The following letter to Remax describes our problems.

Ms. Rosenthal;
As you know we were unable to rent 2688 Gordon
Road due to the Boiler blowing. We ended up renting
XXX XXXXXX Drive instead (much more than the budget I
explained when calling from Afghanistan). Also, as
you know we have let you know on several occassions
that there is some sort of short in this home, and as
of yet you have not sent an electrician to check it
out. If we return from work, shopping, or searching
from work one day to find the house burnt down and our
cats dead, we will not have any problem contacting a
lawyer to sue Re-max and the owner of the house.

We already had to do without water for almost a
week, forcing us to go rent a room at Fort Wainwright
one night, then use the Gym at Wainwright another
night. Then go dirty for the rest of the week.
During the time that you FINALLY sent someone to fix
the problem, the plumber you sent had to bypass the
water softner, and he called you to explain the
situation (I was standing right there). There still
has been nothing done about the water softner. During
this incident I contacted the base legal assistance
officer, and he said "I am not going to waste your
time, hire a Tenant/Landlord lawyer, and go after
Re-max". Of course, since you had already drained us
of all money that we had, you had no worrys because we
would have to pay the civilian lawyer up front.

From your report it appears that ReMax is acting as a property manager for the actual owner. It also sounds like you are on active military duty.

Since ReMax has been unresponsive I would send a demand letter by certified mail to the property owner and threaten to file a lawsuit against him/her along with ReMax. The property owner contracted with ReMax to avoid the day-to-day hassles of being a landlord and the threat of a lawsuit is likely the last thing he/she wants. Both owner and agent are likely aware that the property is substandard but neither will want to face a judge and jury. In your case, it gets down to a person serving his country versus parasites preying on military personnel.

You should be able to find out the name and address of the actual property owner at the assessor's office.
