FORMAL INVESTIGATION AND LICENSE REVOCATION PETITION.

False & Deceiving Advertising Practices Irresponsible, Unethical Public Deceiving recruiting and employment practices and False employment and contracting offers. Violating the Independent contractor rules and regulations by demanding unpaid clock in time beyond regular business hours like at 6 am as shown in the email attached. Violating labor laws by employing agents as independent contractors and demanding a set check in time of 6:00 AM daily.

Unethical and deceiving Business Practices Unethical False and misleading contracting offers Providing incorrect,fraudulent, unethical, incomplete or materially untrue information about the company and job description and benefits. Proceeded with unauthorized carrier appointment when asked to stop all processes and release any unauthorized and revoked contracting authorizations.

Negligence,abuse and aggravated retaliation and intentionally retaining an unauthorized contracting when he was in breach of all agreements and offers,causing losses that will reach the 1,000.000 and the closing of my business due to losses directly related to their false harmful recruiting practices. Negligent communication and not obeying ethical business and recruiting practices, Both of these individuals cause irreparable losses by choosing to consciously keep me captive despite the fact I asked them not to proceed immediately after they violated our hiring and contractual agreement.

Obtaining or attempting to endanger and destabilize the integrity of the Insurance industry using fraudulent, coercive, dishonest and damaging recruiting practices, or demonstrating incompetence, untrustworthiness or financial irresponsibility in the conduct of business in this state or elsewhere misrepresentation or fraudulent practices Knowingly proceeding with bad faith with contracting and ignoring all calls or answering emails after days and days and months of requesting the release.

Violating Federal laws and regulations in regards to business and public agent’s contractual practices. I ANDREINA URDANETA received a call from Jerrod Hassley he was aware I had already 17 licenses and in good standing and I became a profitable target they assumed, and I was. His corporate presentation was clear, direct and assertive and I believed him. His offer was to pay the 125% I believe, and 15 to 20 appointments per day guaranteed. He was going to immediately start training and start routing calls within a week while waiting for transfer of Carriers. Since you all have licensed these people, I assume they understand the rules and regulations and illegal practices, they have taken a hard test,just like me. I accepted the job and started to work for Jerrod & Gordee. I worked from 6:00 that they demanded I was in training for over a week full time, until I finished one for the health and final expense side.

Clocking in everyday as demanded 6:00 AM until 5 Pm daily. Week 3 comes in and I start asking about the appointments and they never answer any of my emails, texts, calls,it doesn't matter how smooth or demanding I sounded. I quit the company I was working for and accepted this job and three weeks into training when I was supposed to be The third Monday came, I didn't receive any appointments for the entire 3rd week, no one answered, no one texts back. I demanded they stop all transfers and release any transfers that took place as I realized I was hired and I lost my job and all for these two unscrupulous people that should not have a license.

I Lost My job, credit and now I got a new job and they still went ahead and kept me captive even after all the damage they caused and retaliated as I demanded to stop all processes by not releasing me from their questionable agency. I received an email demanding to report daily at 6:00 Am Monday to Friday, and so I did. I complied and took a week for training, showed up on time daily and obeyed their As per the interview and our agreement with these two men who promised me and I trusted in good faith that I was going to work with them with an influx of appointments and leads leading to 15k a month in revenue for me as an Agent. I accepted a job in which I would partner with them and I believed in good faith in their offer. The insurance Industry is an honorable and strictly regulated Industry.

I ask that the Industry regulates the hiring and recruitment processes of these hungry predators and make them responsible for their unfair, dangerous, and deceiving recruiting practices. I ask to please investigate and possibly terminate business licenses as they use the privilege and the name of the company to do business and establish trust that they are not responsible for good intent. The Carrier needs to be aware of the illegal recruiting practices and protect the community appointing people that can hold responsibility towards the community it’s Agents.

I ask for a serious revision and stronger regulations of the Insurance and recruiting industry and issue courses to train agents to understand the importance of professional and responsible hiring practices, as I am a single mom who became unemployed and in the hole for 7 weeks just because I trusted someone you licensed. These two men can and will continue to do this to other single parents unless you stop this and the financial crisis will be suffered by the single parent Agents who worked really hard to be licensed to then be stock in an unfair fraudulent offer by these predators taking the new agents to ruin and a dangerous situation. I ask the above-mentioned units to immediately investigate and suspend their licenses until the investigation ends so they can’t do this to anyone else.

