Bank of America is refusing to release my income tax that was deposited on 1-30-09 they are claiming that the funds are on hold until my account is officially closed. They indicated the close date is April 27,2009 and there is nothing that can be done about it. I have contacted the OCC and IRS both of these companies have stated that it is illegal for this bank to keep money that was deposited by the Federal Government.

This happened because I deposited a check on Dec 22,2008 that come back NSF according to them on Jan 16, 2009 almost 30 days later. When that happened my account was sent to "risk management." I have gone to the branch in my city and was told by the manager that he had never heard of anything like this, he also attempted to contact "risk management" and ran into the same brick wall. I need my money I have people that I have made arrangements to pay once my check was recieved.

Results after patience and persistance

I am happy to report that on Feb 4, 2009. Bank of America allowed me to come in and withdraw my income tax. I received a call from the secretary for the CEO of Bank of America today Feb 9, 2009 confirming that everything was ok and that I did get the check that was due to me. She was very concerned and I must say that I have dealt with several people at Bank of America who were actually willing to help. I would recommend to anyone who is having a problem that seems difficult to resolve to be patient, kind and courteous and you will see better results. I would suggest that if you are having problems with this bank seek to contact the corporate office. I am so grateful to those individuals who helped me.

I contacted the corporate offices at Bank of America and managed to speak to someone who was willing to help me. She and I made a conference call to the "risk management" department and she was given the same info but also indicated that she would be contacting Consumer Resolution Department. I got a call from a very helpful young lady who managed to get my close date Feb 3, 2009. Unfortunately when I called the account had not closed and they are still holding my tax refund, but I was told it would be closed on the 3rd. I was also told I would get a cashier check in 2 weeks but I am going to call corporate again that is not acceptable. The moral of this story is to stay on top of things, document everything and be nice. Most important God is in control when we remember that things always work out.

In order to REALIZE it you must be able to GET IT, correct? If you can't GET IT, then it really isn't there, wouldn't you agree? Perhaps BOA is in MUCH, MUCH, deeper 'DOO-DOO' than anyone could ever imagine, huh?

I would be in that bank every day from beginning to end making as much noise and stink as humanly possible. If they call the cops on you then so be it make them explain it to them why they wont release your money, also contact the irs and the office of the controller of the currency the regulates banks and thier practices


make yourself a giant sign and picket the place. whatever it takes , then when they give you back your money, close your account with them permanently, after paying a 35 million dollar lawsuit they are only going to get worse on thier deceptive practices anyway.
