As far as I know, he has ripped off a lot of ebayers,until now. I paid $545.00 to this scum bag for a mini atv, which I never received. Nor was it ever shipped. This was a Christmas present for my grandson. Check him out on ebay. His ID is dstiel05.
Although he has removed his email at aol wich was djstiel@aol, I was able to find another one that he is using, which is jlgrainger2005@aol.com. Feel free to reflect your opinion on this scumbag.

1. Look at the seller feedback, don't buy from people with less then 98% positive feedback or less then 50 total feed backs
2. Its in plain sight for the most part, review the seller's history and feedback supplied by real buyers.
3. Kevin, why havent you forward these emails to the FBI. These are very serious type threats. You have no idea if this man is capable or not of doing harm to you or your family. You have alot of patients because I would've done everything possible to have this man arrested. You should get in contact with a lawyer to have criminal charges brought up on this individual.
I know how the police department works.. I live in NYC they don't take internet crimes seriously. If you complain enough and get a lawyer involved they will do something about it. If the police refuse to do anything and harm falls upon you , the police are reasonable for not acting on those threats he sent to you. There are 2 posts attributed to her on 30 October 2005. In the first, she claims to have been victimized by Kevin and, (if I understand this correctly) this rebuttal was determined to be bogus. In the second, which times in at a little over 12 hours later, she wishes him good luck with the oic, we dont reside in Tn no more, and with the company, well, chapter 7 filed, were done.
After that, there doesn't appear to be any acknowledgement from either Daniel or Jessica.

That is the oddest ad I've ever seen. He says to just email him for what you want. He's got double strollers, Eddie bauer play pens, computers, crib, or just ask him for anything and he'll have it because he has too much stuff. Again, he uses his kids by saying that cash will go to his kids. You should offer him the ATV you didn't get in exchange for his so called "anything stuff."

I have been an avid ebayer for 5 years, and have used paypal almost as long. If a complaint is filed, paypal gives the seller plenty of time to respond. Unfortunately for sellers, if you do not have delivery confirmation or proof you mailed it, paypal always will go in favor of the buyer. I actually was ripped off by an overseas buyer who did recieve package, but then turned around and filed a complaint, which i lost because I didnt have a del. confirmation, even tho buyer did not ask or pay for it, and I had emails from her stating she loved the dress. it did not matter.. My advice to sellers using paypal is ALWAYS add .55 to your item for delivery confirmation to protect yourself. Now, that being said Jessica stated "I am in contact with pay pal, in which I provided all nec. proof. They told me this wasnt the first victim of Kevin Fortier, and gave me Daniel's Name(E-mail) and my husband contacted him."
Paypal would never do this..The person who ripped me off had also done this to 3 others who I was able to contact via her neg. FB on ebay, and we were able to get her kicked off ebay (at least under THAT name), but paypal would not reverse charges even though I told them of the others who were ripped off. They would not discuss anybody else with me, as it is a violation of privacy. And they just kept telling me to show proof..I do not know why Jessica would make that up about Mr. Fortier unless she is doing this to help out the man who originally ripped Mr Fortier off. That is sad. This is a man who was trying to do something wonderful for his son and its turned into a nightmare for him and the family. You need to be real careful about that check, or anything like it. He put verbiage on the back that indicates the check was your refund. If you endorse and deposit a check like that, it is the same as signing a statement that you have settled for this amount. You may not have any further recourse against the maker.
I am talking in generalities here, I understand that the check in question did not clear, so you are OK, but if it had, I believe legally you just kissed the other 400 odd dollars goodbye.

