Before, I go into my problem with East Iowa Realty - Broker Chuck Schwager and agent Linda Bailey, I want to begin with a Word to the Wise.  If you want to avoid real estate problems and being deceived, DO NOT use the listing agency as a Dual Agency.  Find your own representation with another realtor.

We made that mistake, and look what happened to us.

We used the listing agent on this Victorian Home in the town of Maquoketa, Iowa.  They were to act as a Dual Agency.  This was back in late January, 2023.  In February, 2023, we paid for a Detailed Home Inspection Report.

and the report came back with many problems.

Now, most real estate contracts are standard, but both the realtor and her broker, wrote up the contract in such a way where it is difficult to get out of the contract due to a bad home inspection report.  They worded it (and you had to look closely at all wording) that the buyer must ask for repairs. Also, that certain conditions, a home inspector might find, are NOT a reason to terminate the contract.

We are older senior citizens, and were quite upset.  We told the agent that we did not want to buy the home.  We had paid the agent a $2,000 earnest money deposit, which she immediately cashed.  Thus, locking us into the deal.

That money should have been deposited with a Title Company or Attorney.

Anyway, the agent said we had to make up a repair list.  We were not happy with this.  We called the Broker, Chuck Schwager to voice our concerns and our desire to get out of the deal and get the $2,000 back.

Chuck Schwager was rude to us.  Said we HAD TO WORK WITH THE AGENT.  REFUSED TO GIVE US OUR MONEY BACK.  THREATHENED US BY SAYING THE SELLERS COULD SUE US.

His actions were certainly not ethical to say the least.

Our home in another state was under contract at the time.  He forced us to take the house by his words above.

We called the East Iowa Association of Realtors and spoke to the director.  Instead of helping or advising us, SHE JUST LAUGHED AT US, AND OFFERED NO HELP AT ALL.

We also tried to call the State of Iowa Professional Licensing Board, which has a Real Estate Division.  We were told, we could file a complaint, but it would take 90 days or so for a review.  We did not have this time and did not want to be homeless after we sold our current home.  They told us to call a private lawyer.

We called several lawyers, but they either had a conflict of interest, or were not interested, or were too busy to help or felt there was not enough money in it for them. One said there was not enough time to build a case and wanted a large retainer which we did not have to give.

Leaving us between a Rock and a Hard Place.

Our of dispair, we did work out some repairs, but not enough to cover some major items.

We paid $262,000 for the home and moved in around April 9, 2023.  We were not happy, but tried to bear up under the circumstances.

However, we were not happy and listed the home again by ourselves as is.  We did finally find some people to buy our home for $ 249,000.  This is a $13,000 loss, plus closing costs.

We move out of state in September, 2023.

The moral of this true story is this.  We are sure many realtors are hard working and honest.  However, there are the "bad apples" out there, whose only interest are GETTING THE SALE COMPLETED AND MAKING A COMMISSION.

East Iowa Realty got 100% of the commission since we made the grave mistake of putting our trust in them.

I guess MONEY TAKES PRECIDENT OVER WHETHER OR NOT A CLIENT IS HAPPY WITH A DEAL.

The Broker, Chuck Schwager, should have intervened in our favor, since it was a dual agency.  However, as we stated before, he threatened us with a LAWSUIT.

And to add insult to injury, the very government agencies, that should have helped us, also failed to do so.

That is not the way to handle real estate transactions.  He should have allowed us to terminate the contract outright and put the home back on the market.  

However, we got stuck, and they did not care.

To those out there looking for a home to buy in any state.  Make sure the realtor or broker you hire, is ethical and will protect your interests as a buyers agent.  If not, you could find yourself in the same position we were, sadly, in.

This is a truthful report, as we have experienced it.  We write this report freely and under the First Ammendment - Freedom of Speech -a right upheld by the US Supreme Court.

Comment Regarding this Review of East Iowa Realty. Seems like the Author wrote up a valid review, so WHY is this RICK person Attacking the Author. Seems like he is Stalking her!!!

I am a newer member to this site.  I joined because I too, was ripped off by a Real Estate Agency in California.  Complaints to the State of California Dept of Real Estate went on for over 1 year with no results.  They claim to have sent my complaint to the Legal Dept of the State, but never heard from them and I was never vindicated  I had planned to write up a report, on this site, describing the problem with Both the Real Estate Agency and the State of California Dept. of Real Estate.

