I was involved in a car accident on 8/15/2002 I was struck by a someone driving with a suspended license in a rental car - "go figure". I was sideswiped on the driver's side front end, pushed up a curb, head on into a brick wall and then head on with a light pole. You could only imagine what it looked like.

I did not get to see it for 2 days until the body shop, where my attorney sent my car, asked me to get my personal belongings out of the car. When I saw the car I thought it was totaled, the owner of the shop Nelson Gaiton assured me not to worry that my car was in great hands, and his shop does these type of repairs everyday and I will be very happy once they are done. He told me it would be as if I drove it off the lot brand new.

We were worried about what to drive in the meantime and well he let me drive one of his cars, I drove it home with my kids in it and well it kept pulling to the right and almost caused me another wreck. So I called him and my attorney asking what kind of repairs do they do and well they blamed it on the previous driver, so they sent me another car to drive and well this one overheated and the tire blew with my children in it.

I then called and said I would not take anymore of their cars and was not sure about keeping my car with them and he assured me it was fine. We then rented a car from enterprise which he put on his card for 2 weeks and said we would have to pay. That was 800 he took off of the amount the insurance company paid so he had 9200 to repair my car with and another four thousand in an attorney lean so this is nearly $14,000 in repairs.

The body shop had my car from 08-16-02 until 11-27-02 on the 13th of November I got a call from Nelson that the car was ready and we were excited because we nearly had paid out of pocket for another rental car we had. Well when I got there, the car was two different colors, and I saw pieces from under the driver's side door loose and the hood did not look in place correctly, so I told him I am not picking it up until it's complete. Well he went on to say I cannot run from my problems because I was very pissed off and this point.

On the 27th of November I recieved a call from my attorney's office that the car was great and to pick it up. My fiancee and I went to pick it up and he said to have the transmission looked at and so I asked what is wrong I thought you had done all the repairs it needed and he went on to say since it was still under warranty and in a wreck to have it looked at.

I did not want to deal with him anymore so we left and I took it the 29th for a checkup and oil change at saturn since the 28th was a holiday, The engine light was on and so we were worried. I recieved a call an hour later from the service manager at saturn who asked what the heck happened to the car and who did the repairs. The wiring harness was all mickey moused, none of the wiring was in correctly the diagnostic test showed all lights coming on, and the paint on the hood had stripes in it.

Well to make a long story short we have put several thousand of our own money into this car and it has broke down several times. My car is a Saturn L200 2002 so I still make payments and have to rent a car if I need to travel out of town. The car broke down once and the whole a.c. until fell out because it was not put back correctly, when this happened we lost all power and almost wrecked again.

Saturn service manager spoke with Nelson who stated my car was totalled but fixed anyway. I have a written statement from saturn. I have proof against his business and no one to help me. I reported it to the attorney general complaints who transferred it to consumer complaints who transferred my complaint to the dmv and they cannot help me they only issue business license not take them away.

I made a complaint last year with the BBB and they are only a mediator and the response from Pacman auto was that I knew it was totaled and asked to please fix for the money he had. This is a lie. I never knew or I would have just had them total it. It would have saved me a heck of a lot of money and STRESS! They also said they fixed the frame, but I just had that fixed 8 months ago when I was told by my new mechanic to have it checked and it still needs repairs and paint from the accident and it is allready 2004. I hope someone could give advice this would be greatly appreciated. The bad thing is it wasn't even my fault and I'm suffering!
