Overtime suit targets Career Education Corp.

Already burdened with ongoing lawsuits, investigations and an upcoming proxy fight, Career Education Corp. faces the prospect of temporary workers suing for overtime abuse.

Notices went out last week from the Chicago law firm of Robin Potter & Assoc. to 800 former temporary admissions advisers at the Hoffman Estates-based for-profit education chain asking if they want to be part of a legal action alleging that overtime was not properly paid at American InterContinental University, an online subsidiary of Career Education.

"In 30 years, I've never seen such vast violations," said Potter, whose firm is also attempting to sue on behalf of full-time advisers, who worked at offices in Hoffman Estates, Schaumburg and Downers Grove.

Career Education denies the charges, spokeswoman Lynne Baker said, adding that previous attempts at class action suits on overtime issues have failed. And this legal action, she said, is similar but not the same as a class action suit. Plaintiffs have to opt in.

Potter's suit claims a variety of tactics were used to deny admission advisers at call centers, fielding calls from around the country, from collecting earned overtime.

Despite Ms. Baker's comments, this lawsuit is going forward. The judge on the case is sick and tired of the excuses CEC keeps throwing at them. The accusations made about the admission advisors by the defendants are ridiculous and without merit.

One way or the other, CEC will be "paying up" what they rightfully owe. CEC has attempted to manipulate the situation far too long with overpriced lawyers and intimidation to the members of the suit, and its a waste of time. If you're reading this CEC - no one is intimidated by you anymore.

On another note, its is really good to see the government coming down on these idiots. They have been out of control far too long. When everything is finally revealed about this company, I sincerely hope that CEC loses it's regional accredidation.

I applaud the federal government for taking the steps to regulate CEC, and urge everyone (students and employees) to write a letter to your congressional representative about what you have experienced. Your documented experiences are about the only thing that is going to take this company down.