Before doing so, I took a look at other complaints on real estate agents, on this site, to see what most people were complaining about.  I HAPPENED TO LAND UPON A REVIEW BY SOMEONE NAMED "Barbara" who authored a review on East Iowa Realty.

Her report seemed to be truthful and represented her version of events.

I am now SHOCKED, at a person, calling himself RICK, who is constantly attacking this woman!!!

He keeps saying YOU SHOULD BE SUED FOR TRYING TO GET OUT OF A REAL ESTATE CONTRACT AND YOU WOULD HAVE BEEN.  

Exactly, who is this RICK?  Is he the owner of East Iowa Realty?  Is he using a fake name?  Is he an agent for this company?  OR  is he some kind of nut case, who gets joy out of stalking people, who have the courage to write up a report or review on a company which they feel did not serve them well nor provide adequate representation.

Frankly, I am very upset.  This Rip Off Report Website has lots of Rule and Regulations to follow when posting online.

One is to write a truthful report based upon their experience.  Anyone responding should be either  the owner of the company,  or an agent, who can write up their own side of the story.

Consumer Comments are fine as long as they do not attack, or harass, or threaten anyone.

Yet, this Rip Off Report seems to be allowing this Rick to CYBER STALK this person, who wrote the report.

Why is that?  YOU TELL ME.

It seems there is a clear violation of the Site's rules here.  

Anyone, has the right to review a company, and to report a negative experience.  This is especially true when they have gotten no legal help nor help from any Real Estate Board - as I, myself, have not gotten.

I had planned to write up my own report on this California Realty Company and the State Dept of Real Estate, just to get this matter, off my chest, so to speak.

NOW, AFTER SEEING THE OBVIOUS STALKING OF THIS RICK, ON THE AUTHOR, I HAVE SECOND THOUGHTS HERE.

I certainly do not wish to also become a VICTIM of someone, like this RICK, who is most likely, Mentally Disturbed.

If Rick is the owner of East Iowa Realty or an Employee, who is doing this by pretending to be this RICK, then let him or her write up their own version of what happened, in a polite and respectful way.

The Rip Off Report APPEARS to be a good site here to post reviews, but they should not allow this apparant harassment and ILLEGAL STALKING OF ANYONE, WHO WRITES A REVIEW ON ANY COMPANY.

Anyone out there agree with me?

I thought that New Year, 2024 would bring an end to this RICK (OR WHOEVER HE REALLY IS) 

This person calling himself RICK, IS A CLASSIC MORAN AND TRULY BELONGS IN A MENTAL HOSPITAL.  

The Police have been informed.  Doesn't he know that CYBER BULLYING IS A CRIME THAT CAN LAND HIM IN JAIL?

Why would this RICK feel the need to attack me, and my truthful report on East Iowa Realty?  Unless he is really very close to this company.  JUST TELL US YOUR REAL NAME RICK, AND STOP HIDING BEHIND A FALSE NAME.

 

I AM ASKING THIS RIP OFF REPORT SITE TO STOP HIS REBUTTALS FROM COMING THROUGH AND TO BAN HIM FROM HIS CYBER BULLYING ATTEMPTS ON THIS POST.

Again, this site is for 

People who have been ripped off by a business or entity and can voice their story on what happened to them.

All people out there, who also have been ripped off by a company to learn from and share their own experience.

I invite any sensible person or attorney out there, who wants to help me, against this Rick, to respond via this website.  It is RICK, (or whoever he is), who should be sued

 

Just for the record, and everyone else reading all this, A BAD HOME INSPECTION REPORT IS A VALID REASON NOT TO BUY A HOME AND TO GET OUT OF THE CONTRACT.

Yet, the broker of this East River Realty, CHUCK SCHWAGER was extremely rude and nasty to us.  Brokers are supposed to help resolve a problem with a real estate deal, AND NOT THREATEN CLIENTS WITH LAW SUITS.

Yet, this Chuck Schwager did threaten us with a lawsuit and that is not ethical under Iowa Real Estate Law.

