIR EXCUSE this time "Benefits are not payable because: The reason for quitting was not attributable to the employer" and "The employer is not chargeable since the employment was not in the base period".

If you have any advise, I need to file my appeal in two weeks and am looking for some ammunition against these people, they're going out of their way to avoid payment of my benefits.

The company pays for unemployment through their taxes! That's why it's so hard to get it unless you have been strictly laid off! I wouldn't be surprised if these companies PAY OFF the hearing officers to deny claims!

I copied this from The Employer Handbook to Unemployment published by the State of Florida:

Unemployment Insurance provides temporary income payments to make up part of the wages lost by workers who lose their jobs through no fault of their own, and are able and available for work. It is not a "relief" or "welfare" payment and is not available just for the asking.

It is job insurance paid for by a tax on business.

The objective is to provide a cushion to absorb some of the shock of unemployment to jobless workers and their families and the business community. This temporary income, plus other resources, helps workers sustain their families when they are without jobs. It also keeps money flowing into Florida businesses as the unemployed workers spend these payments to provide for their needs until they can obtain jobs or the duration of benefits ends.

Thus, it helps maintain purchasing power which many consider the key to business prosperity. In this way it promotes economic stability and helps to stave off the downward cycle that leads to depression. Businesses credit this program with playing an important part in lessening the depth and length of economic recessions.

Who Pays?

The Federal Unemployment Tax Act provides for cooperation between state and federal governments in the establishment and administration of the Unemployment
Compensation Program. Under this dual system, the employer pays payroll taxes levied by both the state and federal governments.

Greetings,

I read your report and all the comments attached. I really feel for you and your initial situation. I think part of the problem here is most people don't understand what Unemployment really is.

It is an EMPLOYER only paid tax that is for basically there in case an employer runs out of work. You then get an amount to hold you over until you can find more work. Claims are also paid if an employer is unfair to an employee, or you fire an employee because you just don't want them around anymore.

Unemployment is not for fleeing from your husband even though you needed to do that.

Employers who have claims filed against there account also pay all the money collected by an ex-employee back dollar for dollar over (I think) a 3 year period.

Since your employer at the start of this mess was not at fault for you leaving his employ, you were denied benifits.

Is it fair to your employer to have to pay you unemployment when you married this person and had a child with him, that you then had to protect?

You were NOT denied a tax paid benifit. You were denied a State Tax Insurance benifit that was completely paid by your employer because he did nothing wrong.

This year the total unemployment benifit an ex-employee can collect over 26 weeks is up to $7150.00. I know if I run out of work or just fire a man because I'm in a bad mood, I will be paying that much back to unemployment for each person I release.

As harsh as your situation may have seemed at the time. The fact is that your employer would have had to completely foot that bill in the long run and that wasn't fair to him or her...

Your second employer was in the wrong but because you did not have enough chargeable quarters in you were denied benifits. You must have been out of work for a period of time between the two jobs. That is why your file was opened in Florida because that is where your credits where. If that employer did not have to pay your claim, you did not have enough quarters built up with your new employer to collect. This is in place to stop career filers from constantly collecting benifits. Believe it or not they are out there.

All this is mapped out in the Florida Statute that anyone can look up on line. Just like workman's compansation benifits. One is there for lack of work and the other is there in case you are hurt at work. Both are completely paid by the employer. They are a state mandated tax on employers to pay benifits to employees.

All claims are paid back to unemployment and W.C. by the employer including an administration fee. Though I call it a punishment fee for having a claim at all!

Just my 2 cents so you understand how the system works. No one likes it all the time but it's there for the employee's protection under the correct circumstances. Your circumstances did not fit in the box. The person at unemployment should have explained the "why" of that to you. For whatever reason they did not.

Unemployment is a right but only under certain circumstances where the employer is at fault for the fact that you are no longer working.

I hope things are better for you now.

I am so sorry that you two were denied unemployment benefits. An attorney I used to work for hired another secretary. After she had been there for 3 weeks, she lied to him and he caught her in the lie and fired her. She applied for unemployment and got full benefits. We appealed and she still won. We kept explaining that she lied and that's why she was fired. The Florida unemployment office stated that since we did not put her on a 90 day probationary period, she was entitled to full benefits. Isn't that disgusting?

