When can an HOA (Home Owners Association) go too far? Colorado Management runs a handful of subdivisions by remitting HOA standards.

I am a new home owner and Richmond American was kind enough to place a front and back yard fully landscaped with shrubs, trees, rocks and grass, it looks very nice.

I was humored by Colorado Management when I just recently received two violations. Here is what the HOA manager Irene Borisov had to say

Hello Sean,

Thank you for your reply.

In regards to landscape, each rear yard need to have one 6 ft. evergreen tree and one 2.5 inch caliper deciduous tree. Each rear yard also needs to have 30% bed coverage (I.e. shrubs, bushes, extra trees, perennials) in all areas that have rock and/or mulch outside of 5 feet from the foundation of the home.

I have included the welcome packet that has these requirements and also the formula needed to calculate how many shrubs you will need to have.

Since the landscape was out in by the builder, I will make these notes in the system and not expect that you will be able to get plans from Richmond to turn in, but the other items need to be rectified and you as the homeowner are ultimately responsible for this.

We sent out 600+ violations in regards to these types of issues, so many of the yards that you are seeing are also in default of the requirements of the community and we are working with homeowners to get these problems solved.

I will forward your information on your dies to the AR person in charge.

Give me a break should the HOA be responsible to pay the thousand dollar quote to live up to their standards? My yard looks great, green grass the whole nine yards.

You think you have It Bad!

I have lived in a complex ran by Colorado management and Associates for over 12 yrs. They have it set up to where they are in total control at all times. They have made their own bylaws that state that homeowners can only vote on board members once a year, evey other time they keep re voting in the same people some for 10 yrs straight. They are all in cahoots with each other and are running the place into bankrupcy, at times they run it as a n**i camp. They pay there contractors way to much money at the expense of the homeowners. They yell and treat residents like crap but not at meetings where there are over 3 people so that there is any witness to there behavior. There treasurer just recently resign because he couldn't answer the homeowners simple questions. It was told to a new board member that all you do as a treasurer is sign checks! No one makes them held accountable for their wrong doings, the residents have collected over 200 petitions and they still won't leave. If anyone knows of a attorney that could represent us in a class action suit let us know. They tried to make us pay for dryer vent instalation without our permission and it don't work we just discovered that they were already in place and not hooked up. Lies, Fraud and deception. Stay away from any place that uses Colorado Management and Associates they and the board members(old ones) of Cottonwood Villas are a bunch of crooks!

Only one of MANY reasons not to buy HOA homes.

Unfortunately, yes they can force you to do this. Did you not read the HOA regulations before deciding to build/buy there? If you aren't already aware they make ALL the decisions.
Here are just a few examples:

1. What colors you can(and can't)paint your house.

2. They will fine you if you don't bring your trash cans in soon enough.

3. How many AND what type of vehicles you can have in your driveway.

I will never own a home with an HOA! I want to make MY OWN decisions about MY HOME. I can never understand WHY HOA's became popular or acceptable!

You are in for years of pain. I hope you don't have to live there long. Be sure and update us on this and the hell to come.