HERE IS THE PROOF THAT SUCH THREATS ARE NOT ETHICAL:

I spoke with 2 different real estate agents, from 2 different Iowa Real Estate Agencies, close by.

1.)  The first real estate agent said that YOU DEFINTELY GOT A RAW DEAL WITH EAST IOWA REALTY.  She went onto to say YOU SHOULD HAVE GOTTEN YOUR OWN REPRESENTATION AND NOT SIGNED ANY DUAL AGENCY AGREEMENT.

Finally, she said that IF I WERE REPRESENTING BOTH OF YOU, AND A NEGATIVE INSPECTION REPORT CAME IN, I WOULD HAVE EITHER NEGOTIATED THAT THE SELLERS FIX EVERYTHING OR GOT YOU OUT OF THE DEAL AND YOUR $2,000 REFUNDED.

Now, this woman is a good agent and a credit to the real estate industry.

2.) Another agent that we spoke, in detail, to, was very kind and sympathic to our plight.  She told us  IF I HAD REPRESENTED YOU, EVEN AS A DUAL AGENT, I NEVER WOULD HAVE TRIED TO FORCE YOU TO BUY A HOME WITH A BAD HOME INSPECTION, EVEN IF IT WAS A HOME I LISTED.

She went onto say,  THAT IS NOT WHAT A GOOD AGENT AND BROKER IS ALL ABOUT.  WHAT HAPPENED TO YOU BOTH, WITH EAST IOWA REALTY, GIVES US GOOD AGENTS A BAD NAME.

These, folks out there reading this, clearly show that many real estate agents out there, know the laws of real estate and never would resort to threats of lawsuits just to gain a commission.

Remember, it was NOT the sellers of the home that threatened this lawsuit, IT WAS THE BROKER.!

 I can see why you had a problem with your real estate transaction. You are totally out of your mind. The only one that is getting laughed at is you. Threatening anonymous Internet commenters with police is pretty hilarious. Let us know how it works out with the police, I will be anxiously awaiting the news. And just a tip, the source of many of your problems is staring you in the mirror.

 Your whining is pathetic. And no, none of the people responding to your complaint have anything to do with any real estate firm. Just regular people who are pointing out that you are not blameless here. When you make an offer on a property, that is a LEGALLY BINDING CONTRACT once it is accepted by the other side. I am guessing you waived the inspection contingency and then decided you didn't want the house after you saw the inspection report? Because if your offer had an inspection contingency, you would have been able to withdraw it assuming the seller couldn't resolve the outstanding items. If you don't understand what a contingency or a contract or an offer is, you should have talked to an attorney BEFORE signing anything. That would have avoided the entire situation. If there was some dispute about whether or not your inspection findings were a valid reason to pull your offer, you should have consulted a lawyer BEFORE proceeding with the purchase transaction. Once you signed the closing docs, the deal was done and there is nothing anyone can do for you at this point. And no, the realtor is not your friend . Their business is to sell the house, and that's exactly what they did. The person who needs to look out for your interests is YOU. Also, I am curious what the inspection findings actually were. You seem to think it was something serious, while the realtor thought it was something the seller could easily resolve. What was the actual problem? Because your caginess about that detail sure seems like a case of buyer's remorse rather than a legitimate inspection issue.

Many people are reading your stupid comments and are laughing at you.  You are clearly abusing the right to post on this website.

Doesn't your stupid mind know that this site is for victims of bad businesses who are unethical.  The only way to get their point across, when they have been ripped off.  You are using it for your own personal harassment site.

Do you not know that HARASSMENT online is a criminal offense that can land you in jail and at the end of a lawsuit on you???

I have informed the editor of this site and they know about it now and are also watching it.

I have also printed out copies and have an appointment with the local police tomorrow, who will look at what you have written.

AGAIN, WHY ARE YOU SO COMPELLED BY MY TRUE REPORT ON EAST IOWA REALTY?  WHO ARE YOU IN THIS?  YOU ACT LIKE THIS REPORT WAS ON YOURSELF!  WHAT GIVES WITH YOU?

You must be in real estate yourself otherwise, you would not care.  I guess the almighty commission money is worth more to such agents, as doing their job and being fair to all parties they represent.

Keep it up.  The Police will find you and put you in jail where you belong.

