 I went to Fredy Kia on December 5, 2016 in search of a vehicle and I was convinced to purchase a 2006 GMC Envoy Denali XL that the salesperson Johnathan stated was in excellent condition with no major issues and all the dash lights were off which was a good sign and it test drove okay so I decided to purchase it buy paying a $900 down payment with a $400 car note.

Before my 1st car payment was due the check engine light came on and I contacted Johnathan who insisted the vehicle had no engine problems and that it just needed a gas cap so I purchased one from Orielly's and once that one didn't work I purchased one directly from Chevrolet; however the check engine light never went back off. I contacted Johnathan again and he stated as long as the check engine light wasn't blinking it was not an engine issue. I purchased new tires and a new spare tire for the truck for $500 because the tires on the vehicle were starting to dry rot. I also paid three car notes totaling $1200. I spent $174.25 for parts for a new radio along with $166.68 for the new radio and $101.73 for headphones for the tv in the car for the kid. I also got the oil changed for $69 at Strickland Chevrolet a couple of days before the truck broke down on me. My uncle a mechanic checked it for me after I left Chevrolet because the lights were still on and it had all the correct amount of fluids in it.

'On Friday, March 24, 2017 I called Johnathan because the truck started making a weird noise while I was waiting at the bus stop for my daughter and the overheating gage appeared to no longer be working. He stated he could set me an appointment for April 27, 2017 at 8am to have a diagnostic test done on the truck which was the earliest appointment he had so I took it, but upon driving home from picking up my kids from school I heard a loud popping noise and it cut off after giving off so much grey smoke that I thought it was on fire. I called Johnathan back and he sent a tow truck to pick up the vehicle and drop the kids and me off at home.

On Monday I went to the dealership to sign paperwork for the diagnostic testing and advised him that they sold me a lemon because I've only had the vehicle for three months and I've kept up with the maintenance and barely driven the vehicle because I've been on bed rest since I purchased the vehicle due to my high risk pregnancy because of my chronic hypertension and my heart condition called cardiomyopathy so I only drive to take the kids to and from school. He assured me the vehicle wasn't a lemon and they would repair it. I called a couple of days later and Johnathan advised me that the truck needed a new engine and it was ordered from California and would be in on Wednesday April 26, 2017 and they would repair the vehicle.

I contacted Johnathan on Wednesday April 26, 2017 to check the status of the vehicle and he informed me that the vehicle was ready, but the repairs cost $2995 and in order to get the vehicle back I need to pay $400 for the April car note along with $750 towards the repairs and they'll setup a payment plan at $50 a month that will be added to my car note until the balance of the repairs are paid off. So basically they sold me a lemon that I already spent $3111.66 on and now they want me to pay them an additional $3000 for repairs for a lemon they clearly knew had engine issues stating the vehicle was sold as is which by law implies that the vehicle will be in working order not that it will breakdown in 3 months after the purchase and they also want me to continue to pay my $400 monthly car note. This place Fredy Kia is a rip off and no one should shop there for anything used!!!!

Lemons

 There is no lemon law for used vehicles. You should have had it inspected by a mechanic prior to purchase. Then they could have told you if the engine codes were just reset. Although there is really no need. A GM vehicle from 2006 is a lemon pretty much by definition. Only Japanese cars can get to this age without major failures (most of the time, anyway). It also sounds like you were driving it while it was overheating and basically ignored the warning lights. In any case, you bought it, so it's your problem now. I'm also not sure how much you paid for the d**n thing, but I doubt it's worth even making loan payments on. A nearly 20 year old GM vehicle isn't worth more than $2000 or so.

Most used car purchases are as-is sales with no warranty. It is your fault for not getting it checked by a mechanic.
