I went into this dealership to purchase a 2009 Mercury Mariner. I was told I had to put down $500-$1000 because they did not have the color I wanted so they were going to have to trade a vehicle from their fleet with one I wanted. I put $500 dollars down via credit card and was told that they were getting the car into their lot in a couple of days. When the suv came in it was the wrong one but the manager (Mike) called my husband telling him I should just take this one because it's a better one and it was more than the one I wanted. My husband told him that we were not going to get that one because that wasn't what I wanted. I got fed up with these unprofessional people over there and decided to go to another dealership and purchased the vehicle that they couldn't seem to find me. Now they are telling me that I can not get a refund but they broke the contract that we made trying to make me take another car. They even offered me $300 dollars off any service if I would take this vehicle. I have filed a consumers affairs report and reported them to the better business bureau. My next step is small claims court.

You should TRY the 3 way call. After all, a phone call is easier than going to small claims court.

They did not fulfill their part-the produced the wrong vehicle and should grant a refund.

Dispute process does not work

I called the credit card company and was told that we would have to do a 3 way call with the company to see what their refund policy is and you know they are going to tell them that they don't offer refunds on "special orders."

you said you used a credit card - call your credit card company and tell them what happened and initiate a charge back.
