Ok, so here is a continuation of my story:

I have read Rachel's reports and know all the h**l that she and her family have been through in the past couple of months.

We have ONLY 7 payments with them, but supposedly, they have charged off our acct. Yes, we got behind, but then again, hubby only makes $380 a week and sometimes, if they have a day off, he doesn't get paid. Unfortunately, during the holidays a few weeks were only $275 and that stinks! So, long story short, they have sent me a "letter" on a xeroxed piece of paper saying that I have 10 days to surrender the car to the repo guy who by the way, drives one of 3 plain trucks: a shiny maroon one, a bright sapphire blue one, and an old dingy beige one. We have seen them all..LOL. And they don't have any writing on them. I mean, would you call a company who isn't even listed anywhere in the phone book? How professional is that? So, today, I have to pick up my hubby from work and the kids are home. My son thought that the guy at the door was my daughter's friend so he answered and there was the big, burly repo man with a copy of this xeroxed letter off of a fax machine..(It was sent to them on 1/19 and it takes them 5 days to come by with a copy of it like it is a legal document.) Anyhow, he told my son "Give this to your parents. It is very important. Tell them that they need to forfeit your car of else they are going to sue them." Well, until I see a legal court document telling me to surrender my car, I am not going to do so! We owe roughly $2900 total, but mind you that $700 of it is their late fees which we have tried to have removed, but with no luck!

My hubby is waiting to possibly start a new job in a few weeks, and we have been told by a non-profit organization (I won't mention their name...not my place to and no one's business to know anyhow..LOL.) This organization has said that if my hubby starts making more money so that we can pay back a loan, they will give us a loan to pay off our car loan so that these leeches from h**l will get off of our backs!

They have harassed us from day one! They called one of our friends until she threatened to sue them! They threatened once to rip off the garage door and take the car...A letter to BBB and the Attorney General for the state got one guy in a lot of trouble. They have screamed into my answering machine. One Sunday, they sat on the side of my neighbor's house ALL DAY long!! She told me "I bet they know when you go to the bathroom!" H**l, they knew everything else that we did...They even told me that they knew who owned the house and that they would call them in Virginia to tell them about us and the car. I told them that was nobody's business, but our own! They have pounded on our door until after 10 pm which is illegal. They called us one night until nearly 11 pm which is also illegal. I mean what does it take?

Rachel, thank you so much for your posts. I am trying to understand what to do and what not to do. I understand that they can't just hand you a cheesy xeroxed copy of a "letter" and expect you to fork over a car that is almost paid off! Please let me have your opinion....I appreciate all of your advice about these jerks. You have helped a lot of us and I wish y'all all the best!

Thanks so much Rachel for posting again...

Well, I haven't heard from them or seen anything in over a week.

Here is my update:

My husband was just offered a job which he will begin next Monday. He was working temporarily and now, he has been offered a position at another office with the county. We were told that if he were to make more money then, a non-profit military organization would give us a loan to pay off thes jerks. So, I am waiting for him to bring home his paperwork so that I can make an appointment to see about getting this loan and maybe getting these monkeys off of our backs.

First of all, I haven't received anything else in the mail nor have they called us anymore.

My car is still out in my garage...Just sitting there..Noone has repoed it and I don't think that they should being that only 7 payments are owed on it! I would really like to settle things with them and get this crap over with once and for all!

Being that we are military too (hubby is retired), they can't legally take it with the base sticker on it either and I think that they are aware of that.

I have dealt with this Repo man before and he has even said that they are a dirty business. If so, then why does he lower himself to do dirty work for them? He has even said "I feel for you. They are a dirty bunch of people." Well, can't you refuse to do work for them or not?..LOL. It just makes him look like an idiot by trying to tow cars for them! He is a really big guy and has three tow trucks that he uses. Yes, I know what all three of them look like. It depends on what is available, I guess. They even had a lady follow me into the grocery store and then, she followed me out, jumped into her car and about 30 mins. later, they were knocking on my door. This was a couple of months or so ago.

I don't know how to settle this properly. I guess that I call them and then, hold my breath? Or would I send them a check and hope that they post it to my account or what? I know that there is a guy in a nearby town who has to give the ok for them to take it and he told me that as long as it shows that we have been making an effort to pay it, then he won't issue an order. I have seen no court documents just the xeroxed piece of paper and the repo guy brought the xeroxed copy and handed it to my son. Real professional! My son said "Mom, he had a whole big stack of those letters too!" I bet he did...He was out on a "Repo Frenzy"...LOL.

Thanks for all of your suggestions and help...I appreciate your thoughts and ideas...I really want to pay the darn thing off and get on with my life!

I have read your posts also and nothing surprises myself or my husband about Americredit. I can assure you that the cheesy copy is not Legal by our terms, but Americredit has their own set of loanshark rules. We have requested since November, a copy of our contract, since ours was stolen out of our vehicle along with my social security card and other things. Well all our requests have been ignored as usual and after several attempts to the BBB, we still have not been sent a copy. So, finally we went to the dealership and they keep copies back so many years, so we were able to obtain one. Each state has different rules and in North Carolina, it is supposedly governed by your contract. The verdict is still out on that one , but I will let you know when I get a straight answer.

We didnt have the problem with any repo lowlifes until after the incident. We were sent nothing by Americredit until six days after our vehicle was taken. Arrangements had been made to pay this vehicle off with an upcoming settlement due to me from an automobile accident. And of course the rest is history.

