I had prepaid Fingerhut monies (I was in college and didn't want a charge card from them so I prepaid for items for the holidays). Anyways they were to ship the items as one or two packages as friends warned me they liked to ship a bunch of items as individuals so they would get $ from shipping. Anyways, I paid them $1593.42 which was to include a moped for my nephew (this was around 1995) along with other small items that could easy fit into a one or two cubic size box. They guaranteed items to arrive by December 20th for christmas. They cashed my check and guess what - the items never arrived so by the 22nd of December I'm out running around trying to buy gifts (something I wanted to avoid doing that is why I went with fingerhut who guaranteed arrival). Anyways, I asked for a refund and got around the second week of January, I get all the back order items! So I refuse them (UPS delivery) and off goes UPS. Fingerhut gets pissed and well, I never got my money. I go off to graduate school and well, time moves on so I thought. Well, October 2002, I get a letter from Jefferson Capital wanting to know why I never paid Fingerhut. So I send a copy of everything to them. Don't hear back - so I send them a letter telling them their client now owes me $$$ (21% interest for seven years = they owe me $3935.76. Don't hear a thing. September 2008, I now get another threating letter stating pay or get sued. So, I turn the letter and info over to the Ohio Attorney General's Office. Complaint #465238.

And I quote:
"As a matter of information, Fingerhut closed in July 2002...and were not aware of previous dispute regarding the balance... and Jefferson Capital has not reported any information regarding the account to the credit bureaus."
Lies Lies and more Lies.
Go online - www.fingerhut.com and see they are still in business. And yes, Jefferson Capital did report my non-payment to all three credit bureaus and as of today, it is still on my credit report.
Well, time to sue everyone! Anyone wish to join me on a class action suit?

Apparently, you failed to understand what your state Attorney General told you....Fingerhut DID GO OUT OF BUSINESS...the current company only kept the name, and the distribution warehouse.
Also, due to the fact that Jefferson Capital has not reported your delinquent account, they are "dynamite fishing"...throw a letter out there and see what floats.
If you think suing a company that is no longer in existance is going to work..well, as a person that is married to a lawyer, I can tell you from first hand knowledge..you're wasting your time...sorry.
I would suggest going to your local Credit Bureau, and find out what your rights are in disputing the Jefferson Capital collections action. Due to the length in time, I would say it's a "non issue"

I am not going to dispute the validity of anything other than the fact that Fingerhut did close in 2002. Fingerhut was owned by Federated Department Stores, owners of Macy's and Bloomingdales. In January of 2002 employees of the Fingerhut in operation at that time were notified that Federated had decided to shut down and liquidate. The employees were eligible for unemployment and Dislocated worker benefits as the entire company was shut down. Here is a link detailing the closure of the St. Cloud offices.

The Fingerhut that is currently in operation is a totally different company. They don't even do any telemarketing sales any longer.
