The following is in reference to the illegal towing incident at the Denny's Store location # 6438 3002 East Pioneer Parkway in Arlington Texas on Sunday Morning August 26, 2007 1:45am by your contracted company A&E Towing.

While patronizing your Arlington location Denny's location my BMW 525i was towed from that location by A&E Towing Company for parking in the parking lot for no known reason, regulation, or violation to an undisclosed location.

After I walked out and discovered that my vehicle had been towed, without my knowledge, I was informed that anyone going to Crystal's Nightclub 3008 East Pioneer Parkway across the parking lot would have their vehicle towed.

Clearly, this is an unfair and deceptive practice which did not and does not apply to me as I do not go to nightclubs and sat inside the restaurant which was witness by Texas Department of Public Safety Officer who was on armed duty at the time.


In addition to the illegal towing that your authorized contracted company conducted at this location, I also have to inform you that inside my vehicle was my semi-automatic Sig-Sauer firearm which I am licensed to carry.

Apparently, the spotter for your authorized towing company "profiled the wrong individual with the absolute wrong intent as all well dressed individuals should not be assumed to be attending a nightclub while conducting a tow for profit scam from your establishment's parking lot.

I have photographs of the road conditions of the area from where my vehicle was towed from by the towing company which consists of 1 to 2 foot potholes and broken pieces of pavements. At this particular time I do know the route, speed, or road conditions to the undisclosed location however my vehicle sustained damages in this illegal process.

This particular Denny's is across from a dilapidated abandoned strip mall where the roads are no longer maintained and my vehicle was dragged using an unauthorized rear two wheel lift and using this same method was returned to the Denny's location over obviously unknown conditions.

I have very seldom, if ever, had to tow my vehicle as the quality of a BMW product clearly speaks for itself, however, a flat bed trailer was used as legitimate towing companies and dealerships recommend.

I have attempted to contact A&E Towing on Sunday August 26, 2007 at 2:30pm and spoke with a irate female manager who identified herself from the company who acknowledges the towing contract but denies any liability or wrongdoings.


As a result of this deceptive practice, I have suffered damage to the amount of $ 2,367.00 in damage to my vehicle as outlined in the estimate.

Look up Texas Department of Licensing and Regulation

Texas has strict towing laws in effect for non consent tows.  I suggest you look on the Texas Department of Licensing and Regulation website for details.  If you can prove a law was broken, file a complaint against the company on that website.  If they are indeed in violation of any laws, they will be fined and you can pursue your case in civil court. 

If you have your receipt for the meal you were eating at the time of the tow, (ie. proof that you were a patron of Denny's and not using their parking lot for other venues) sue them for the cost of the tow and damages to the vehicle. 

There are predatory towing companies "in cahoots" with businesses around Texas that tow vehicles and receive kickbacks.  I am in no way accusing Dennys or the towing company of any wrongdoing, I am stating it has become a huge problem in some areas.  These companies rely on the average consumer to not know the laws in place to protect them against predatory towing companies, impound lots, and business owners.  I urge everyone to go to the Texas Department of Licensing and Regulation website and read the laws about non consent tows.  Believe it or not, you have more rights if your vehicle was towed without your permission than if you called the wrecker to have it moved.  Good luck to you.

In reference to the reported illegal towing incident at Denny's in Arlington, the allegation is false due to the following reasons.

1. The act of towing the vehicle is not illegal, as we have a contract with the Denny's restaurant to remove any unauthorized vehicles that are parked in the parking lot and whose owners are not eating at the restaurant. As well, every vehicle towed is reported to the city's police department in which it is towed.

2. The driver of the BMW 525i who reported this incident was seen walking into Crystal's nightclub after parking his vehicle at the Denny's restaurant.  

3. As far as the damages reported, we filed a claim with our insurance company in which they denied. According to the insurance company, the damages were previously done to the vehicle in question after an inspection of a licensed adjuster.
