On July 12, 2008 I went into New Rochelle Toyota's Sales Dep with the intention of buying a new 2008 Toyota Rav4. After a couple of hours of haggling over the price, I reached an agreement that I was satisfied with. The same day I have signed some preliminary papers, and have given a $2000 deposit in cash - and I supposed to come in on Monday July 14 to pick up the car. To keep this story short, I will not go into detail on how the financial manager tried to trick us into ridiculous financing terms. All in all, after sorting out those problems at the dealer we finally agreed to pick up the car on Tuesday July 15. When we arrived at the dealership we realized that the car they prepared for us was different than what we agreed on - it had over 250 miles on the odometer (it was supposed to be a brand new car) and it had a different interior color. We told them that we wanted a different car, the manager over there said that he could get us one, but we would have to pay an extra $600 for. Of course I didn't agree to that so we had to cancel the whole deal.
My current problems start right here. The manager said that they can not give us our deposit back, as their financial dep was closed. He said that they would write it and send it to us, and that we would get it by Monday July 21. Today is Tuesday July 22, and no check has arrived. They also said that can not write the check at their dealership, they explained that their office in Huntingtion takes care of that, and that they do it only on Thursday's !!!! I phoned the dealership (several times) and finally they explained that something must have happened with that check and that they will write us a new one and send it to us (they also told us to wait another week for it). After experiencing a lot of bad things at that dealership, I have a feeling that they have no intention of writing any check or returning my money back. It has been over 8 days since I've canceled the deal and the only thing I heard since then were unfulfilled promises.

Finally the dealership sent me my check!!!

After calling the dealership one more time this week, I finally received my check. And to give an answer to one of my previous doubts - the DO NOT send checks from Huntington. It came with a post stamp with New Rochelle's zip code - so it appears that it was possible to write a check on spot. Im very satisfied that this ended this way. I beleive that sites like this in some way intimidate companies. Thank You ripp-off-report - sites like yours help the little people like me.

You want a paper trail in these matters.
Some auto dealers are honest and smart businesspeople who know that the long-green is far more rewarding than a fast buck. Maybe this dealer is not so smart.
Next time, use a credit card for your deposit. An honest dealer won't mind while a fast-buck artist will. This is your first screening step.
Then if a problem such as yours should occur, you can file a written chargeback request with the CC bank. Then the CC bank is required by law to investigate & if the dealer has not performed as agreed, the bank gets your (& their) money back. No muss, no fuss.
Of course, you want to have a 'good' credit card bank - or better yet, credit union. Look around here for CC bank complaints to aid your process of elimination.
For now, find out what government agency licenses this dealership & file a complaint there. This step usually produces results.
B/t/w you will not really save anything buying a 2008 now. The instant depreciation will kill you. Go for a 2009.
