K-Mart - Martha Stewart - Numark Company I was sold an outdoor furniture set that was advertised to be rust resistant. It rusted in less than 1 year. Was offered a $25 gift card instead of a full refund ($380). AVON Indiana

When I sent the pictures and request to her attention, she gave me a phone call back and stated that my request was denied. Why ask me to take pictures and send them to the company only to receive a call back with another denial? I did speak to a supervisor of the company and she offered me a $25 gift card for my inconvenience. I just laughed at her and told her that I would be suing Numark/K-Mart. I notified the BBB against the company on 1/20/08 my complaint number is 5962138.

I also bought this furniture on April 8, 2009. It started rusting immediately, like the next week. After spending a day putting it all together I wanted to just live with it. However it just got worse and worse.
I purchased 2 five piece seating sets, 1 table, 1 set of 5 chairs and an umbrella. The umbrella and table are fine-though after checking out this internet search I have seen MANY complaints about the table exploding into a million pieces and my grandmas actually did she just thought a racoon jumped on it over night.
I went to the store today (with pictues) and since the 90 days are up now and they dont have anymore they gave me the number for NUmark and said there was nothing they could do..(the manager also said there was 1 other complaint all season....I must have gotten a bad one). Now I am wishing I would have went immediately when it happened.
Since today was Sunday Numark was not open so I decided to give KMart a call...they said NuMark would give me a call within 2 days....cant wait to see how this turns out.

I was a little off on the manufacturer's name. It is NUMARK, not Nuway:

I did reach someone at Numark, and have been going back and forth with them since my post above. They wanted my address to send replacement parts, but it sounds like these would be the same parts that began rusting almost immediately. I don't see the point in disassembling and reassembling the whole set with parts that are going to begin rusting almost immediately. I'm just trying to get them to confirm or refute my suspicion that nothing has changed about the materials used in the parts they want to send me.
From my experience and other complaints I have read online, it sounds as if Numark is trying to dodge complaints by telling people they should have covered their patio furniture. I agree if we're talking about covering it at the end of the summer to protect it from harsh winter weather. But to have a set that remains covered during the summer when it is used daily? That's unreasonable for something sold as outdoor furniture.
I suspect they get a lot of similar complaints because the rep I spoke to said something like, "I can tell you what they're going to say. You should have covered it." When I told her that my set was only three months old she stopped trying to place the blame on me, but she was very guarded about what Numark would do to remedy the situation.
Our set was probably not a month old before it began rusting and at three months there is rust at every joint/connection and in several other spots on every single chair and on the ottomans. I have posted pictures here (keep in mind this is only THREE months old):

Other people who've said you shouldn't expect much out of KMart furniture are probably right. I expected more because of the Martha Stewart brand name and because I paid more. This wasn't a $99 set. I hope anyone reading this and considering a Martha Stewart patio set will not make the same mistake.

Just wanted to say that the original poster DOES have valid reason to complain. We bought our patio furniture three months ago and it is already rusty. It would definitely be unreasonable to expect an incredible life span out of inexpensive furniture that came from KMart, but beginning to rust within a month, then developing numerous rust spots before three months, is completely unacceptable at any price. And we did spend over $900 on the set.
I've called KMart/Sears customer service and they've notified the manufacturer, Nuway, who they say must call me within two days to discuss resolving the problem. I hope they will but this and other online posts don't leave me with confidence in the company. My only advantage over the original poster is that I've been able to see what's going on with this set and call them on it.
Google "martha stewart chairs rust" and you will see that this is not an isolated incident, nor is it even limited to a particular set. Unfortunately, poor quality seems to be a persistent Nuway/Martha Stewart patio furniture problem.

Small claims court is your bet if you are within the one year warranty, but is it worth the frustration to do all that for a table? Only you know the answer to that. I wish you the best, but Kmart/Sears have not been in bk court for taking care of customers, think about that.

Secondly, "rust resistent" means it resists rust, not absolutely will never rust. Especially if you exposed it to harsh weather and did not take care of faded fabric or chipped paint (like it says to do in the enclosed intructions). In the perfect world outdoor furniture would only rust, or biodegrade when it was discarded as trash.
Finally, I agree with Sears on this one. I don't think this even warants an explanation or statement from them of any kind. It's a no-brainer.
