Interesting to hear so many other attorneys and parties have had the same problems with Gene Podesta at Baker.  In one of my medical malpractice cases against Eugene Podesta’s client, Methodist Healthcare, Podesta did the same type of thing.  Using motion after motion, delay after delay; Gene forced the case out for almost 4 years.  While we were finally able to settle the suit, Mr. Podesta used numerous underhanded tricks to impede the suits progression, with the ultimate aim of procuring a more favorable settlement for his client.  The reason our judicial system is so muddled and difficult is because of lawyers like Eugene Podesta and other big defense firms like Baker Donelson.  Gene loves to complicate and confuse, throwing every lawsuit filed against his clients in total disarray.  Truth finding is never Podesta’s goal.  His aim is to fog up the facts, facts that are normally cut and dried, in order to help his healthcare clients avoid liability.  This practice is the root cause of the pandemonium that exits in our court system.  So when my fellow barristers encounter a five year heavily fought lawsuit on their simple cases with obvious liability, you can thank the likes of Gene Podesta and his cohorts at Baker Donelson.