My husband sends emails, certified letters and all are ignored. We had to find out some of our info from the BBB, because the Americredit liars will tell you nothing. We are having to be very patient with our case because it involves the Repo Company, the Adesa Auction, and Americredit all three. But, the ball goes right back to Americredit because they started the mess when they illegally put our car in charge-off while my husband was deployed. Since we paid the Repo Company to get our belongings back and some were stolen or lost... as they say......... we have to go through the proper channels with this. Americredit is not going to use any upstanding moral company, because they are not upstanding.
They operate like Loansharks and that is exactly what they are. They use the lowest form of Repo companies because birds of a feather flock together.

There are commercials on television right now telling consumers not to use Western Union to send in any payments to Businesses. IT also says that any upstanding company would not ask you to. So, I rest my case. Even the media knows what lowlifes Americredit are. What is the first thing Americredit will ask you to do to expedite a payment? They want you to use Western Union and then charge you 40 dollars to do it.

Now, Americredit is charging us for the repo fee and also for selling the vehicle at the auction.
We were never offered any form of settlement to get the car back, but the liars are telling the BBB that we were, but that is far from the truth.
They have made several inquiries into my husbands credit report and it just verifies to us what liars they are. We hope they continue to do this stupid and illegal stuff, because it just helps our case.

They cant touch my credit report because I have a fraud alert on mine and have them as the responsible party. Them ,along with their sidekick repo guy and their auction buddies.
I still have the ashtray that was thrown in the garbage bag with my personal property , minus a pair of earrings. Guess the professional crooks were in too big of a hurry to put the ashtray back in the car after they stole the earrings.
Then, there were two CD's that were in the car that the auction guy found and they were not even mine. I told him to send them to me for evidence and you know what he did, he threw them in the trash can. I am sure Americredit told him to. Typical of crooks. He called me on the phone and said he couldnt find the items that were still missing but he found some receipts with my personal information on them and as I just stated he found these two CD's. We think that the crooks tried to replace them with the ones they stole, which belonged to my daughter. She keeps track of her cd's and magazines and even has her Brad Pitt pictures are in folders and itemized. i wish you could have seen the place where I had to go and get my property, what wasnt stolen. the window was boarded up with cardboard and it is one of the biggest crime areas in our town. I said all this to make the point that we were treated like common criminals when we came to get our property.

We were told that they didnt knock on our door or let us know they were there, because we would have shot them. The owner had some poor girl working alone to take the heat for his actions. I asked her if I could go through the vehicle to get my belongings and she said that the car was gone. They had driven it to Adesa as soon as they got it. I asked to speak to the manager and she called him on the phone. HE threatened to call the law on me because I asked him why I wasnt notified so I could get my belongings out. He said you could have shot me and I said, how, when I didnt know you were coming and I dont answer my door packing heat when someone rings the door bell. I said that is more your style by stealing people's property ,like a thief in the night.
Just the whole drama of having things stolen and what we have been throught notifying all these agencies over my social security card has been a nightmare. When the police notified the Repo guy, he copped an attitude with them too. The police told him that everybody who gets a car repoed is not a lowlife and he has no right treating people like that.
Somebody needs to tell Americredit that, also.

I am not the sharpest knife in the drawer, but I am smart enough to know when I have been SCREWED and not even kissed first.
Also, Sherri, we got a paper in the mail after the auction telling us how much the car sold for. IT is cheesy looking too and we have requested a professional one, that looks legitimate and have yet to receivet that either. Dang, I could scribble an amount on a post it note and send it to anyone too. WE have sent certified letters to the auction and also to Americredit and have yet to receive an answer back. Any legimitate company would supply their customers with legal documents that could hold up in court. Most upstanding companies are more than happy to supply their customers with these documents. THat is how you can tell Americredit doesnt fall under this category. They are sneaky, underhanded and just plain liars.

We were able to stop one poor lost soul from using them about two weeks ago. THis person was a friend of a friend and she had never purchased a car in her name. Guess who the dealership tried to put her with?????/ You guessed it. After she heard about my nightmare and I referred her to the rip-off reports, she went back to the dealership and said I dont want the loan if Americredit is all you have to offer. They put her with someone else.

I can only speak from experience and from what I have read from others about Americredit and it has not been a pleasant one for myself and for my family. IF we all live long enough, sometime in our life, we will all fall on some sort of hard time and there will be plenty of Americredits just waiting in the wings to take advantage of people. They make their money off the high interest rate, so there is no need in all the rest of the bullcrap they dish out to customers like they do. Adding trumped up interest charges, inventing late charges and not even abiding by govenment documents sent and faxed to them numerous times, is not a legitimate or professional business practice. THey do this to people because they can and until we all start fighting back, it will continue on.

I for one am not going to stop until justice is done. Their idea of customer service involves either ignoring you, or harassing the devil out of you and your family, friends, and so on. The favorite of all is passing you around from one dept to another and putting you on hold until you ACCIDENTALLY get cut off. Then you have to start the whole cycle all over again. You would think out of over 3,000 people working in customer service alone, they would have at least trained one or two in proper phone manners.

Good luck to anyone out there who has lived the Americredit Dream. Just hang in there and it will get better. There is life after Americredit.
Just try to spread the word to keep this from happening to others.....
