Maui Police Department Assault

Seeking lawsuit against Police department and neighbor (ex-police officer), using federal funds for harassment. This morning (Monday, July 11, at 5am, I was awoken by a flashlight coming from the entrance to my property, which is 100 yards from entrance, with a 30ft locked gate, end of dirt road into jungle. - video of officer was recorded - 2 911 calls over 2 minutes - Previous police reports unanswered Fake cops/neighbors have attacked me twice in past, so I ran into jungle during storm for 2 hours until I had cell reception.

Called 911 eight times, and had two lengthy calls with officers. The 911 officer claim there was a noise compliant (6:40 call, today), and they have the right to jump my gate, run into my property 100 yards, and awake me with light at 5am. I repeatedly asked if there was an arrest warrant, which they said no, but can issue one anytime.

On Saturday, June 27th, 2020 at 3pm, I was walking from Haneohi Stream, adjacent/next to his property.   The ocean and creek bed are natural land, but I crossed 85 feet of land claimed to be owned by past relatives by Mel, who lives next to Hart Cunningham (me).  I rarely leave my property, but once a month will visit the ocean directly under his old conservation land of 2.2 acres. 

Hart was walking his dogs and goats up to his house from public stream, when Mel and 3 other men aggressively start following Hart from the ocean up hill to Hart’s house.  Hart was on public stream unarmed.  Mel was carrying a handgun and 4 foot garden knife.

Lester, who repeatedly stated he was a retired Maui police captain, living at 186 door of faith, was carrying a machete and handgun.  Two other men from Honolulu, were carrying machetes and knives.  The four men ran towards me from behind, surprising him, with machetes and handguns.  Hart started to run away, when realizing he needed to protect his dogs, as the 4 men were drunk, armed, while Mel is known for killing his own dogs during hunting. 

Lester approached Hart from behind, while Hart was defending himself from Mel pushing him.  Lester aggressively motioned his machete at Hart, knocking Hart against tree and boulder. Lester begins taking video of Hart, then turning off his camera, explaining to Hart how they’ll will make Hart "disappear” and he "runs the police department”.  Hart panicks in fear, avoids their third attack and scales the hill to his property, immediately calling police. 

Officer Chang arrived at Hart’s property, took down all relevant info, reviewed Hart’s injuries with fellow officer.  Lester had called police before Chang arrived, which prevented arrest for the assault against Hart.  Report number / 20-022661 officer Chang, 6/27, Assault (type of incident) Hart went into Maui police at 8:18am on Monday, June 29th at 55 mahalani street, Wailuku, HI 96793 808 244 6355 (can be used to order police report) to make formal complaint about Lester,  retired officer assaulting targeting, threatening and assaulting. 

They stated they were unaware of him, and would not take down the report.  Hart then went to the hospital to have formal review of his left oblique from the assault.  He did not check in due to precautions related to Covid, moving to an online doctor reference and finally family friend over telehealth call. 

Hart suffered bruising on left thumb,cuts along his left side, and bruised right leg.    I am seeking TRO, lawsuit filed outside of Maui, and letters sent to police captains. Hart Pearson Sebastian Cunningham Enroll.com HPSC.LAW
