This complaint concerns crimes against disabled elders and dependent adults with disabilities. ELDER ABUSE CODE: California Penal Code 368 PC defines the crime of elder abuse as inflicting physical or emotional abuse, neglect, or financial exploitation upon a victim who is 65 years of age or older. The offense can be prosecuted as a misdemeanor or a felony, and is punishable by up to 4 years of jail or prison.

We’ve been residents of Robinhood Point in the city of Chula Vista California for 34 yrs now, and we have NEVER had any problems until recently we have been harassed by this HOA and my wife and I would like to be left alone from this HOA harassment and discrimination.

Because I complained to the Robinhood Point Association HOA, about a wrongful [ SEE EXHIBIT A ] accusation, Attorney Tim Flanagan sent me a letter with illegal progressive charges which now amounts to $4,965.77 (Originally they had that amount over $5,400). [ SEE EXHIBIT B ] Paid in full November 29, 2021 and I had to use my savings which I do not have much. I am retired and living off social security. 

I am a disabled, 89 year old my wife is 84 years old honorably discharged Korean War veteran, with few resources to fight this criminal organization. My daughter has also been harassed via social media and had her NextDoor.com account disabled by the head of the HOA Sherry Barton. This criminal organization consists of:

Attorney/Collection Agency Tim Flanagan is ABUSIVE, DISHONEST and most of all making wrong assumptions on the Guest Parking vs Resident Parking

Attorney/Collection Agency Tim Flanagan MUST be disciplined by the California State Bar for illegal procedures and disciplined to the full extent of the governing laws. Your Honor, we ask that Attorney/Collection Agency Tim Flanagan return my $4,965.77 plus interest and due to the harassment and elder abuse/PTSD we please ask to break from this harassing Robinhood Point HOA and NEVER have to pay their monthly due again. We have always maintained to the rules. We have our own gardener and we can pay our own water.
