Warning - Stay away from this hosting company. With so many hosting companies out there fighting for your business, this is one that you really want to stay away from.

After setting up my account with this company on the 9th of Feb, I tried to contact them via e-mail to see when I would receive my instructions for setting up my account. 10 minutes later I received a e-mail bounce letting me know that the e-mail could not be sent. I checked their site and they had no contact phone number for me to call.

The next day, after I checked and still had not received an E-mail from chaos-ownz-hosting.com, I contacted PayPal and asked them to cancel the payment. They said they will look into the matter for me.

On the 12th, I received an E-mail from chaos-ownz-hosting.com, stating...

" I just logged onto the PayPal account that you made your payment to and I see that you are requesting a refund. It states that you had emails bounce back to you from our server. We were having a problem with the server that I had set you up on. I was unaware of the problem until this morning. I have contacted the system administrators regarding this situation. I am sincerely sorry for the problems that you have encountered.

I am willing to move your site onto a different server that I know has no problems with the email system. This server is just as secure and has the same amount of uptime. I would hope that this would be an offer that you cannot refuse. However, if you feel that this problem cannot be resolved, please respond to this email and I will make sure that the money is refunded to you.

Again, I am sincerely sorry that this has happened. The problem is being taken care and I hope that we can continue to do business.

I immediately asked for a refund... And waited and waited...

On the 15th I received an e-mail from PayPal stating that because this case involved intangible goods, they could not issue a refund and that I would have to obtain the refund from the seller.

On the 17th I asked again about my refund.

They replied on the 18th ...

"After speaking with PayPal and seeing the resolution that they came up with, no refund will be issued. I have proof that emails were sent to you with your log in information.

In reference to the email below, I would have been willing to issue the refund if PayPal said that it was what I had to do. However, PayPal stated that a refund does not need to issued.

I am sorry that you were unsatisfied with the service that you received, but your login information was sent to you the day of your payment."

On the 20th, after a heated debate over this with chaos-ownz-hosting.com. Not only will they not refund my payment for services that I never used, Not only are they not honoring their TOS and 30 day money back guarantee. But they responded by telling me that they were going to get a lawyer after me for slander.

"I am contacting a lawyer! I hope that this $10.00 was really worth all of the slander and heresy that you have just brought upon your self.

And as far as the refund that I was willing to pay you, we can just count it towards court costs and lawyer fees.

If asking for a refund and trying not to get ripped off is a crime, then guilty as charged... With so many hosting companies to choose from, Stay away from chaos-ownz-hosting.com.

I am glad to see that they are proving my side of the story.

In response to their clams...

1 ) I canceled my site on the 10th not the 18th ( I have my PayPal cancellation notice for proof) My e-mails to your site were bouncing, I had no other way to contact you.

2 ) I never received my account instructions until the 14th ( you may say you sent them, but you also said you had e-mail server problems on the 12th )

3) On the 12th, you contacted me, knowing full well that I canceled my account and offered me a refund.

4) Your TOS State "CLIENT will be refunded the amount they have paid, excluding any fees taken by PayPal and for account setup" You do not charge a set up fee for your hosting services and nowhere in your TOS does it say anything about prorating the refund based on amount of time on server.

5) Giving me back my money is the right thing to do, you knew on the 10th that I canceled my account, and you can see that I never used your services, Any other business would have gladly refunded my payment.

6) It's painfully obvious that you do not know how to properly run a business, Please refund my hosting payment per your TOS, less the PayPal fee's and I will consider this matter closed. As you can now see, I am not letting this go.

The other side of the story

In responce to this claim that he was ripped off I would like to provide proof that a refund was offered, but it was not the refund he anticipated. According to my TOS it states that is a customer cancels their membership within 30 days of signing up, the customer is entitled to a refund less the PayPal fees and account set up fees. This gentleman had an account on my server for 10 days. Please see the information below and the emails that he continues to send.

This is part of one email that I sent to him:

As you can see this information was sent to you regarding your account within 8 hours of your payment. In accordance with the TOS that you electronically agreed to, Section 9.b it states:

9. B Applicable to All Hosting Accounts. CLIENT may request Chaos-Ownz-Hosting refunds money within 30 days after sign up has taken place. CLIENT will be refunded the amount they have paid, excluding any fees taken by PayPal and for account setup. If 30 days have past CLIENT may cancel contract, however, CLIENT forfeits monies paid to Chaos-Ownz-Hosting. CLIENT may cancel account with Chaos-Ownz-Hosting and be removed from billing, thereby stopping all future charges.

The $10.00 that you paid to Chaos-Ownz-Hosting had a deduction of $0.59, thus bringing the total to $ 9.41. The cost of the site being on the server per day is $0.33 each day. The account that was set up was on the server for 10 days, February 9, 2006 through February 18, 2006 (the day you confirmed that you wanted to cancel your account.) ; a total of $3.30. Now at this time I will willing to offer the refund of $6.11. This is the $10.00 excluding the fees taken by PayPal and the account.

Please notify me immediately of your intentions so I may refund this amount to you.

His response:

I'll tell you what, if you do not wish to end this on a professional note and refund my full payment then. Keep the money, you obviously need it much more than me... But trust me, It will cost you much, much more in the long run...

If you think that I have been rude, childish and inappropriate, Just wait till you see how vindictive I can be now that you have really pissed off. You could have just refunded my payment at the beginning, knowing full well that I did not use your server. But no, you have had to bring the worst of me out. You now have 1 Hr to refund my payment, If I do not receive my payment in that time I will begin letting everyone know what type of company you run. With all the hosting companies out there just one complaint can turn people off from your site. Just think of the money you can potentially lose.

LIKE I TOLD YOU, I DO NOT LIKE TO BE RIPPED OFF !!!!!

This is the last email that you will receive from me. Your slander is in appropriate and unprofessional and it will not be tolerated. I am contacting a lawyer! I hope that this $10.00 was really worth all of the slander and heresy that you have just brought upon your self.

His response back:

Good, just as long as you know that you will be paying lawyer costs for the $10 that you stole from me. I hope that $10 goes a long way... LOL - And please, have your lawyer call me as soon as he takes the case, I would love to talk with a lawyer that would take on a $10 case.

Note, the word slander that you are throwing around would be true if I was lying about the facts

1) I signed up for your service on the 9th
2) I canceled the service on the 10th ( PayPal Can Verify )
3) You had offered me a refund on the 12th
4) I did not receive the account instructions until days later on the 14th
5) Your TOS give a 30 day money back guarantee ( less paypal fees )

No threats, No slander, I'm just telling the truth, and the truth is enough to show anyone who reads it, how unscrupulous your company is.

I know that you can read the underlined part. It states minus the fees taken by PayPal and for account setup. Since the account has been on the server I have to charge something for that time, weather you used it or not. You agreed to the TOS! Now I am willing to refund the amount I told you and nothing more. You are being very rude and unprofessional and I don't appreciate your attacks on me and the name calling. It is very childish and inappropriate, as well as unprofessional.

I have done nothing wrong. I offered a refund to Scott in the amount of $6.11 which is what he is entitled to. I have no problem payment this amount to him, but he believes that he is entitled to the full $10.00, even though he read and agreed to the TOS found on my website.
