Lean Life PM - Novapoint - JAB Ventures RIPOFF credit card fraud - unauthorized charges after cancellation, no product. Draper Utah

This company is a complete ripoff. I ordered the free sample on Sept. 19, pd. the $6.95 shipping and handling. Never received the product sample. Called and left a message to cancel my order Sept. 26, also e-mailed "cancel my acct" on the same day. No reply.

Oct. 3 ~ there it was. $99.90 charge to my Visa, unauthorized. I called the company, again had to leave a message. I e-mailed every day for a week demanding my money back. After I filed a complaint with the FTC and e-mailed them a copy, I got a reply from some guy named "mitch" telling me they couldn't find my information.

They sure could find my Visa number!! Oct. 7th ~ there it is again~ $6.95 charge on my Visa for the $113.80 "free" sample (to date they have charged $6.95 twice, and $99.90 once).

I filed a dispute with my credit card company and they will investigate. I will fight this scumbag company with everything I have until they return my money. If we get enough people on this website who have been stolen from, I think we should all file class action suit.

Any lawyers in Utah interested in representing a class action contingent fee agreement????

My credit card company has charged back the two (2) shipping charges @ $6.95 each. That's a whole $13.90!!! Woo h*o!!!! How shall I split that up when buying Christmas gifts for my two kids???? I have not received a credit for the big one ~ $99.90.



So far, I have filed complaints with several consumer divisions including the BBB, State of Utah Dept. of Commerce, Consumer Complaint Division, and most recently, the Attorney General's office in Utah.



Lean Life made these unauthorized charges starting on Sept. 19, 2005, to my credit card, which I might add, was a brand NEW card.

The Sept. 19 charge of $6.95 was charged back by my credit card company. The October 7 charge of $6.95 was also charged back by my credit card company. As of 10:39, EST, no further credit has been posted to my credit card account. The Credit Card company has not charged back the $99.90, and, despite what Leanlife has said in writing in response to my complaints, they HAVE NOT REFUNDED THE $99.90 TO ME.



On November 1, 2005 I received a letter from the State of Utah, Dept. of Commerce, stating that according to the company's response, they had considered my complaint "resolved". They enclosed a fax copy of a letter, dated Oct. 27, 2005, unsigned, with the name Mitch Allen at the bottom. In this letter, Mr. Allen states:



"The credit card company has charged back our account $99.90 under her claim, and specifically instructed us not to credit her account, she has been credited back on her card. The credit issued is the amount requested. We requrest that this crazy women (sic) stop harassing us before we file criminal charges against her, along with a slander and defamation of character law suit."



Today, I received a response from the BBB regarding my complaint. In this one, Mitch states the following:

"Client was credited back $99.90 for the cost of the 90 day supply. As well as $6.95 x 2 on 11/02/05."



Mitch? I'm confused....

Which day was it that the alleged credit happened...was it Oct. 27th, the date of your letter to the Dept. of Commerce or was it 11/2/05, as claimed in your response to the BBB??The correct answer is neither date. The entire amount has yet to be refunded.



And why, OH WHY has the large credit, the one that you charged to my card without my authorization or approval on Oct. 3, 2005, not shown up anywhere on any statement from my credit card company? Why does my credit card company not show ANY KIND OF CREDIT, CHARGE-BACK OR REFUND as of today?????



It's because you are lying. You have been lying, and stealing from all these people on this website who have filed ripoff reports.



I have responded to both of these organizations and provided them with written proof from my credit card company that no such credit for $99.90 has been issued back to me. I wonder if the State of Utah Department of Commerce, Division of Consumer Protection will be filing charges. I believe making a false statement to a government official (and in writing too!!) probably comes with some kind of punishment, perhabs losing one's license to operate a business in the state. (like this guy even has one!!).



Perhaps it will be the Office of the Attorney General who will file the charges. At this point, it's a race to the finish line.



But I'm still out $99.90 while this company lies over and over and over again.



I did notice a new contact telephone number in this BBB response that Mr. Mitch apparently responded to. This number begins with area code 801. I think I'll check this out online (reverse lookup) and see what I get.



I'm glad some of you are getting refunds ~ it sure does give the rest of us hope. But I'm not counting on anything ~ and I check the activity of each credit card online every day from now on.

I,too, ordered a sample of Lean Life for $6.95 and was then charged the $99.90 on my card and received no product.



I have called the company's phone number over a dozen times and left messages. You see, they never answer the phone and you have to leave a message. I have sent about 1/2 dozen emails with no repsonse.



I have proceeded with getting information to the Better Business Bureau of Utah, but I wonder how much they can help.



These types of company's must be stopped-they are repulsive.



Also, I used my debit card, has anyone else been able to get the charges reversed using a debit card?



I feel like I am ready to contact the media in the area to possibly get a story rolling on these scam artist.

Allow me the opportunity to correct you and hopefully improve your communication skills. This will come in handy when you will be called to testify for the defense in the class action civil trial against you, which I'm sure will be filed against your company in the very near future if it hasn't been filed already.

Jake is really Jason, the owner of the company. I think it's HILARIOUS that he is actually responding to the consumer complaints against his company, JAB Ventures. (By the way, JAB stands for his initials). Jason also sells really crappy sunglasses, called Luminator Sunglasses. I've heard no one like that product either. He's the world's best salemen, problem is, he's his only customer.

Let me start by addressing each of your libelous comments regarding me and my consumerism.



1. You ripped me off. You also ripped off 16 other people all over the United State as shown by the postings on this website. This makes you and your comments not credible. The evidence is clearly showing otherwise.



2. I have never, ever asked for more money from you. I have asked for the money that you stole from me, $6.59 and $99.90, to be refunded to my credit card. If I have to go to court, which I am seriously considering due to your libelous statement posted about me on this website, I am entitled to treble damages if I can prove that your theft was punative, which it was.



3. You may have shipped out the product, but not to me. The only package I have received in the past 90 days was a gift for my 3 yr. old son from overseas.



4. You never offered to re-ship the product. This is a complete lie. You are correct though, I am still not happy. I don't think anyone would be "happy" about being the victim of a crime.



5. "It is clear that Stephanie has way to much time on her hands, and enjoys trying to rip off companys and get free product. " This is a personal attack on my character in writing. This is Libel in the truest form. According to the Associated Press Stylebook, "At its most basic, libel means injury to reputation; libel is distinguished from slander in that libel is written or otherwise printed, whereas slander is spoken". AP Stylebook and Libel manual, pp. 342.

You have defamed my reputation in print allowing anyone, anywhere to read this. I demand that you remove this immediately.



5. I am concerned that you find my complaint regarding your crime humorous. But not surprised ~ there are 16 other victims on this website who's complaints, I'm sure, you found humorous.



6. You need a lesson in punctuation, and you spelled "humorous" wrong.



If this libelous response isn't removed today, October 31, 2005 from this site, I will file a libel suit against Lean Life PM, "Jake", "Mitch", JAB, et als.

Again, tried to contact this company via e-mail demanding my money back. I got this e-mail in response ~ which sounds like they actually received instructions from my credit card company (can you hear the ALARMS going off????)



I contacted my CC company and they stated that they would never, ever discuss an account with a vendor, period. They also stated that they would never, ever advise a vendor NOT to credit back what is rightfully the money of their customer.



Just wanted to share this with all of you. Also, I filed a complaint with the Federal Trade Commission ~ I'd advise the rest of you to do the same. Visit www.ftc.gov and follow the links. They responded to me within 24 hours.
