TLC Business Group Tonia Mitchell Tonia Cunningham 9 contractors performed services refuses to pay Aurora Co

Hi,     We are a small local home service company. On February 5, 2020 we started working for TLC Business Group on a home the Owner Tonia Cunningham owes in Aurora. She hired us to paint her home and put in new flooring total job was $5816, we charged her $1560 deposit to purchase all the supplies needed on her project.   

During the course of 17 days we had 9 total contractors out on her job working. She refused to allow teams to work in the home together sending people home 4 days at a time, didn’t have the supplies she needed to supply ready and still some supplies like hinges for the kitchen cabinets never came in. Our contract ended on February 22, 2020 on that day she refused to allow the painter to finish sent him home because the flooring people were still working.

We ended up after having our attorney send her letter going back out on March 14, 2020 to finish the painting.    She absolutely refuses to pay her remaining balance. She owes $4626.41 after being accessed late fees, she shook hands with each contractor promising she would pay if they finished the job. Now she has gone around telling each contractor that we refuse to pay them. The deposit she paid covered all materials on her job and we have $183 in trust however that is not enough to pay any of the contractors who worked in the job.

It’s now been 34 days and we have filed a mechanic’s lien on her property the 10 day wait period is up on Sunday.  I have called, sent letters, sent numerous emails and she refuses to pay in any way. After doing a ton of research I have found we are not the only ones she has done this to. She is having smaller companies come out or individuals to do work for her for free. All 9 contractors are now out of work and needing their money from the work they’ve done.
