I received an unofficial summons (no court Document # included) from Como Law Firm via UNIFUND CCR Partners and would like to know how to respond. Is there a standard template or can I use a debt validation letter to respond?

I'm in a similar situation as this with this same firm. I however did not realize my rights and the laws regarding this and didn't respond to anything that they sent me. However because of this and the pocket law I was automatically held in default and a judgement was made against me. Now without any notice they have put a levy on my bank accounts.
Also, I only spoke to Mr. Steven Rosso once, and was concerned about the debt. It was a medical bill that I was not aware of, and expressed my concern about the matter and asked him to send me the bill so that I could look it over and try to take care of it. He said that he would and basically milked me for information. I never received the requested information, but received the judgement.
I have never dealt with anything like this before. Any help/advice would be greatly appreciated. I'm at a loss for what to do at this point. Thanks.

Sorry to respond so late, but you will need to answer the summons within 20 days. I did and now Como Law has filed for judgment against me using another court file number. I'm in the process of talking to the court since Como was notified of the orignal answer and discovery file number by the court admin and they needed to respond with the orignal court number. Anyways, so now there is a jugdment in the high teens against me and I have a phone call into the court admin to get this resolved. Como went around the procedures by acting as if they never recieved my Anwser to the summons. We'll see what the court says.

The brain dead idiots at this law firm think they can bully someone into making their case. I would keep an eye on whether they file for a summons. In other words call or check through the internet for any suit filed against you.
I also would visit debtorboards. A lot of useful information including a couple of lawyers that will answer questions.

I am unfortunately inm the same circumstances, got the similar summon from same parties ( Unifund and COMO law firm) wanted to know my next steps, I am worried about the law you mentioned here. Shall i get a lawyer?

Findings for MN & CA

Actually I found some very interesting information for MN & CA. MN & CA have a law enacted called a Pocket Docket. A Pocket Docket allows lawyers the ability to submit a summons without filing a court docket and paying the court setup fees. Based upon MN & CA law, a lawyer can submit a summers for answer and require the defendant 20 days to respond to the Pocket Docket or be found in default of the summons. If you are found in default then the law firm can request a default judgment against you without your appearance. It is very important that MN & CA summons are responded too with an Answer and Defendants Discovery Request to Plaintiff putting the burden of proof back on the Plaintiff, requiring a 30 day response or they will be in default and any court case will be dismissed based upon non-response of the above request to plaintiff.
One needs to keep in mind that since MN & CA have this pocket docket law, the court filling fee is put on the defendant and cost me $248 to file the paper work or I would have been in default by not responding to the summons.

They are trying to trick you into making their case for them. DO NOT FILL OUT ANYTHING they send you.
You are under no legal obligation to make their case for them. Although many people disagree with me on this, I have never even responded to "interrogatories". The legal burden of proof is on them, so why would I fill out that garbage so they can beat me? That makes no sense.
I have refused to fill those out on three different occasions, and on three different occasions I beat the lawsuits filed on me. That's because I DENY EVERYTHING!!
Unless the judge issues an order to me, they get nothing.
Even then, I give very vague answers. Just enough to avoid the contempt charge.
Debt collectors get nothing from me. NOTHING!!

i just seen your report. i just thought id let you know that i know a few people that have dealt with unifund and that como law firm. from what i have heard is that they have a good reputation for not showing up for court. they have a great reputation for going after people for debts that way past the SOL of collections, if i were you i would get reports sent into the minn attorney generals, the bbb, the department of commerce (above all them) and the court house where you live. i would get them reports in ASAP..best of luck to you, let us know how things turn out for you.
