The Collision

On November 18, 2019 I had occasion to be involved in a collision with another vehicle. I had just made a left turn onto the S/B ramp of the SR‑51 Piestewa Freeway; I was in the left (main) lane of the ramp. Further down the ramp I happened to look in my rear view mirror and observed a black car coming on strong in the right lane.

As I approached the “Wedge” where both lanes come together, I wondered where the driver was going to go. The black car continued its excessive speed and came up along side of my van and bumped into it. We both pulled over and I called DPS.

I was instructed to drive to the Officer’s location where a report could be taken and offered my side of the story. When the driver of the black car exited her vehicle, she was dressed all in black, with a black jacket, including high black boots. I thought to myself, she’s a dominatrix; the only thing missing was a whip.

I told the Officer what happened and the Officer told me that she said that you were accelerating. Of course I was accelerating. I was attempting gain access to the freeway where people are doing upwards of 70 mph.





The officer looked at my van and was struck by the fact that there was absolutely no damage to my van; and so was I. Her car had a busted mirror and a long scrape above the bulge on her door. It just didn’t match. My suspicions were aroused.

I told the Officer that she disobeyed a merge sign posted at the beginning of the ramp. She continued in the right lane for another 1,600 feet into the “Wedge” and deliberately contacted my van on the passenger side. I told him, all we did was bump together; we did not scrape.

Since there was no damage to my van and the collision itself was so minor, I called State Farm and described the details leading to the collision. State Farm told me that they would deny her claim.





I called the Officer the next day to get the court date for her citation. The Officer told me that he didn’t write her a ticket. When I asked why, the Officer told me that he had discretionary power and didn’t think it merited a ticket. He did however cite Ms. Lazaro as the striking vehicle in the accident report.

Two years later, just days before the statute of limitations would run out, I was served with a summons for that same incident. The Plaintiff (Virgen Lazaro) was claiming extensive property damages and serious bodily injuries.

I was contacted by State Farm and told that they would assign an attorney by the name of Hollee Duddleston to my case. When the attorney presented me with pictures of Ms. Lazaro’s black car, it was clearly evident that the damage on her car did not come from my van. This evidence along with the excessive speed on the ramp coupled with long wait before claiming damages was revealing. She is a little con artist

Ms. Lazaro is guilty of:

1)   Lying to Police

2)   Filing a False Official Traffic Report

3)   Filing a False Official Complaint

4)   Disobeying a Traffic Control Device

5)   Failure to Merge

6)   Passing on the Right

7)   Reckless Endangerment

8)   Reckless Driving

Ms. Lazaro’s mental stability constitutes a real and imminent threat to all motorists and her license to operate a motor vehicle in Arizona should be revoked. She is unfit to operate a motor vehicle.

 

DPS Corruption

The next day I went to DPS Headquarters and filed an Internal Investigation Complaint against all of the Officers involved.

1)  Official Misconduct

2)  Official False/Misleading Statements

3)  Deliberate Non-Performance

The response:

"there was a lack of supporting evidence and probable cause"  to cite her or to issue a warrant for her arrest.

Then too, DPS Director Frank Milstead was flying down Interstate 17 at almost 100 mph (criminal speeding) and weaving through traffic without using turn signals before being pulled over by a Yavapai Sheriff's Deputy. He flipped his badge and got off scot free. Governor Ducey’s response was "Even good guys make mistakes."

That should be very comforting to those “Civilian Good People” who were cited, paid fines and even went to jail for speeding.

 

The Governor’s Office (more corruption)

I called the Governor's Office to investigate why, several serious ARS Violations can be committed leading to a collision with extensive damage and extreme injuries can take place, and the Official stance of the DPS and all the Officers involved is...  "there was a lack of supporting evidence and probable cause"  to cite her or to issue a warrant for her arrest.

No response.

State Farm (corruption)

I have repeatedly requested that both vehicles be brought together to plainly show that the damage on Ms. Lazaro’s car was not the result of our collision. So far State Farm has refused this request.

I get emails from Attorney Hollee Duddleston that she will call me to discuss photographs and she never calls me. She is a liar.

State Farm Claims Handler Terry Hutson finally returned my call and I sent her pictures of my van and Ms. Lazaro’s car. It is clearly evident from the photographs that the damage was not caused by me. I asked her to call me when she got the email. She never did. Another liar.

I called, do nothing, Michael L. Tipsord the CEO of State Farm to get some closure on this thing since it’s been going on for 5 MONTHS. I spoke with Jaquay, the receptionist and she refused to put my call through; and nothing ever became of my call.

Now after spending hours upon hours to complete a disclosure statement, which I had to correct, I find out that State Farm now wants to abandon the disclosure statement, avoid a trial, make me complicit and pay Ms. Lazaro’s damages calling it “Hush Money”. This is the most egregious departure from logic and common sense I have ever witnessed.

I told Terry Hutson that if she approved “Hush Money” to Ms. Lazaro, I would litigate for defamation of character, since that would make me complicit in the collision. I would add her to a BBB Complaint and also Rip Off report

 

The real story.

1)  Ms. Lazaro had an agenda.

2) There was extensive damage already present on the driver's side of her vehicle from a previous collision.

3) The collision was deliberate in its design. In order for her to pin it on me, she would have to contact the passenger side of my van and leave an equal amount of damage to my van; but she didn’t.

4) She was absolutely in earnest. This easily explains her desperation to ignore traffic laws, posted signage and excessive speed in order to make contact with my van.

5) Unfortunately, she wasn't as skillful as she thought she was. The contact was so slight that there wasn't so much as a scratch on my van.

6) A Railroad Crossing produces more action than what was experienced during our contact.

6) Ms. Lazaro still went ahead and filed a false Traffic Accident Report and lied to the reporting DPS Officer out of greed, hoping for a sizable settlement.

7) As most people with illegal intentions, they don't think it through and the plan usually doesn't equate with the action taken.

8) That's why they get caught.