The rest of what I saw in this thread? Well, what can I say? While I agree that keeping the pressure up might be helpful, some of the veiled threats and name calling went across the line.
As for Daniel Stiel's reputation, that was tarnished by him alone long before it reached ROR. You want to sue someone for libel Danny? Try coming after me. I checked you out pretty thoroughly. The fact you weren't arrested for grand larceny amazes me, along with interstate wire fraud, etc. You also clearly intended to defraud your victims on eBay, and never intend to make good unless forced to. You can't sue ROR or Kevin because the report is documented and accurate. Libel requires that the information published be false, which it clearly is not since you have produced zero evidence to the contrary to counter the evidence presented by Kevin. As for suing others, good luck. The US Supreme Court has many times protected the rights of others to their own opinions. If you check very carefully, you will see that is just what the other comments by those not directly involved in the matter were. Speech clearly labelled as commentary or opinion is not cause for libel nor slander. So go ahead, try to sue someone.
Many states have reduced the threshhold of grand theft from $1,000 to only $500. This means you might be charged with a felony, which means rather than jail, you go to a state prison. Given you appear to have committed interstate wire fraud, you may be facing significant federal time as well.
Kevin - It is clear this suspect has no intention of repaying you. You need to file criminal charges and a civil suit ASAP before time runs out. Start out by contacting the Tennessee State Attorney General (fecal matter rolls downhill). Be polite and to the point, leave opinion out of it. In a civil suit, you can also recoup expenses relating to prosecuting the matter, such as court costs, travel, time (sometimes), legal and filing fees, etc. The judgement is good for ten years, and you can seize everything and anything he owns until the judgement is satisfied, including any wages earned.
Let us know if any of the constructive solutions work out or not.

If you are a resident of N.Y. and were ripped off by this individual please go to your local police department and file the following charges against him:
PL 190.05 Issuing a bad check-B Misdemeanor
PL 190.20 False Advertising -A Misdemeanor
PL 155.25 Petit Larceny -A Misdemeanor
PL 190.60 Scheme to defraud -A Misdemeanor
Insist that a warrant be drawn for his arrest. This will place his name in our N.Y.S.P.I.N. system. This is the New York State Police Information Network. It will also show up in other law enforcement data bases when his name is run to further complicate his life.
Then contact the police department who covers Daniel's area and fax them a copy of the warrant and case information. Insist they draw similar charges in their area as well for him.
The "Issuing a bad check" charge is only if he mailed you a refund check that bounced.
Once the charges and warrant have been drawn contact the U.S. Postal Inspector who covers where Daniel lives and inform him of Daniel's activates. If he used the U.S. Mail for any of his illegal activities he can be arrested on separate federal charges. Please include all of the victims who were ripped off by him when talking to the Inspector to get them interested.

This man would be in jail by now if the laws and the legal system worked over night. Unfortunately they do not, also we are talking about more than one state which each state has their own set of laws, we are also talking about internet fraud and all the laws that perain to the internet. I am sorry for your loss, but there is a lot of energy being expended on this issue. Have you thought about suing him in small claims court? I know he is in a different state, but that shouldn't matter and you would be surprised how quickly someone pays up when they are served with papers.
Just last month, I filed suit on behalf of a client who was owed $9330. My client got a check the day after the process server delivered copies of the lawsuit to the defendants.

Im so sorry to hear that Mr stiel scammed you.We won an auction for a mini ATV just before XMAS... a gift for our son. However,what Mr stiel neglected to disclose is that he never had the item he was auctioning off on hand. the auctions catch phrase was"WHAT A XMAS GIFT"and in the ad,he indicated that he would be shipping it priority immediatley upon payment.I made payment via paypal just minutes after the auction closed and inquired as to when the I would receive the item (Mind you,he lives in tennesse and we are in arkansas)His response was for me to allow 3-4 weeks!?!? Icouldnt believe it it!! I could walk to his house and back in less than 3-4 weeks and gladly would have driven to pick it up. When I asked about his definition of "priority",it was then that the story began to unfold.He claimed the manufacturer,not him,received payment and that they then shipped the merchandise to him from japan and because of customs and it being the holidays, priority was 3-4 weeks.HOGWASH!!!paypal confirmed payment went directly to HIM,not some japanese manufacturer. Nevermind had the man actually put that information in the in the auction listing, we would have gone right past it. Anyway, I immediatley notified my bank, paypal, ebay and paid for a square trade mediator to get involved afterwhich I received a full refund.i consider myself lucky because it appears not everyone was so lucky. im sorry for your situation and I would be happy to help in anyway i can. best of luck to you!! I lived in Johnson City, TN, for awhile. Johnson City is right next to Jonesborough. I worked with two different people who had been "SHEISTERED" by Stiel. I'm not real sure if they ever got anything rersolved with him. I didn't here about any "WHOOPINS'" so Daniel J. Stiel must have either gave them their money back or they just gave up.

