I have been paying this company $306 per month to pay off a debt that they bought from MNBA. I am in the process of refinancing my home to pay off this debt and all others. I called to ask if they would be willing to contact the credit bureaus and inform them that I have been paying towards this debt and the individual (I do have his name, etc, but I will not release that info at this time) said no. I asked why..he said it would be lying. I asked why and he said it would not be the truth. I asked "So you won't contact the bureaus?" and he said " No" and I said " it's not lying" and he said" yes it is" and I asked "what is the lie?" and he said "what is reported there is going to stay that way until the whole debt is paid off". So I asked then" if the report just stays the same there, and my payments are not aiding my fico score of then why should I keep paying it?" Well his tone of voice immediately changed. (we had started off very politely) He raised his voice and said "That is the dumbest, stupidest thing I have ever heard Ms (me) and I said "Why's that" and he said "Because we will sue you, slap a lien on your home and garnish 25% of your wages" Well I had already heard that from them before. I said " you can't take 25% of my wages" he said "yes I can, it is what you agreed to let happen when you signed for the credit card!" I said I don't remember that and could you please fax me a copy of that agreement and he said no. I asked "why not?" He said "I won't and you are copping an attitude Ms (me). I said, you're the one copping an attitude!

I'm just asking..and he interrupted me as he had been all along.. Right now you are paying off this account with no added interest or other fees, but I can change that and add them on!" I said "You can't do that!" and he said "Yes I can!" He went on to mimic me saying " why should I keep paying it.." "I said "you are not being very nice Mr (dip)" and he said "I don't have to be" and I said "No wonder you have the job you have" He said "You called 2 weeks ago for the same request!" I said, No I didn't!" "Yes you did!" "No I didn't!" Yes you did!" He then went on to inform me that he had just added on to my account that it will now be accruing interest and fees. It went on a bit more and I eventually hung up.

I feel this behavior was quite uncalled for. I had to report it. Even though I don't have the time to sit and type this, I couldn't let it drop.

I called MNBA and they said the agreement does not say that but they have sold the account to these folks, who are a subsidiary of Hilco Receivables. In fact, on the one letter I have from Apex, it says their client is Hilco Receivables, LLC. They refer to their client as they but they is their parent companyat one point I wanted to see if they would accept $150 or $200 instead of the $306. They have totally refused saying They won't accept that.

So, just thought I would pass this on to any one else having been offended by them. The experience did not upset me because I know it is their game. Their game is distasteful and unnecessary.

Linda,

Paying on that old charged off debt actually hurt your credit score, AND it restarted the 7 year negative reporting date. Even if you paid it off today, there would be a "paid collection" for 7 more years from today.

And, by paying on it, you re-affirmed it and restarted the Statute of Limitations on the legal collections of the debt.

The SOL for consumer debt in VT is 6 years from the time it first went delinquent.

And anyone other than the original creditor must prove you actually owe THEM the money, which they usually cannot.

Now that you have paid them, they can legally sue you and seek garnishment of your wages. However, I doubt they can get 25%. It is usually a percentage of your disposable income.
