 one and one half months ago i joined BLAST fitness in fresno, Ca.

Neither my husband, nor I, can lift weights per our doctors orders. We joined BLAST so that we could use the pool, the dry sauna, the steam room and my husband could use the hot tub available in the mens room.  there is only one club in Fresno, Ca. with all those amenities so we went there and explained our situation. We found some things in disrepair such as half the ladies showers didn't work and the hot tub was broken.  They said those things would be fixed soon.  After a few visits and the ladies  bathroom always was filthy and smelly. we tried to cancel then but was reassured those things would be fixed. we made it loud and clear these were the only reasons we joined. since then, the pool was broken and closed  until further notice, the steam room was always dirty, the hot tub and showers were still broken. Everything we joined to do is now non operational.  Further, we took the membership where you can always bring a guest but found out later (not stated on the website) the guest can only use weights, they cannot go to class or swim in the pool.  We tried contacting head quarters and they looked into it and there was a cross blaming of the company always blaming corporate and corporate always blaming the club.  We decided we had enough as they were  not supplying the very amenities we joined to get which made them  in breach of contract for selling amenities that cannot be used.  We cancelled at the club location and was told they could not accept our cancellation without a manager present.  they can sell memberships without a manager but not cancel. we were told to contact ABC financial. ABC Financial said that we needed thirty days notice and that the yearly membership was due during that time so the only way they could let us out of the contract is if we paid the yearly due.  We have gone back and forth with them.  I say why should i pay for services not given.  Then i tell the THEY have two choices, freeze our account until they fixed everything or cancel without the annual charge because why should i pay for services i didn't receive? they are in breach of contract.
They reply that it is too late to freeze the account because i already cancelled (i some how didn't get the email where they explained that was an option) and there are no take backs. they say irregardless that everything is broken we still have to pay them.  then i say, "i i went into a hamburger joint and ordered a hamburger they advertised but they said they were out of hamburgers and presented me a bill would i have to pay it?"  then i tell them again, "no but you failed to provide services you sold so either freeze our account or just cancel without further charges because why should we pay for what we didn't get."  here is the latest answer from them

" The club Rate lock fee of $49.99 is due on 9/15 of each year. All members are required to pay this fee as it is stated on your agreement. Per the terms of your agreement, you must provide a 30 day written notice to cancel your agreement . I apologize, but we are unable to waive your final payment".

They won't freeze my account until the amenities are fixed and it doesn't matter that i didn't get the email about being able to freeze it.  I called the club today and the hot tub is still broken, the pool is open but the heater is still broken...but at least it is open, the ladies showers are still broken and they say they are not planning on fixing the broken showers for a while.  i went in not long ago and the bathrooms were still filthy but none of that matters.  yes, we agreed to pay the club lock fee of $ 49.99 but that was contingent on them supply the goods they sold.  they didn't supply them but they refuse to make it right in any way.  they won't allow us to keep the membership but freeze it until they do what they said, they won't waive the fee even though they didn't give us the goods.  I just don't understand.  i would love the membership as it was sold but it is like bait and switch.

I would love for them to be fair and let's do lunch. i really feel perhaps their account managers are only trained to a certain point and have no reasoning skills or something.

 For weeks i have been going back and forth with ABC financial trying to make them understand the problem and come to a reasonable conclusion; fix the problems or cancel the membership without penalty. 

I finally reached out to ripoffreport.com and i guess my message reached upper management because today i received a letter from an offline processor who seem to understand exactly my delimna and is willing to work with me.  They are allowing me to freeze the account until the amenities are fixed. We are going to try just one month at first.  All dues will be paid when i start the account again.

The gentleman was very kind so we will see what happens now. Thank you ripoffreport.com for helping the little guy.
