After Woodforest lost their suit they were being sued for and had to do a big pay out. Please pay close attention to your bank statements. Make sure you keep every daily email notification. What they are doing to moving transactions to later dates and showing an available balance. So you think you have that balance available. So you make a deposit then they take charges that have been moved from an earlier date and put them on the current date to try to get you to ecru overdraft charges. And it is a crock of bull when you try to talk to someone in customer service, because first you get someone who speaks broken English and they tell you the same thing over and over which you already know and when you speak to a supposed supervisor (which is another customer service rep) they tell you the same thing. They cheat you out of money by trying to make you hit over draft. I even had a bank rep at the branch tell me that he does not bank with Woodforest and would not. He said they also take out the bigger transactions first so they get their money and then they leave the smaller transactions like the 5 and 10 buck ones so they hit overdraft and do not lose out on their money. This is straight from a teller mouth. And I know before you start to judge that you are going to say you should balance your book...well I do..another thing they have started doing is when a deposit goes in and they see you have all of the transactions coming out they will hold you deposit for applying it to the account. I have contacted the companies that were doing the direct deposits and they sent me an email showing the deposit was made at the same time each time Woodforest has done this. I think this is crooked. I think it should stop. I think they should not be allowed to hold your paycheck for up to 48 hours and draw interest from it before depositing it into my account. And the way I feel about it is, if you would have never cheated people you never would have been sued!

..but I would give this bank some kudos for even noticing, much less responding to a report.

Granted this was lodged back on the 4th and it is now the 26th.... at least there was a response. Most banks do not respond or acknowledge a complaint from a meager "peasant" customer such as you or myself in anyway shape or form.

Give them a call at the customer "care" department and speak to the Vice President who looks so forward to speaking to you. Then post the results of this conversation here for all to see.

In case anyone did not notice or read the banks response to this report..I have copied and pasted it....

..where are you getting the information that says she was driving in the Mcdonalds coffee case?

As far as the OJ case..I would not think it is a wise decision for anyone to use a MURDER trail as an example of a frivolous lawsuit. Bottom line in that case...the defense was able to convince a jury to return a verdict of not guilty. I don't think the civil case went quite that route.

On a side note..yes,,I believe OJ was 100% guilty. But I was not in the deliberating room so my opinion or beliefs mean nuts.

As far as most of the complaints regarding bank overdraft fee scam rip off fraud unfair unjust etc...you are presumptuous in stating that this was caused by the OP themselves. I say if these complaints have not only made it to court, but have resulted already in a bank losing the case, that perhaps they are not so frivolous.

Once again I ask/request..to post any examples of a frivolous case that even made it into a court room. Or is all you have to present is OJ and McDonalds?

Anyone can toss those high profile cases around from 6 million years ago....how about doing a little research..in which you will can present evidence to conclude the bank lawsuits qualify based on any other US Federal Court past history..as "frivolous".

If so..then we can debate.

She opened the coffee, set the open cup on her dashboard and then romped on the gas pedal to get into the street. So she was at least 50% (if not more) at fault. However, she/her attorney found a judge/jury willing to listen to the emotion instead of the legal. Just as some of the bank lawsuits. All it takes to win a lawsuit is a judge or jury biased to your side. Or do you really believe that OJ didn't kill Ron & Nicole?

But interestingly you want to argue te inclusion of one sentence instead of trying to support the OP against the "big evil bank". Most of the complaints here on ROR about OD fees are fees caused by the OP themselves because they don't keep an accurate register and spend money before it's available in the account.

Oh yeah..lets go back to 1992 and use this an an example of the BILLIONS of dollars the banks have FLEECED from it's loyal customers??

Lawsuit

Facts

On February 27, 1992, Stella Liebeck, a 79-year-old woman from Albuquerque, New Mexico, ordered a 49 cup of coffee from the drive-through window of a local McDonald's restaurant. Liebeck was in the passenger's seat of her Ford Probe, and her grandson Chris parked the car so that Liebeck could add cream and sugar to her coffee. Stella placed the coffee cup between her knees and pulled the far side of the lid toward her to remove it. In the process, she spilled the entire cup of coffee on her lap.[10] Liebeck was wearing cotton sweatpants; they absorbed the coffee and held it against her skin, scalding her thighs, buttocks, and groin.[11] Liebeck was taken to the hospital, where it was determined that she had suffered third-degree burns on six percent of her skin and lesser burns over sixteen percent.[12] She remained in the hospital for eight days while she underwent skin grafting. During this period, Liebeck lost 20 pounds (nearly 20% of her body weight), reducing her down to 83 pounds.[13] Two years of medical treatment followed.

Settlement offers

Liebeck sought to settle with McDonald's for US $20,000 to cover her actual and anticipated expenses. Her past medical expenses were $10,500; her anticipated future medical expenses were approximately $2,500; and her loss of income was approximately $5,000 for a total of approximately $18,000.[14] Instead the company offered only $800. When McDonald's refused to raise its offer, Liebeck retained Texas attorney Reed Morgan. Morgan filed suit in a New Mexico District Court accusing McDonald's of "gross negligence" for selling coffee that was "unreasonably dangerous" and "defectively manufactured". McDonald's refused Morgan's offer to settle for $90,000.[5] Morgan offered to settle for $300,000, and a mediator suggested $225,000 just before trial, but McDonald's refused these final pre-trial attempts to settle.[5]


Not even on the same PLANET as far as a comparison. This is just a mockery used by bank defenders to imply just because they banks can be sued, it must be frivolous.

In REALITY, how many "frivolous" lawsuits can be posted here that made it to court as evidence??? I patiently await, but expect NO answers as usual.

The banks that are being sued for ripping off their customers in most cases are not akin to spilling coffee.

For an example of some of the tactics many banks are currently being sued for regarding unjust overdraft fees and lack of good faith, just take a gander at the Court's order from the recent Wells Fargo Lawsuit that the bank LOST to get some idea. The bank VIOLATED the law...I do not think it is frivolous to sue for that if it cost anyone...

Some information...

I have an account at Wood Forest so I know these things to be true. Apparently you are not keeping a register. If you were and you kept the register balance positive you would not have any fees. When you use your card to make a credit purchase it creates a hold against your account. If the store doesn't request payment within 3 business days the hold will expire, allowing that money back into your available balance. But th transation will be paid when requested. The store is the one who decides when ey requestthe paymen. The bank has nothing to do with this, it doesn't/can't hold transactions and can't force them through when your balance is short. The proper way is to keep your register and use the online banking to confirm what has posted and that it posted for the correct amount. Those items shown as holds or as "pending" have not yet posted and may change order when they are posted.

On direct deposits, Wood Forest actually makes them available the business day before the deposit is scheduled. If your paycheck comes in saying put in account on Friday, the money will be available for your use on Thursday morning (including to pay items posting Thusday night). For any deposit you need to make sure it's available before you spend it. You can't go to the grocery store on Tuesday and write a check against your deposit going in Thursday. You'll get OD fees almost every time. It doesn't matter when the company sends the direct deposit info to Wood Forest, it depends on when the company says to pay the deposit. Just like the payments, they don't/can't hold direct deposits and actually they're the only bank I know that gives it to you a day early.

And I don'tthink they lost a lawsuit. I believe they made a settlementthat included refunding some OD fees but no admission of wrong doing. And yes,people will sue even if the company didn't do anything wrong- McDonald's coffee in the lap is a great example.