Why don't you identify yourself, Rick.  That is probably not your real name.

What is our problem with East Iowa Realty have to do with you anyway?

Do you work for them?  Are you the owner?  If you are the owner, you could write your own explanation here in a civilized manner, instead of taunts and harrassment.

You are clearly violating the rules of this site.  Your actions will be reported to the site and as harrassment with law enforcement.

Stop the harrassment now.  You should be ashamed of yourself.  I can only hope that something similar happens to you, and you are ripped off and out money.

I guess Flint wants to use this site as a type of War!.

We stand by our report on East Iowa Realty as truthful.

We tried hard to get out of the contract with the bad inspection, but the agent, Linda Bailey, kept telling us that the inspection report was too harsh and that nothing is truly wrong.

I do not know who this Rick or Flint are, or if the names they show are correct, but they should not add insult to injury.

Perhaps they are friends of the Real Estate Agency and personnel.  Who knows.

Our report on East Iowa Realty is a truthful one, exactly the way it happened.

That is all.  Our report stands.  The war of words is over.

We wrote this truthful report on East Iowa Realty based upon our own experiences.

This Rip Off Report Site is one of the LAST TRUE PLACES where one can actually post a negative review on a company that trully deserves the negative review.  Many other sites out there, refuse or "ghost" negative reviews.  I stand by my review on East Iowa Realty.

What happened to us was a example on how some real estate agents out there, are NOT representing their clients. and, to them the ALMIGHTY COMMISSION IS KING.

A bad inspection report IS A GOOD EXCUSE FOR GETTING OUT OF A REAL ESTATE CONTRACT.  Agents and brokers should NOT threaten any type of lawsuit.

We got caught in a trap, and warn others that not all agents and brokers or ethical or repuatable.

I guess this RICK must be a real estate agent.  If so, they do stick up for each other, right or wrong.

Perhaps oneday, Rick might experience a similar situation with a realtor or some other entity, and then he would know what I am speaking of.  This assumes this is his real name.  Who knows.

We do not want to get into any war of words witht his Rick, but just to say, WE STAND BY THIS TRUTHFUL REPORT

You are ABSOLUTELY DEAD WRONG on this stupid notion that all real estate contracts are "standard". Secondly, YOU went into this deal naked. YOU did not have your own attorney representing you. How many papers did you sign at closing? Did YOU READ EVERYONE OF THEM??? Did YOU UND)ERSTAND everyone of them? Buying or selling real estate involves lots of money and it is NOT amateur night! Your real estate agent is NOT your attorney. Their ONLY purpose is to expedite a sale so they can get a commission. The excuse of you are senior citizens is simply that...an excuse. YOU ARE OLD ENOUGH TO KNOW BETTER. When you have/had a bad tooth, you didn't fill it yourself, did you? You went to a professional who does that every day. In this case, there were alot of contractual agreements you agreed to. That's why when you buy or sell real estate you HAVE YOUR OWN ATTORNEY representing you! By the way, if you just can't stand someone who KNOWS MORE THAN YOU, then DONOT POST on a public site!

People like yourself have no business buying real estate.  That's literally the whole point of an earnest money deposit -- to ensure that you follow through with the purchase.  And YOU choose what contingencies to put in.  Most houses have lots of problems, especially if they are close to 100 years old.  You shouldn't be putting in an offer unless you are 100% sure you want to buy the house.  And if you want something trouble-free,  you want to buy a newer house, not a 100 year old Victorian.

And yes, I'm not sure why you would agree to a dual agency.  It's not like it saves you money, the agent just gets to keep both sides of the transaction while doing virtually no work for you.  Hire your own agent, and look at a few dozen properties before picking one.  Real estate is not an impulse purchase kind of business.

You should have talked to a lawyer prior to proceeding with the purchase.  I'm sure you could have just walked away from the $2000 and the seller would not have sued you.  You don't seem to understand that on a $260,000 house the agent makes close to $16k.  They will tell you literally anything in order to close the deal.

Wrong Moral

The real moral is not to sign anything without reading it. You agreed to buy the home, and then you tried to back out. You would deserve to be sued if you did that. Instead of playing age card here, you should have used your years of wisdom to pay much more attention to the property and the contract instead of just jumping straight in.
