Allen Sports Catastrophic failure of Allen Sport Bike rack caused damage to my car Portsmouth New Hampshire

On 9/15/18 while transporting bikes using an Allen Sport MT-1 bike rack, unbeknownst to me, one of the "rubber feet" used to cushion the rack came off, causing damage to my car. When I discovered the damage to my vehicle I was miles from home and had no other way to transport the bikes back other than to try a makeshift repair. Unfortunately, before I got home the other "rubber foot" also suffered a malfunction and came off causing more damage. Allen Sports response was, "There is a warning in our user manual that instructs not to use the carrier if a part is damage, missing or worn." And the "damage done to the vehicle would not be covered by our warranty, as the carrier was used knowingly without the proper padding.” OK, however their rack failed while I was driving, and initially I had no way of knowing I was using the carrier without proper padding. I contend they are liable for the damage that occurred when the first "rubber foot" came off. I also contend the initial failure of the rack caused all the damage that ensued.
