My landlord, Lina Nicol Mascio, illegally withheld half of my security deposit for bogus painting charges after moving out of Granada Grand Condominium at 5271 Southwest 8th Street Miami, FL 33134 on May 19, 2014. I only received a a partial return of my security deposit, $362.50, instead of $762.50 divided in half with my roommate. I paid a $1525 security deposit at the beginning of my tenancy, but the list of itemized deductions sent to me on 7/19/14 was past the 30-day deadline and violates Florida Statute Sec 83.49.

Because no claim of itemized deductions was sent to the tenant by the 30-day period ending June 30, 2014, the landlord must return the full amount of the security deposit to the tenant. The termination date of the lease agreement was May 31, 2014. 


According to Florida Statute:

If the landlord fails to give the required notice within the 30-day period, he or she forfeits the right to impose a claim upon the security deposit and may not seek a setoff against the deposit."

I am threatening a small claims lawsuit if Lina Mascio does not comply. She is stealing money from tenants and completely ignoring state law for landlord/tenants.

The problem has been solved. The rest of the deposit check, $387.50 per person, was sent to us.
