I had a debt with Capital One. Nelson, Watson called me to collect for Capital One.

After many, many calls and the language they used toward me, I finally gave in for them to take 3 payments out of my account. Then they were to contact me to set up another plan that would cut the debt in half.

I have never heard from them, except to take the money from my account now for almost a year. They take it from my account the end of the month and I get paid once a month with my disabilty. Thus this causes me an over draft every month plus what they take out.

I have come to my wits end. I can't keep doing this.

NEVER, NEVER, EVER give debt collectors your checking account numbers for autodebits...This is an invitation to disaster.

FYI: SSDI cannot be garnished. If SSDI is your sole source of income and you do not have any real assets...they are powerless over you. Even if they won a judgement, they CANNOT touch your SSDI.

Call your local Red Cross for a referral to free legal aide in your area.....They can provide further clarification.

You might want to think about canceling your checking account to stop the auto debits.
=====================
Here's how to confirm if you are "really" dealing with an actual attorney or a debt collector pretending to be one:

When you are speaking to them and they make a legal threat against you, immediately state the following:

Per the Fair Debt Collection Practices Act, I would like the full name of the attorney who will be taking action against me and his/her license # in the state bar association. I will be calling the state bar association to verify your attorney's information.

If they do not give you this info, the threat is bogus. If they do give it to you, the threat is real and you should proceed with caution

#1 Consumer Suggestion

Heres what you do

AUTHOR: Cat - (U.S.A.)

Here is what you do.

1. go to your bank and ask them to stop payment on this account immediatly. Sign something if you need to, but tell them this co. will not stop. IF they won't then close out your account to further charges and open another one where they do not have your acc number.

2, never give your acc out if your behind because now you know they lie and talk to you like SCUM! These people will say anything to get you to pay.

3.Do not talk to these people again. Ignore the calls and if they contiunue send a ceast and desit letter , certified return reciept requested.

I hope you got what they asked for in a written form before you gave them acct access.

I hope you get this done today!
