How to get Rip-off Revenge

I was injured on the job as a truck driver for PFG Food Groups, back in March 2006, and a second time one week later in April of 2006. I had fallen off of a trailer loading ramp, from the trainer's mishandling of products and training.

PFG had their Workers Comp policy through Specialty Risk Services, which whom I filed an accident report as soon as I got to the office. I had fractured my knee in 2 places due to landing flat on my right knee from 5 feet up.

I had gone to the hospital when I returned to my home, and got Xrays done, and I was ordered to stay off for 3 days. PFG along with SRS ordered me to their work doctor, that was paid by SRS to have me return to work asap. The worker's comp doctor flatly refused the hospital orders and ordered me back to work that night, with no time missed for my injury.

One week later, I was injured again, same knee having a 60 pound box of potatoes dropped on it, and spraining knee, lower leg and ankle. Again, the WC doc ordered me back to work, or lose my job. I returned to PFG and said I was not able to do any kind of heavy work, but they said they had no light duty for truck drivers, so I was fired for being unable to do the work.

Since April 2006, I retained an attorney, and SRS was ordered to pay for my injuries to 70% of my wages by the Md. Worker's Compensation Board, but up to now, June of 2007, SRS has still refused to pay, citing I was not hurt, or i missed my treatments, or they had already paid me by cheque. However, SRS would not produce copies of any endorced checks, showing when, where, if, and who cashed them.

The above is impossible, because I lost my home, my belongings, my car, and my family. I did not have a chequing account since 2002, as my wife took care of the bills. After we lost the apartment in Elkton, Md. I was evicted, and sent my wife and daughter back to her parent's home in NC, while I stayed in a men's shelter in Chester County, Pa. until the fall of 2006 when my mother offered me a room. Since then, my knee has gotten far worse, and I am completely disabled, and suffer anxiety and depressive disorders due to 2 mental breakdowns from the stress and pain I am in. Just 2 weeks ago, I had a perscription from my doctor for a knee brace, which they refused to pay for, on top of my perscriptions.

Since then SRS has still refused to co-operate with my attorney to get this settled, but SRS knows they are liable. I will be forced to take them to court and file a 'Bad Faith Claim' against the Hunt Valley, Md. office of SRS, which will cost them not only the 70% of wages i'm owed, but also an additional 20% more for being late with any payments, totaling 90% of my wages since I was hurt in March 2006. And additionally, the 'Bad Faith Claim' can be charged to 300% of my claim, or 3 times what it is worth.

Mary Hodgson and Krystal Harris at SRS knows they are in the wrong, and SRS WILL Pay for how badly they ruined my life. I did not ask to get hurt, I just ask that I was to be compensated fairly for my claim. However, since SRS has resorted to fraud and misrepresation, I will be forced to bring these facts to the Judge and Jury when my case is heard. I have ALL the reports and forms in my posession as well as my attorney.

Let's get an attorney, or DA that can go national with this, for a major malpractice suit against SRS for defrauding hard working workers that got hurt.

Dear Joseph,
I was in an auto accident in Jan 2004. My vehicle hit a patch of ice, smashed into a guard rail. This caused the  pickup to spin around, flipping and landing on the roof. I sustained, dislocated hip, a broken pelvis in three places, five crushed disks, nerve and muscle damage, and a shattered left knee. I am fully disabled and Specialty Risk, said, they would pay me 2 weeks wages, until they find me a job. They have denied, pain medications, a tens unit and visits to a spine specialist. The worst, they stopped my benefits checks, over the years. Approx 3 times a year, for over 6 weeks at a time. What Specialty Risk used to do is, send 4-5 checks in one envelope, 6 weeks later. The worst was, I was never paid, from the beginning of Nov, until Dec 27th. Leaving us with no money over Christmas. This has s****.>

I had a work injury due to employers neg. over 1 year ago. Surgery was earlier this year. The week prior to the surgery I was told what really needed to be done but SRS would only allow him to do a small part of the surgery. The Dr. told me I would "most likely need another surgery but he could not do everything now because SRS would not allow it(pay for it)". It took 8 mons. to get Physical Therapy. The pain increased 100% after the surgery. After 11 months I can barley move around sometimes. I walk with a cain. The current Doctor which SRS sent me to has requested on several occasions to do surgery. An IME doc said the same thing in his reports. I even went as far as to get a third opinion and that doc said the same thing. SRS refuses to allow surgery or any meds I have been prescribed for pain and daily needs. SRS sent me to their doc which did not specialize in my medical condition. He spent less than 15 min. with me and never once addressed the problem. I asked him 5 times why he wasn't checking my problem. He told me he was done and I could leave his office. But he did manage to let me know directly that he doesn't need to practice anymore, he only works for attorneys and insurance companies. Since he said I was less than 15% disabled I could go back to work. This is what SRS is going by. They don't care what anyone said except the doc they paid who doesn't even specialize in my condition. When you break your leg you don't go to a dentist to get it fixed. Get the point?

Meanwhile I am laid up at home in a tremendous amount of pain, taking pain medication until it runs out and I can't afford to buy it on my own and I am unable to work. Heck at this point it's a struggle to keep our home, take care of my 3 children and just pay the basics. This Christmas was the worse I had in my entire life. I felt so bad for my family because I could not play with my kids and their toys. It was a very small Chrismas this year. We have used our entire savings over the past 15 months. Does anyone have any suggestions? I am very dissappointed in my attorney as well.

My Mother was injured at Pactiv Co. in Temple Texas in Dec. of 2005.
They have SRS as their Workers Comp insurance company also and we have been going through the motions of denial for years.
We have been sent to "doctors" in the "network" and "lawyers" that worked for the "doctors" in the "network" and nothing has been done.
The crush injury that occured in 2005 led to chronic pain syndrome that she lives with every day. She is always in pain and swollen. She can't gain employment because of this injury - and I am sick of it all.
