This Remax Heritage Agent Anita Hochstein withheld important contract information prior to the closing of the house on (((REDACTED))) Missouri City Texas 77459.

CONTRACT AND WATER HEATER:

We never received a copy of the HOA information. The owners of the house would not let the appraiser into the house to do the appraisal until 2 days before closing. When the water heater was not raised 18 inches as required by FHA she then used a non licensed, non-insured, probably non-citizen, to drain and raise the water heater and then refused to let us have a licensed, bonded and insured plumber to inspect the work.

TERMITES:
During the inspection of this house active termites were found all over the garage area. The owner was present and witnessed this event. He offered to spray some RAID ha ha to cure the problem. Before closing we agreed to kindly and generously let them stay in the house for 30 days free of charge, however, we wanted to have the termites treated at our expense immediately after closing. They refused this. They didnt want it treated until they moved out.

MOLD: This house could also potentially have mold in the guest bathroom

This all came about during the day before closing as they kept putting our requests off and would not even let us do a walk through, then tried to force us into closing.

ATTN: All prospective buyers and sellers, DO NOT do business with the agent, I assure you, that you will highly regret it. This agent cost her clients a sale. Also, if you contact me, I will gladly provide you our inspection report at no charge so you can see what you will eventually be getting yourself into. I accept anonymous e-mails, to forward the inspection report.

I hope I saved someone alot of future problems.

I understand the frustrations you went through, but I believe you were dealing with an uncooperative seller, which has little to do with a realtors performance.

A realtor is there to facilitate a transaction. Any information, such as HOA information and inspections, are completely the responibility of the buyer.

If the seller refused access for inspections and appraisal, it would seem that the sellers were causing your grief, not the agent.  It may have been a case where the sellers were breaching contract by not allowing access to the home.

NOT TRUE ON ALL COUNTS

I WAS VERY SURPRISED TO FIND THIS MESSAGE HERE. I HAVE BEEN WORKING IN SUGAR LAND AND THE GREATER SOUTHWEST FOR OVER 23 YEARS AND ALWAYS TRIED TO BE FAIR AND HELP ON BOTH SIDES OF THE TRANSACTION. THIS ONE WAS A BIT STRESSFUL BUT, I DID EVERYTHING I COULD TO MAKE PEACE. I REPRESENTED THE SELLER IN THIS TRANSACTION.


BEN HAD A REALTOR REPRESENT HIM IN THIS TRANSACTION BUT,STARTED ON A DAILY BASIS OF CALLING ME AND E-MAILING ME TO PRESSURE MY SELLER TO SIGN OFF ON A DEAL WITH WHICH THEY WERE UNCOMFORTABLE.  BEN HAD TO SWITCH MORTGAGE COMPANIES FOR HIS LOAN IN MID STREAM BECAUSE THE ONE HE CHOSE WOULD NOT CALL HIM BACK AND THE TIME ON THE CONTRACT FOR LOAN APPROVAL WAS EXPIRING. ALL INSPECTIONS WERE ALL DONE  AT THE HOME HE HAD REQUESTED AND HE USED FRIENDS OF HIS FAMILY FOR THESE INSPECTIONS,PEOPLE HE KNEW.


BEN HAD JUST SOLD A HOME IN THE SAME NEIGHBORHOOD AND WAS VERY FAMILIAR WITH HIS SURROUNDINGS AND THE HOA. THE SELLERS DID DELAY GIVING BEN AN EXTENSION BECAUSE THE SELLERS WIFE WAS BEING SCREENED AT MD ANDERSON FOR CANCER AND SUFFERED FROM EXTREME BREATHING DISORDERS.  THEY DID NOT KNOW IF THE DATES WOULD WORK OUT DUE TO A POSSIBLE SURGERY SCHEDULE SO, THEY WAITED UNTIL THE TESTS CAME BACK. BEN WAS ADVISED OF THE CIRCUMSTANCES AND GIVEN THE CHOICE OF WAITING TO FIND OUT OR HE COULD HAVE CANCELLED AT THAT TIME.


HE CHOSE TO WAIT AND THE APPRAISAL WAS DELAYED SO, HE WOULD NOT LOOSE ANY MORE MONEY UNTIL WE KNEW WHAT THE SELLER WAS ABLE TO DO.