I ask the Internal Revenue service to conduct an investigation and audit as I have reasons to believe this company does not follow laws or regulations. I kindly ask this court to grant an injunction to stop and revoke the operational license until the investigation is over or until the court feels it is appropriate or until, to stop these two from doing business in California and any other state until you speak to other Agents who may no longer be with the company I have reasons to believe they are taking advantage of the public and the hard working people and Ethical Agents who are trusting that they are honoring the privilege of doing business in ways that will not harm the public.

They do not take responsibility for their harming actions to the members of our community they just block you and good luck. These two are abusing the occupational license privileges by violating the business practices without remorse and with intimidation, retaliating behavior I ask the department of Labor to initiate an investigation as I have been treated unfairly and I worked an entire year to be licensed and trained so I could not even have a fair shot in the Industry as this attack left me in a terrible financial crisis. These two men were very clearly aware of my circumstances when accepting the position and I made my conditions clear and I made direct decisions based on this offer that by now represents losses of over $75,000 dollars without counting the money unable to earn due to the unauthorized transfers and captivity.

I with much respect ask the department of labor to kindly investigate the payroll practices and hiring practices. Furthermore, I ask for a full audit as they hired me as a sales representative, they made me an offer of After I left I called the Recruiter who sent all my calls to voicemail, hiding behind the phone, and no one answered any of my messages, truly very used to doing this and obviously worked up until now. They are not answering the demand for explanation, furthermore they have not answered any calls I have placed. The Government is responsible for protecting honorable citizens and to keep law and order by protecting the community it serves. I ask with kindness and respect that every single department here involved by name responds for the best of our community by keeping unethical,fraudulent,deceiving and dangerous companies like this one, from using the license given to them and that they as officers shall remain obedient and respect their fiduciary commitments as they were trusted and licensed by the Government to do business and an honorable company.

The commission payroll practices are deceiving and dangerous. I accepted this job under a false offer and they knew I was going to quit a stable job for this offer they made. REMEDIATION I ask this court to grant a minimum sum of $75,000.00 which will represent the 5.5 months. This company kept me captive. My credit was compromised as I trusted I accepted this false offer that left me unemployed for over 9 weeks and unable to work with American Amicable for almost 6 months when he was asked to stop the appointment because of the breach of agreement, he decided to proceed and retaliate and never release me despite the fact that they were wrong and in breach.

The loans I had to take to survive as he left me without a job and no one did anything at all. Business ethics course and to take again the class for ethical business practices and abide by the law in responsible hiring practices. To hire a professional HR and IC support firm responsible for facing the aftermath responsibly and don't hide behind the phones not taking ownership or caring about the harm done. I ask this court to suspend their personal Insurance licenses as they are not understanding the privilege and responsibility and their fiduciary duties and responsibilities to the public. I ask this court to grant me all court fees ,attorneys fees, and all other expenses incurred and that will be paid due to this fraudulent job offer.

Furthermore I kindly ask this court to grant the maximum compensation and all punitive damages that this court may consider just. I request an investigation for potential Labor Law violations including but not limited to: Over Time moneys owed to past employees and the immediate remediation of such violations with all allowed punitive damages and other fees the court determines fair. I ask for an investigation for discrimination.

I believe I has been a victim of discrimination by nationality,age & gender I believe I was a victim of unfair employment practices and irresponsible hiring practices I ask all Insurance Commissioners of states, Counties, Cities & States where they own licenses to be revoked as well as any Government procurement privileges , vendor access, business licenses,occupational Licenses, Insurance Licenses as they have endangered me as an employee engaging me in misleading and false and unethical sales & marketing practices, considered a violation by the Department of Insurance, the city, the county and State. This fraudulent behavior will cost me my home, my car, and my stability again, and six months later I ask for the release letter and they laughed ignoring the new requests for release as I found a new job and again it will be ruined by them. My little girl has no one else in this world for me and we will both end up homeless and these two men are not willing to help and are not showing any type of remorse.

I ask this court to demand my release as it was unauthorized to proceed after my request and their questionable business practices. As A New Insurance Agent I call the full force of the California Department of Insurance to initiate an immediate investigation in regards to this company who is recruiting newly licensed Agents with ill intent and creating false advertising, false offers and recruiting practices that will leave a professional like me homeless because of this unethical and predatory Recruiting practices.