This is wrong, considering I have sent out his refund, along with an appology, But I have a newborne and two year old, I needed to make sure he didnt get it and that I was being scammed. Lt. My GF left a msg yesterday, and I have more info here. Mr. Stiel does not live where he says he does. check out Case# 520GT0400273600 in the Bristol GD Court of Virginia. These are Charges to mr. Daniel James Stiel also known as living in tennesee Born Sep 9 1974. If Any of this information Helps anyone prosecute him, then I did my part.

This guy ripped me off to, He cant even spell look at his rebuttel. I have filed charges and the police said it will probably go to the FBI, because it is a federal crime.
Most local police departments have a hard time going through with online fraud, but will forward them on to the proper departments. I say that you should file charges against him. He will go to jail, there is no doubt in my mind. You dont rip people off on this scale and just get away from it, He can give all the excuses he wants to us, but when it comes the the judge, it aint gonna fly.

Rip off rweprts have no way of knowing the truth, and I will be filing a lawsuit against them For slander, and allowing such rediculous words to be exchanged. I have the paperwork filled out, and will be submitting Monday morning, BETTER WATCH OUT RIP OFF REPORTS. A signature has been confirmed of delivery, and Tiger Int. confirmed it has arrived to its shipping location in Tupper Lake NY. If some one else signed for is NOT my responsibilty, Now, I will sue Rip off reports and Kevin and have My Proof to bring, Rip off reports are false and they never check to see if the reports are correct, or if some one is just trying to scam in return. Let me tell, I am not very good at bluffing, never won a poker game and dont like liers, so you can be assured I will know rip-off reports you know what in the dirt in court and all theyre B.S. to follow. WATCH OUT RIP OFF REPORTS, better file for unemployement cause I PROMISE to you, and all. We will be in court. I have proof of delivery and I assure you this wont ever happen to somweone again. I have great attornies! Too bad. That's YOUR problem, not the buyer's. So is shipping and refund processing. If you're stupid enough to do all this AND accept full liability for delivery, that also YOUR problem.
If you refund his money and he eventually gets his merchandise, then at that time you can seek legal remedy. In the meantime, you are currently on the hook big time. The buyer didn't pay "Tiger", he paid you. That's the end of the money chain pal, and it's your problem.
To the original buyer: I believe that more than enough time has passed. My advice is that you send a registered letter since you appear to have the address. In that letter you should demand a refund or delivery of the merchandise in 7 days. If you do not receive either, file CRIMINAL charges with the authorities in the county his business is in.
As to his threat to sue, that's a pure bluff, and a weak one to boot. Hell no he's not going to sue. The last thing he wants is to get mired up in the legal system - he'll end up in jail due to your criminal complaint.

Scammed by being called a scammer

I sent MR. KEVIN his info. on of the manufacter in China called Tiger International. They shipped atv, I forwarded all info I had to Him, and yet he says ha never recieved. I sold 5 of them and he is the only one that says he never recieved it. Everyone else was tickled for what they recieved. One lady even wrote me and told me thank you. I am not out to scam anyone and told him I would refund him as soon as I verified with Tiger Int. wrote me bacl to explain, I didnt make any money, actually about 18.00. I have had Numerous people trying to scam me over the seasons, but I want to make sure Mr. Kevin NEVER recieved it. I truly am sorry if he didnt, but I am not a scammer, and will sue any one, ANY ONE!
Mr. Kevin Fortier mis the scammer. If he recieved it. But I am a respectable member of the community, and wont stand for some b.s. reports. I will NOT scam anyone. And if he did not recieve it. The guy won an auction of mine on the bay, he never paid and lied about paying, although I didn't send him the item, he continues to send me profane emails and threats of sending me viruses. This guy should be barred from the net. After he rips you off, he blocks your email address so he doesn't have to respond to you. Steer clear of this guy and or his company. He is a shady businessman at best.
