Franklin Credit Management Corp. Tricked into forclosesure Jersey City New Jersey

My wife and I had a run off bad events some health related some work related and had fallen behind in our home mortgage payments to Franklin Credit management Corp. and our Property taxes, and fell behind on our loan by two months But we always managed to pay our monthly payment but were not able to get current.

After some time of this routine my wife called FCMC and requested a loan Modification to help us get current on our loan and erase the credit damage on our credit report that this was causing, she spoke to a representative from FCMC loan modification dept where we were advised to write a hardship letter explaining our circumstances and why we felt we needed a modification after this senario we were told by a representative of the company that we were approved and that our payments would be deffered and that we need not make a payment untill the following month which is exactly what we did. The following billing cycle our bill reflected that we had fallen behind another payment bringing us in danger of forclosure.

After contacting FCMC again in regards to the matter we were then told that we were denied and that we are now back 3 months on our home mortgage loan and that they had paid our back taxes and raised our loan payment by over $400.00 Obviously we were not able to get curerent prior to this so by raising our payment made catching up impossible after several attemts to the FCMC customer service dept nothing was resolved about the error of telling us not to make a payment and bussiness went on as usual except that now our payment went up by over $400.00 per month after approxamatley a year of this We again decided to ask for a loan modification and were told that we would get a loan modification and that the paperwork would be drafted and sent to us that it needed to be notorized and faxed back to FCMC and that our back taxes and back payments would be deffered and that they would start an escorow account for our property taxes.

Paperwork was drafted and sent to us but when we recieved them it stated that our payment would go up by $50.00 from our original payment amount which we felt was ok but also that we needed to pay an extra amount of $324.00 per month for what we belive to be for taxes bringing our payment again to $375.00 more than the original agreement we questioned it because our taxes are only $1,200.00 per year and the $375.00 came out to $4500.00 per year and the paperwork stated that this payment will be payed untill the note was satisfied so after another ordeal and going around and around with not being able to contact or talk with the same person twice in thier company except the represenative that put us in the situation previously mentioned with FCMC we were told that the paper work would be corrected and re-sent to us after weeks and several attempts to contact anyone with information in regards to the process, new paperwork was drawn up and mailed to us after reveiwing the terms again as anyone that would sign any commiting document would do we had a question about why they rasied are payment and again called to verify before signing We were told that it was because they had changed the note from a 30 year to a 20 year note Which in this case we were prepared to sign the new document and be done with this situation When we again told by the previously mentioned representative that they would question the person in charge or writting the modification and would get to us later that day with an answer to why it went from a 30 year to a 20 year note.

After waiting two days we again tried to reach someone in regards to this matter waiting to get the paperwork that we had notorized and faxed back as to get the process over with and start out with fresh slate with no response Again approxamately 2 weeks went by without a response by phone or mail called FCMC and and because the paperwork stated that we need not make payment again untill Febuary 28th did not send a payment out again also once again as advised again by thier representative so on the day that our payment was due we personally contacted FCMC and asked what amount needs to be paid and what was the delay in the deferment process and why has no one returned our calls or contacted us in this matter?

We asked to speak with a manager which is a process in its self after finally reaching a manager we were told that because we had so many questions that the deferment had been denied and that we were now in serious danger of forclosure because as my wife was told our property had been inspected and that it was worth much more than the loan amount. We made two paymants that day to avoid any legal action but still feel very worried that they may try to forclose on our home in some way if anyone has any advise please reply. We are curently trying to reach FCMC's Corporate office if any one out knows of who or how to proceed please post a reply
