America Servicing Company Refused to allow a short sale for the property although had all the papers fax to them. They prefer to foreclose Des Moines Iowa

My loan was sold to ASC from Option one and when I fell behind in payments, because it was an investment property and tenants refused to pay rent. I called ASC and ask if I get approval to do a short sale, they told me to send in all the necessary papers to get a short sale approval which I gathered, because I had a buyer.

Together with my realty agent and myself we faxed the papers four times and overnight them three times I have the receipt to show, but each time I called to check if they receive my paperwork, I get an agent who says they still missing the net sheet. I refaxed the net sheet and couple days after called to find out if they received it, they told me they missing the MLS listing.

I had my realty agent refaxed the MLS listing after a few days I decided to call to find out the status on my file they said it was closed because they didn't received everthing on time and to resend them. I decided to overnight the package and called the next day to find out if they received it the employee told me that it wll take between 30-45 days, before it can get an approval. This is two weeks before the foreclosure date on 31 May.

I was told that they can cancel the forclosure if they happen to get to my file before. As time went by I called the next day to find out how things going with my file and spoke to THERESA who told me the send the package overnight again because the case is close and have to start from the beginning. I again rushed to the post office an overnight the package.

when i called a few days later I spoke with a gentleman who told me that the netsheet is still missing, at this time my anger was building up with this ccompany, so I hanged up the phone and decided to call back later and spoke with a gentleman who told me that they received all the paperwork and they will forward my file to the appropriate person for the short sale approval.

After a few days I decided to call and asked for Theresa, who asked me to overnight the package, I was told that she is on another line and the person who answer the phone was willing to help me. I pleaded mny case to this lady and was told my file was no where to be found and I can resubmitt it to start the short sale approval. As a believer and being run around I thought they were willing to help me but miscommunication in the office is slack.

I overnigh my package for a third time I never heard anything from ASC, but received a letter from their attorney that the house is going forward for foreclosure and there is nothing they can do. I had a substantial offer for the house and the buyer was motivated and ready to go, but ASC is not in the business to help anyone all they want to do is make money both ways and screw consumers up with their credit.

I will not stop here I'm investigating to see if I can get the FTC invole to stop this company from it's fraudalent behavior. I think the employees are to blame because they're getting pay to handle cases of what they're doing. Until one person from the company get mistreated or booted we would not hear the truth behind the management profile of what they asked of the employees to handle consumers in such a bad and miserable way to get their pockets fill. I will try my best to pursue a case against these people.
