I was offered help by John Acosta and American Mortgage Aid in getting a loan modification.  They encouraged me to get a $1200 REST report Which would aid them looking for issues in my mortgage agreement that would aid them in working with my lender to get a speedy modification.  I was told that if there was no need for the report, I would get a refund for the report and if I got the modification that the 1200 would go against their price of their service.

They said do not contact your lender, they would deal with them directly.  I would get mail from my lender and I would call John Acosta and he say Don't worry my friend; your lender has all of the paper work and everything is going as planned and the modification should come soon.

I answered a call from my lender one day, and they said that they had no paperwork or anything else from American Mortgage Aid.  I called John Acosta and once again he said that the lender has everything and is requesting nothing else.

I told them that they had nothing and gave him my lenders number.  He came back and said that I needed to fax additional paperwork which I did.  I was passed off to Mark Heustes who later passed me off to Leah Sims whoi shortly tere after emailed me to say that they could not help me get a modification.  This process started in January and she emailed me in at the end of July.

The week before John Acosta called and said tyhat everything was going as planned and I would have my modification shortly. 

After that they stopped returning phone calls and emails.  They refused to give me my 1200 back and they could not produce a copy of the REST report, but they did offer to re-order it.  My lender never got the REST report.

I called Mortgate Alert (the REST retailer) to request a refund, since it apparently was never sent to the lender and it was not in my file American Mortgage Aid.

Leah Sims seeme sincere; no issues with her.  John Acosta took advantage of me and took money for a product that was not delivered. Had they had gotten the report and used the report, they would have possibly been able to help me or at least said that the REST report says we can't help you. They did't get, they didn't use it and they did nothing to help me.  John Acosta did say that Leah went to bat for me twice.  I guess that means she contacted the lender twice over the six month period.

They should be closed for fraudulent business dealings and they should refund money they took

 YOUR COMPANY IS A TOTAL RIP OFF AND YOU GUYS TOOK MY MONEY AND NEVER HELPED ME....AND YES YOU DO CHARGE FOR YOUR SO CALLED REST REPORT...YOU GUYS SCAMED ME FO $1795.00 AND TOOK $1500.00 FROM MY AUNT HOW DARE YOU YOU GUYS...AND NOW YOU CLOSED YOUR BUISNESS AND DISCONNETED YOUR NUMBERS IM GONNA SOME HOW FIND A WAY TO FIND YOU GUYS AND MAKE SURE YOU GUYS GET ARRESTED FOR FRAUD...SCUMBAGS YOU GUYS TOOK ADVANTAGE OF HELPLESS PEOPLE

     Larry O**** Case Id #77825 became a client of AMA in January of 2013.
Mr. O**** opted to pay $1200.00 for A REST report,  from a third party.  ALL $1,200.00 was charged by that third party. All documents were received to our office by Mr. O**** on 4/18/2013. We put in an order for the report with the third party on 4/19/2013. It was delivered to us and our mutual client via email within 3 business days. AMA has a copy of that report (available upon request document is over 36 pages) the findings on the report show that Mr. O**** should qualify for one or more modification programs. AMA then proceeded with the submission to his lender on 5/13/2013.

Per our contract (available upon request) with Mr. O****, WE DO NOT CHARGE unless the borrower receives and approval and accepts the terms of that approval. In this case, unfortunately, the investor declined our requests after vigourous attempts to obtain help for our client in July. The entire process Mr. O**** was contacted and aware of the status of the modificaton request (this was the first and only Ocwen decline we ever received).......no fee was due to AMA. Mr. O**** is requesting that AMA refund him money that he paid the third party to generate a report that was ordered and delivered. This process was explained by me from 7/25/2013-7/30/2013 via email. The third parties information to request a refund was furnished by me on more than one occasion.

I don't believe that he made any contact with them to request the refund.....I called Mortgage Alert personally to see if he contacted them about a refund, they stated they returned a call to him, left a message and never heard back.  After I gave him the information to the third party, I also did not hear from him. To date American Mortgage Aid has not received any funds from the borrower. Mr. O**** also filed a BBB complaint with the same allegations, American Mortgage Aid responded, and the case has been closed. Mr. Acosta is one of our best agents and has always cared for his clients. He was as upset as the client with Ocwens decision to decline.

     Borrowers are offered a chance to purchase a REST Report from a third party (A approved retailer of the REST REPORT company) Clients are not required to purchase a report to be clients of American Mortgage Aid, but we have found that borrowers that opt to purchase the report increase their chances of obtaining a loan modification, and it helps American Mortgage Aid see what programs the client will or should be approved for. We will still work on a loan modification for our clients even if they do not opt to purchase a report from Mortgage Alert. The charge for the REST report goes directly to the third party, and the report is generated by them (as soon as all the documents are collected) and is sent to American Mortgage Aid and the client that purchased it. The REST Company has put a price range on the report to their retailers of $795- $1500.

    The report is ordered by American Mortgage Aid once the borrower decides they want to purchase the report, and have sent all the necessary documents needed to run an accurate report. The report cannot be generated until the borrower gets in all the information.

     American Mortgage Aid submits on the clients behalf (and includes the REST report) in the submission and follows the file all the way through to completion. If and when the borrower receives and approval and accepts the approval, the fee to American Mortgage Aid will be due. It is impossible to scam homeowners when we DO NOT receive ANY compensation until the job is completed. If we do not obtain an approval, there is not fee due to the client.