I feel you on this. I lost my job because I was in the hospital for 3 weeks in ICU. They fired me and when I filed they said it was my fault. They requested documentation that I could go back to work and I did provide that to them. They said it wasn't good enough and fired me. Unemployment sided with them and during the appeal I lost. How was that my fault. I didnt understand. How can someone help what documentation the doctor provided. They dont care and something must be done because what they are doing is not right. Most people who are trying to get unemployment dont have time to keep appealing. We need the money. And for the jerk that stated that he's glad people like her dont get the money...you need to get over yourself. The government is not paying unemployment. Everyone who pays taxes does. WE PAYED TAXES SO WE DESERVE TO GET BENEFITS WHEN NEEDED. REMEMBER THAT.!!!!!!

I have been reading your rebuttals all night, and have concluded that you are a complete f-ing idiot.



First, you try to insult M who was just trying to help someone that was mistreated. Then, to make matters worse, you say horrible things to a mother that needs assistance due circumstances beyond her control. What kind of person are you? Did you read her story in full? Sending her abusive husband to prison and moving in an attempt to protect her children, is reason enough for me to ask for government financial assistance; at least temporarily.



As far as DirecTV NFL goes, I applaud M for finding a way to cheat a bunch of NFL crooks; especially in this lousy sports market. I am not a local sports fan (Chiefs and Blues) so I am fortunately not affected by the blackout restrictions. However, if I was, I would do exactly what M suggested. Why anyone in their right mind would pay $80 to see a game in run down and extremely dangerous Veterans Stadium; the only NFL stadium that has a need for a judge and courtroom on site, is beyond my comprehension.



Furthermore, doing what M suggested is in no way stealing. All Eagles games, except for the 2 home games they play VS AFC opponents and UP TO 4 prime time games, are broadcast on FOX. Whether the guy watches the games on satellite, or on local fuzzy TV via rabbit ear antennas, he will be viewing the same network. Why does it matter if he sees FOX on satellite or FOX on antenna? From my experience, everything is the same, EVEN commercials. The same would apply for the 2 AFC games; except the network would be CBS. Obviuosly, the national prime time games would not even be an issue. Your whole argument sucks; but then again, that's what we expect out of ball pouches like you.



Additionally, as a DirecTV customer, I can totally understand why one would not be loyal to them. The only thing making their service marketable in this area is the fact that they have NFL Sunday ticket. They should be thanking their lucky stars that they are still exclusive NFL Sunday Ticket providers. Otherwise, they would be back to providing services only to those in states like Iowa with barely any cable alternatives available.



Back to you d**k breath; tell me again why your unemployment situation was any different than the other lady's. The way I see it is that you got $hit canned because you are an under qualified and uneducated a$$ hole. On the other hand, she quit in an effort to protect her children. What sounds nobler to you?? Hmmmmm



You spent much of your night attacking victims of fraud when you could have been finding ways to assist them. If a company or corporation mistreats someone, the victim has every right to get even; whether you like it or not. The original DTV victim was mistreated and SHOULD do what M suggested in order to at least get partial satisfaction.



In any event, I have no doubts as to why you are unemployed. In fact, I am sure that is why you came here tonight and attacked victims. Are you feeling a little worthless because you are an out of work shmuck? Did it make you feel better attacking M and the lady who had an abusive husband? I certainly hope that neither of them pay attention to a A$$ polyp like you.

Your income is YOUR responsibility, not the State's. You should have found other employment "up north" before you quit your job. Just because life get's tough doesn't mean everyone else is supposed to take care of you. I've worked at a few places I didn't like.



You know what I did? I found another job and THEN quit. Yes, I have drawn unemployment when the situation warranted it. I was laided off through no fault of my own (in other words I didn't quit) I felt uneasy and ashamed to take it but I had a family to support.



I felt bad about getting it not entitled to it as you seem to feel. I'm glad that my tax dollars don't go to people like you that think it's OK to just quit when the going gets tough and let somebody else support you. Maybe your family, friends, or your church but not the government.
