We began looking into the Anthem Highlands area of Broomfield in mid November 2011. We found a floor plan we wanted and began talking to a sales representative about it. We were interested in buying an inventory home but they persuaded us to build by giving us a 6% discount.

Before signing I asked about the surrounding areas and what the future plans were. The saleswoman's response was that Pulte would be using the existing neighborhood plan for the rest of the areas and may mix in a few new floor plans. We felt comfortable with this answer. We were aware they could sell it but because there were no warnings it didn't seem like something that would be happening in the near future.

I also contacted the city on two separate occasions to inquire about the surrounding areas and was told the same information given to me by the saleswoman.

The original deadline for this deal was December 1st. Our sales representative was able to get the deadline extended to mid December and was attempting to get it extended to the end of December. We told her we would sign on the last weekend before the mid December deadline (December 10th or 11th). She said she couldn't reserve lots and that we should sign a week earlier. Since we felt confident in the information we had been given, we agreed.

On the day of the signing she re-confirmed that the area across the way would be built using the same neighborhood design of our potential neighborhood with possible new floor plans.

On December 29th 2011 Pulte announced that they had sold not just the vacant land that was not yet platted and completely undeveloped, but also every single lot in our neighborhood that was not under contract to be built.

A sale of this magnitude was likely in the works for far longer than 3 weeks. Therefore, we had the right to know that this sale was imminent so that we could make an informed decision that was best for our family. We feel Pulte's actions of not informing us about the impending land sale as well as pushing us to sign much sooner than the stated deadline demonstrate an effort to secure our contract before we found out about the land sale.

They refuse to return our $5000.00 earnest money because of the contract we signed.  We signed thinking we were fully aware of what was going on.  We had no idea when we stepped foot in their neighborhood that a land sale was being negotiated.  We had no way of finding this out because they hid it from the public.  If we had known we would never have continued with them.  BAIT AND SWITCH.
