Well, first of all this whole thing started when I started attending the gym in Austin texas called Premier Lady. They also have a tanning salon next door, and it's only $25 a month. Excellent right? Well I paid a couple months before I was told that they were changing payment services. No big deal, I signed the papers and that was it. Little did I know that I was signing a ONE YEAR CONTRACT.

We moved and I had to cancel my gym membership with gas prices and all. I also had to cancel tanning. No problem with the salon, but I got charged a month after I cancelled my membership. I called the salon and they told me that they were leaving American Payment Services because all the customers were having this problem. When we signed with the Payment company, no letter came or anything telling me what I was getting into. They gave NO CONTRACT. The salon also said they were taking legal action against the payment service, because of all the money being STOLEN from the salon and all their customers.

I called the company demanding to know what was going on. I was paying $25 a month for no goods, no services. I was pretty sure this was illegal. They told me that I was going to have to pay or they would turn the past due amount in to the credit agencies. I was told that I had to pay 4 more months at $25 a month. FINE, I just want to get it over with.

It's not a LOT of money like they are scamming other companies with, but at 22 with a mortgage, two cars, insurance, and a 2 year old, it adds up quick.
My credit card got stolen about a week later, and I had to cancel the card. I called all the accounts it was attached to and let them know the new number, forgetting that I was paying for nothing with American Payment Services.

I was charged an extra $25 for the card getting declined. I understand that. It was my stupidity. I called, gave them the new number and paid over the phone.
The other day, I got a paper in the mail saying that my card was declined, and that I was charged an extra $25 AGAIN. I was so frustrated, and was planning to call first thing Monday morning. Little did I know, that I wouldn't have to give them the card number again.

I checked my bank account today to find out that they had charged me the $25 a month fee PLUS the $25 for a declined credit card. How is this possible!!! If it was declined, that meant that they didn't have my correct card number. If they didn't have that, then how could they charge the account?

A word to the wise...just check out the payment service that all your payments go to. If its AMERICAN PAYMENT SERIVICES, then just pay cash or check. Don't go through the headache me, and all the other Tan Center members are going through.

APS: I am Client Services for American Payment Services. I understand that you are upset about the way the fees and transactions work but it was in your contract. After reading your report, I am going to walk through some of your statements and answer them the best of my ability.

You stated in your opening paragraph:

APS: You signed papers and didn't know it was a contract? Not many people just sign papers without knowing what it is they are signing or reading it. Truth if the matter is that American Payment Services is just a billing company. Contracts are drawn up with the approval of the club. APS is hired to uphold the clubs contract, unless the club wants to wave the fees which happens rarely. Your contract was with the club, not us.

You stated:

APS: This is ridiculous not to mention a down right lie. So much infact that APS could take legal action against you for fabricating this statement. APS has never stolen anything from our clients and have a long list of clients who have used our services for many years and will continue to for many years to come.

You stated:

APS: Yes APS charges a fee when a card declines. It is the same as writing a hot check at a store. You will get charged a return fee. When your card declined, You were charged per the contract you signed.

APS: I fail to see how canceling your credit card and failing to contact us about it is our company's fault? Invalid credit card number is the same as a decline and fees will incur per contract that you signed.

You Stated:

APS: When a card declines, it is set on a 10 day redraft (per contract that you signed) This is done to collect monies owed to the facility you are getting services from.

You Stated:

APS: A word to the wise...When you join a facility on a draft basis, read the contract so you know all the policies and procedures. It sounds to me all of your issues could have been avoided by reading your service agreement, which you said your self you did not do.
I apologize for any confusion you had with ours and your facilities policy and procedures but nothing you posted held any water here.