BEN CONTINUED TO E-MAIL AND PRESS ME FOR A SIGNATURE ON THE EXTENSION TO CONTINUE THE CONTRACT. ONCE THE TESTS WERE IN AND THE SURGERY COULD BE DONE IN THE NEXT 6 MONTHS AND DID NOT HAVE TO BE DONE IMMEDIATELY, THE SELLERS SIGNED THE EXTENSION AND CONTINUED WITH HIS MOVE PLANS AND ON TO THE CLOSING DATE. THE SELLERS WERE GIVEN AN EXTENDED STAY TILL THE END OF THE MONTH AT THE HOUSE AFTER THE CLOSE ON THE EXTENSION. THE DAY AFTER THE EXTENSION WAS SIGNED THE APARTMENT WHERE BEN HAD BEEN STAYING SINCE HE SOLD HIS OTHER HOME TOLD HIM THEY HAD A TENANT FOR HIS APARTMENT EARLIER THAN ANTICIPATED AND IF HE COULD MOVE OUT THEY WOULD FORGIVE HIS LEASE. NET BENEFIT TO HIM OF $3000.


THIS IS WHY BEN IS UPSET.


BEN IMMEDIATELY, WANTED TO CHANGE HIS CONTRACT AND MAKE THE SELLER MOVE OUT  EARLIER THAN AGREED PREVIOUSLY TO ACCOMODATE HIM WITH HIS LEASE SITUATION.


HE TOLD ME IF WE DID NOT GET THE CONTRACT CHANGED HE WOULD MAKE SURE HE SENT CONTRACTORS THROUGH THE HOME ON A DAILY BASIS TO ANNOY THE SELLERS AND HE WOULD SEND THE PEST CONTROL PEOPLE OVER TO SPRAY AS HE WANTED. HE DID NOT CARE THAT IT COULD ENDANGER THE SELLER'S HEALTH. 


 THE SELLER TOLD HIM THEY WOULD MOVE OUT AS EARLY AS THEY COULD ARRANGE BUT, THEY COULD NOT PROMISE ANY EARLIER DATE IN PRINT AT THIS TIME DUE TO MOVING ARRANGEMENTS IN PLACE.


BEN SAID HE WOULD NOT CLOSE ON THE TRANSACTION AND DID NOT SHOW UP AT CLOSING AS AGREED.  THE SELLER CALLED HIS AGENT AND DISCUSSED WHAT ACTIONS HE WOULD TAKE IF HER CLIENT DID NOT SHOW UP TO SIGN AS HE HAD AGREED TO DO.  BEN WENT AND CLOSED THE TRANSACTION.


THE FHA INSPECTOR DID GO TO THE HOUSE AND INSPECTED AND SIGNED OFF ON THE REPAIRS THAT WERE DONE AS REQUIRED BY THE FHA LOAN. HAD THEY NOT BEEN UP TO CODE, HE WOULD NOT HAVE APPROVED THEM.


BEN ACCEPTED THE RESPONSIBILITY OF DOING HIS OWN TERMITE TREATMENT AFTER THE HOME WAS VACATED. HE HAD AN OPTION PERIOD AFTER THE INSPECTIONS TO ACCEPT THE HOME OR REJECT THE DEAL.  BEN SENT HIS WIFE TO DO WALK THROUGH OF THE HOME WITH HIS REALTOR AND REFUSED TO COME BY HIMSELF.


I WOULD HAVE PREFERRED TO HAVE BEN GO ON TO ANOTHER PROPERTY. I LIKE TO TRY AND HAVE EVERYONE HAPPY IN A TRANSACTION. IT IS NOT A GAME OF WHO GETS THE UPPER HAND. BEN MADE THIS IMPOSSIBLE . THE SELLER WAS DETERMINED NOT TO LET HIM SLIDE ON HIS COMMITMENTS AFTER HIS ACTIONS AND GO FORTH WITH THE IDEA THAT THIS WAS THE WAY TO CONDUCT BUSINESS IN THE FUTURE(SELLERS WORDS). MY SELLER IS A RETIRED HPD. IF YOU WOULD LIKE HIS NAME AND PHONE NUMBER, JUST CALL ME AND I WILL PUT YOU IN TOUCH.
